SKYGATE’S “WIN A WINTER WARDROBE COMPETITION” FACEBOOK PROMOTION
Information on how to enter and the Prize forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of the Terms and Conditions.
Entry is only open to Queensland residents aged 18 years old or over. Employees and consultants of the Promoter and their immediate families may not enter.The Promotional Period commences at 9.00am AEST on 1/7/2013 and closes at 4.00pm AEST on 31/7/2013.
To enter, individuals must, during the Promotional Period:

Select the ‘Win a $500 Winter Wardrobe with Skygate’ Facebook Page Tab
Enter their first and last name, suburb, state, postcode, a phone contact and valid email address.
Accept these Terms and Conditions and submit their entry.
Continue to Like Skygate's Facebook page until the prize draw has completed.
Each individual may enter the promotion only once.
Incomplete, inaccurate or duplicate entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
A random draw of all eligible entries will take place at the head office of the Promoter after 12.00pm on 1/8/2013. The winner will be notified by telephone and/or email within two (2) business days of the draw and their name and image will be published online on Skygate’s Facebook Page. The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn will win a a $175 gift voucher for Country Road at DFO, a $150 voucher for Just Jeans at DFO, and a $175 voucher for Fossil at DFO (Prize).
The Prize is not transferable or exchangeable and cannot be taken as cash.
The Prize must be taken within 1 month of the draw date (unless otherwise agreed with the Promoter) or it will be forfeited.
If the Promoter delivers the Prize, then a registered post receipt, an express post receipt or a receipt from a courier will be evidence of the Prize being delivered.
A draw for any unclaimed Prize may take place at the head office of the Promoter on 5/8/2013, subject to any directions from a regulatory authority. Any winner will be notified and published as described at paragraph 8 of these Terms and Conditions.
If a Prize is not available for any reason, the Promoter may substitute an alternative prize to at least the value and of a similar standard as the Prize that is not available.
The Promoter makes no representation or warranty about the fitness for purpose or merchantable quality of the Prize.
Entrants consent to the Promoter using their name and/or image in the event they are a winner in any media for an unlimited period without remuneration for the Promoter's promotional and publicity purposes.
The Promoter may, subject to any written directions from a regulatory authority, modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage whether direct, indirect, special or consequential arising in any way out of the promotion or use of a Prize.
The Promoter collects personal information (including name, suburb, state, postcode, phone number and email address) in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending E-Newsletters, electronic messages or telephoning the entrant for Brisbane Airport purposes. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
