1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia and New Zealand aged 18 years or over. Individuals must have a Facebook account in order to access the promotional page.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences at 9:00am AEST on 16/07/2013 and ends at 11:59pm AEST on 23/09/2013 (“Promotional Period”).
5. There will be a draw conducted for the entries received each week of the Promotional Period (“Weekly Prize Draw”), for a total of ten (10) Weekly Prize Draws. Entries into each Weekly Prize Draw will close at 11:59pm AEST on the dates outlined in the second column of the table below ("Entries Close Date"). Entries into the first Weekly Prize Draw will open at 9:00am AEST on 16/07/2013, and entries into each subsequent Weekly Prize Draw will open as soon as entries into the previous Weekly Prize Draw close. The Weekly Prize Draws will take place at Below and Beyond, Level 22, 385 Bourke Street, Melbourne VIC 3000 at 10:00am AEST on the dates outlined in the third column of the table below (“Draw Date”). Un-drawn entries in each Weekly Prize Draw will be entered into any subsequent Weekly Prize Draw/s. If an invalid entry or ineligible entry is drawn, the Promoter may draw additional reserve entries in each Weekly Prize Draw and record them in order .

6. To enter a Weekly Prize Draw, individuals must complete the following steps during the Promotional Period:
a) visit the Handee Facebook Page at facebook.com/handeeitshandy("Handee Facebook Page");
b) become a fan of the Handee Facebook Page by clicking the ‘like’ button (if not an existing fan of the Handee Facebook Page);
c) follow the prompts to the promotion entry page;
d) select from the options available how they would choose to spend a $500 EFTPOS
Card (e.g. shopping, spa, etc.);
e) input the requested details (including their full name, telephone number and a valid email address);
f) read and consent to the Terms & Conditions by ticking the relevant tick box; and
g) submit the fully completed entry form so it is received by 11:59pm AEST on 23/09/2013 (or earlier if an individual wishes to be entered into more than one Weekly
Prize Draw – see clause 7).
7. To be in the draw for every Weekly Prize Draw, individuals must complete the above steps by 11:59pm AEST on the Entries Close Date for Weekly Prize Draw 1. If they do not do so, they will only be entered into the Weekly Prize Draw/s that are still open on the date the above steps have been completed.
8. Incomplete or indecipherable entries will be deemed invalid.
9. Only one (1) entry permitted per person and per Facebook account.
10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and Facebook account) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
12. The winners will be notified by telephone and in writing by email within two (2) business days
of the relevant draw, and their names will be published online at
www.facebook.com/handeeitshandy on 04/10/2013.
13. The Promoter’s decision is final and no correspondence will be entered into.
14. The first valid entry drawn in each Weekly Prize Draw will each win a $500 EFTPOS Card, awarded in the winner’s local currency. For the sake of clarity, any Australian winners will be awarded an AU$500 EFTPOS Card, and any New Zealand winners will be awarded a NZ$500 EFTPOS Card.
15. Any ancillary costs associated with redeeming the EFTPOS Card are not included. Any unused balance of the EFTPOS Card will not be awarded as cash. Redemption of the EFTPOS Card is subject to any terms and conditions of the issuer including those specified on the EFTPOS Card.
16. Subject to the unclaimed prize draw clause and to applicable laws, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.
17. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
18. Total prize pool value is up to AU$5,000.
19. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
20. A draw for any unclaimed prizes may take place on 30/12/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and in writing by email within two (2) business days of the draw, and their names will be published online at
www.facebook.com/handeeitshandy on 03/01/2014.
21. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
23. Any cost associated with accessing
www.facebook.com/handeeitshandy is the entrant’s responsibility and is dependent on the internet service provider used.
24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or Consumer Guarantees Act 1993 (NZ), as well as any other implied warranties under the ASIC Act 2001 (Cth) or similar consumer protection laws in New Zealand or the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) taking and/or use of a prize; or (f) any prize that is lost, stolen, damaged or tampered with in any way.
26. As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
27. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an
indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter. For full details on how personal information will be collected and used, please refer to the SCA Hygiene Australasia Pty Ltd Privacy Policy outlined below in Appendix 1.
28. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at
www.facebook.com/terms.php.
29. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
30. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
