Terms and Conditions
Information on how to enter and prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions.
Entry is open to residents of Australia aged 13 years and over, who participate in the ELLE Australia Billboard. Entrants under the age of 18 years must have prior parental or legal guardian consent to enter. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.
The entire promotion commences at 00:01am (AEST) on 15 July 2013 and closes at 23:59pm (AEST) on 11 August 2013 ("Promotional Period"). There will be four (4) weekly prize draws and One (1) major prize draw during the entire promotional period. Each individual draw period will open, close and be drawn on the dates and times stipulate in Table A. The draws will take place at the Promoter's premises, 54 Park Street, Sydney NSW 2000. Winners will be notified by email using the contact details provided in their entry. Winners of any prize valued at over $250.00 will be published in the public notices section of the Australian on the dates as stipulated in Table A.

It is a condition of entering the promotion that the entrants agree to the use of their image and message (entry) or to be interviewed, photographed and filmed at any time during the promotional period by the Promoter or their agents for a story or feature, future advertising or marketing material on this promotion to be developed and featured in any ELLE Australia magazine, website or social media sites (or any other form of media it deems suitable) without further remuneration or reference to the participant. Details may feature in any ELLE Australia on a date to be determined by the Promoter. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.

The entrant must not engage in any illegal or unsafe behaviour whilst participating in the entry (image). To the extent allowable by law, the Promoter and its partners exclude any legal liability or responsibility for legal or otherwise incidents or activities engaged in by the entrant or any person during participation in the entry (image).
By submitting an entry in the Competition, all Entrants warrant to the Promoter that each visual entry and message submitted is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
All entry media submitted becomes the property of Bauer Media Ltd (Promoter). As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entries to the Bauer Media Ltd.
The promoter will not be liable for any breach of copyright. The entrant will be solely responsible for their own entry and the consequences of submitting them. The entrant represents and warrants that:

All decisions relating to the conduct of Bauer Media Ltd and the Promotion, including, but not limited to, the selection of any and all parts of an entry to be included in any advertising or marketing of ELLE Australia, and the awarding of prizes, are at the sole and exclusive discretion of Promoter and are final and not subject to appeal. The Promoter's decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into.
Failure to comply with any term or condition may result in disqualification and/or forfeiture of Prize at the Promoter's sole discretion.
It is a condition of entering the promotion that the entrant warrants to the Promoter that they understand that any arrangement entered into in relation to the redemption of this prize or use of their entry does not create a relationship between the entrant and the Promoter of employer and employee, principal and agent, partnership or joint venture.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

For the removal of doubt, non-winning entries will roll over into weekly draw periods. However, all valid entries (winning and non-winning entries) received during the entire promotional period will be entered into the major prize draw.
Incomplete, indecipherable, or illegible entries will be deemed invalid.

Major prize:
At time of winner notification, the Promoter will ask the winner and their companion to nominate their sizing preference for the apparel. The Promoter will make all reasonable attempts to supply the apparel in the size stipulated by the winner at the time of winner notification, however in the event that for any reason whatsoever the sizing stipulated is unavailable at the time of the redemption of the prize, the Promoter will supply the apparel in the next sizing available closest to that stipulated by the winner at the time of winner notification.
In the event the winner is under 18 years, the winner must be accompanied by their parent or legal guardian when redeeming the prize.
Prize must be redeemed in full and as a package by 30 November 2013. Prize is subject to availability at the time of booking. The booking time of the flights will be determined by the promoter in its complete discretion.
Prize does not include transfers to and from the winner's place of residence to the departure point. These costs are the responsibility of the winner.
Redemption of prizes is subject to the standard terms and conditions of individual prize and service providers. Prizes do not include any ancillary costs associated with redeeming the prize.
The winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges and all other ancillary costs.
It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.
Two (2) flights must be utilized at the same time, for the same travel dates, to and from the same destination.
A valid passport is required for all international journeys. All passports must be valid for six (6) months prior to departure. It the responsibility of the winner and their travel companions to ensure they have all required travel documentation (including but not limited to passports & visas) as required for travel to the destination point. All costs associated with obtaining this travel documentation is the responsibility of the winner.
The winner and (their companion) are responsible to obtain all required documentation and visas to enter United States of America and Canada. If the winner should also be a U.S. citizens will require additional documentation to enter Canada. A Canadian visa may be required for Non-U.S. citizens; check your home country requirements for entering Canada. From 4 September 2010, the United States government will charge a US$14 as payment for the mandatory ESTA for all individuals proposing to travel to the United States under the Visa Waiver Program. The fee is payable by credit card and, it is very important to make payments through the official website. ESTA's official website is

The winner may extend their stay on the trip at the winner's expense.
Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner's sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter.
Prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the prize subject to the standard terms and conditions and guidelines of the accommodation venue and the activity service provider. Failure to follow the standard rules and guidelines presented will result in the winner forfeiting their right to participate in the said activity.
Weekly Prize:
Items included in the prize pack (including but not limited to colours, brands, designs, fragrances, textures, sizes etc) is determined by the Promoter/Elle Fashion Team in its complete discretion. In the event, the apparel chosen by the Elle Fashion Team is sold out at the time of winner notification, the winner will be awarded a voucher to ASOS to the value of $500.00 (AU). If any winner is awarded ASOS voucher as a prize, the winner will need to sign up to an ASOS.com account (if you don't already have one), so that ASOS (prize supplier) can credit the winner with the voucher amount. Please note that although this is an Australian competition the vouchers will be allotted in Pounds Sterling. Due to exchange rates this voucher will be worth the equivalent Pounds Sterling amount in Australian currency on ASOS.com on the date the winner chooses to spend the voucher; The winner may wish to set the currency to GBP in order to get the full value. The winner may spend the voucher value as they wish on ASOS.com, as long as the voucher is valid, but it cannot be used against purchases made on Marketplace, Fashion Finder, ASOS Premier, to buy ASOS Gift Vouchers or to be redeemed against shipping costs. If the winner is under the age of 18 years, the prize will be awarded to the winner's parent or legal guardian on behalf of the winner. It is the responsibility of the winner's parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant., the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. If necessary, an unclaimed prize draw will be held on 11 November 2013 at the same time and place as the original draws in order to distribute any unclaimed. Any winner from this draw will be notified by email and their name will be published on 14 November 2013.
