Travel on Sale Capture the Spirit of Asia photography competition terms and conditions

1) Entry into the competition is deemed acceptance of these terms and conditions. This is a promotion by Travel on Sale owned and operated by Pinpoint Travel Group, Level 3, 34 James Craig Road, Rozelle, Sydney, 2039. ABN 70 003 745 999 Lic No 2TA002974.
2) Entry is open to all residents of Australia over the age of 18 (not company organisations). Entry to competition is free. Each Facebook ID can enter up to 5 entries. However, employees and their immediate families of Pinpoint Travel Group, and their associated agencies and companies are not eligible to enter to win but are able to vote.
3) The competition opens on 19th June 2013 and entries close 21st August 2013 at 23:59 AEST.
4) How to enter: Entry must be made via the Facebook application on Travel on Sale; entrants must first “like” the Travel on Sale Facebook page. Entrants must complete the form, upload their photograph and agree to these terms and conditions. The entrant may only submit original material in which the entrant owns the copyright, if the promoter suspects that the entrant does not have copyright ownership of an entry, the photo will be removed and the entrant might be contacted. The entrant must not submit material that is unlawful, offensive, threatening, abusive, defamatory, derogatory, obscene and indecent or that is sexual or pornographic in any nature or that advertises or promotes any commercial purpose; the promoter reserves the right to remove all such entries without notification.
5) 5) Each entrant agrees that the Promoter may use the photo entry and any personal details provided to the Promoter for commercial, promotional, marketing and publicity purposes of the Promoter in any media without limitation, without notice and without any fee paid to the entrant or other person in the photo. The entrant must obtain consent from any person that is present in the photo for all the purposes listed above.
6) Each entrant warrants that any details provided with his/her entry are true and accurate and the entrant will indemnify the Promoter against any loss or damage resulting from any breach of these warranties.
7) The entries will be open to a public vote using the Facebook application, to vote for an entry the user must first “like” the Travel on Sale Facebook page, followed by voting for the favourite entry. Voting opens after the first entry has been submitted, and closes 2nd September 2013 at 12:00 noon AEST. The 8 photos with the most votes when the competition closes will go forward to the second round of judging that will take place on 9th September 2013 at 34 James Craig Road, Rozelle, 2039. This is a game of skill and the 8 short listed entries will be judged by a panel of 3 people in the Travel on Sale team who will select the winning 3 photos based on the following criteria, representation of Asia, creativity in capturing the spirit of Asia, composition, colour and lighting. The winners will be notified using the email submitted in the entry within 2 business days of the judging.

9) The winners should be in accept the prize within 5 days by a confirmation email; should the winner not accept the prize the next photograph/s with the most votes will be contacted within 15 days of the competition closing. On acceptance of the prize the winners and their entry will be promoted on Travel on Sale Facebook page.
10) The total prize value is $4,330 and consists of 3 prizes. First prize at InterContinental Bali Resort, 5 star, 4 nights staying in a Singgaraja room including breakfast and a 60 minute Balinese Massage for 2 people, prize value $1,412. Second prize at Bali Mandira Beach Resort & Spa, 4 star, 4 nights staying in a Superior Room including breakfast for 2 adults and 2 children, prize value $1,468. Third prize at Bali Dynasty Resort, 4 star, 4 nights staying in a Family Studio Room including breakfast for 2 adults and 3 children, prize value $1,450. Indication of the value of the prize is based on current retail value at the time of launch. No discounts can be given for any variation in price at the time of redemption. The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date. (Note: flights and transfers are not included in the prize).
11) The winner must redeem their prize with Travel on Sale before 30th October 2013 and travel must be completed before 31 May 2014 at the InterContinental Bali Resort; 31 March 2014 at the Bali Mandira Beach Resort & Spa and ; 30th April 2014 at the Bali Dynasty Resort. Advance reservation is required at least 6 weeks prior to departure; however it is advisable to book as early as possible to avoid disappointment. The prize is subject to availabilityand blackout dates apply these may include Australian school holidays and/or any special events indicated by the hotel. Where possible the hotels will endeavour to fulfil the winner’s holiday choice and dates, however alternative dates must be selected by the winner if accommodation is not available.
12) This competition may be promoted through various channels, including; landing pages, microsites, Facebook and emails, three winners will be judged from entries from all sources using the Facebook application. (This list is not exhaustive).
13) Prize winners are advised that tax implications may arise from their prize winning and they should seek independent financial advice prior to the acceptance of the prize.
14) It is the responsibility of the prizewinners to ensure that they and their travelling companion have a valid passport for travel and that it valid for at least 6 months after the arrival back to Australia.
15) The winners agrees to their name, suburb of residence and imagery being used in future promotional and marketing purposes, for an unlimited length of time with out remuneration.
16) Each entrant agrees that the promoter may collect their personal information and use it to provide the entrant with marketing material via, mail, telephone and electronic messages for an indefinite period of time. By opting-in, the promoter may share information collected with its affiliated partners who may also contact the entrant in these ways. 17) Products included in the prizes cannot be substituted or forfeited for cash. No items are transferable.
18) The prize, or any unused portion of the prize, is not exchangeable for other goods or services and cannot be taken as cash. The prize is not transferable. Without limiting the above, the prize or any component of the prize cannot be sold on e-Bay or any other online auction site. The prize must be taken as offered and cannot be varied. The prize may be redeemed by the winner only. No relative, partner or friend of a winner may claim any part of the prize nor may the winner transfer any part of a prize to any other person. The prize may be used by the winner plus any other 3rd party inclusive in their booking.
19) The winner and their companion are responsible for all other expenses including flights, transfers, passports, visa applications (if applicable), spending money, meals, drinks (alcoholic/non-alcoholic), activities, incidentals, energy surcharges, gratuities, in country taxes, services charges, travel insurance (Travel on Sale highly recommend all travellers to take out adequate travel insurance) and all other ancillary costs.
20) The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
21) By accepting the prize, the winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
22) It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize and the prize supplier’s requirements.
23) In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
24) The promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability, which cannot be excluded by law. The promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
25) The promoter reserves the right in its sole discretion to disqualify any individual who the promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
26) Entrants can only enter in their own name. The promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm each winner’s identity, age, residential or email address, eligibility to enter and claim the prize and any information submitted by the winner in entering the promotion, before issuing the prize. If the documentation required is not received by the promoter or the winning entries have not been verified or validated to the promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The prize will only be awarded following any winner validation and verification that the promoter requires in its sole discretion.
