2014 Formula 1® Australian Grand Prix

1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
o The Promoter is Network Ten Pty Limited (ACN 052 515 250); and
o The Prize Supplier is Australian Grand Prix Corporation Level 5, 616 St Kilda Road, Melbourne VIC 3004 (ACN 86 947 927 465).

2. Entry is open to Australian residents only who are 18 years of age or over. Employees (and their immediate families) of the Promoter and the Prize Supplier and agencies associated with this promotion are ineligible to enter the promotion.

3. Promotion commences at 09:00am (AEST) on Sunday 22/09/2013 and closes at 11:59pm (AEST) on Monday 18/11/2013 (the promotion period).

4. Entrants are required to hold a valid ticket to the 2014 Formula 1® Australian Grand Prix (Event), purchased before or during the promotion period in order to submit a valid entry. Entrants are required to complete the online entry form on tensport.com.au with the requested details. Entrants may be required to answer a question in order to be eligible to enter the competition.

5. The competition will be advertised on Channel Ten, www.ten.com.au and www.tensport.com.au. Online entry is open to Network Ten website members (existing and new during the promotion period). It is free to become a member however fraudulent memberships/entries will not be accepted and will be deemed invalid. These competition Conditions of Entry apply in conjunction with the Network Ten Online Members rules
.

6. The winner will be judged, on 19th November 2013 AEST at the premises of the Promoter. The most creative answer as determined by the Promoter will be deemed the 'major winner'. Judges/Promoters decision is final and no correspondence will be entered into. A winner is considered to have made a valid entry if they have a valid ticket purchased before or during the promotional period (Ref Clause 4). If the first selected winner fails to provide proof of purchase, the prize will go to the next best entry as determined by the Promoter, until a valid winner is found. Ticket validation will be conducted by the Prize Supplier.

7. Prizes cannot be transferred, exchanged or redeemed for cash. The winner will be notified by phone within 2 days of the judging and in writing.

8. To submit a complete and valid online entry, entrants will be required to provide various personal details including full name, email address, residential address, contact phone number/s, date of birth and gender for the purpose of verifying eligibility. Any contact details entered incorrectly shall invalidate the entry. Online entry is free however internet connection rates apply.

9. One (1) online entry per ticket holder is permitted throughout the promotion period, subject to each entry being submitted in accordance with entry requirements. Each entrant must be a member of the relevant Network Ten website to submit a valid entry.

10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at
any stage does not constitute a waiver of those rights. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, and PO Box addresses. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

11. Entries must be received by 11:59 pm (AEST) on 18th November 2013. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.

12. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.

13. Prize Details:
One x F1 two-seater Hot Lap for the winner consisting of 1 x ‘out’ lap and 1 x ‘in’ lap per passenger or as otherwise determined by the Promoter in its discretion and having regard to race control requirements at, or during the week of, the Event (Hot Lap) and a photograph taken during the activity by an official photographer of the Promoter (the “Hot Lap Prize”).

14. The winner may, upon written agreement by the Promoter and Prize Supplier prior to the Event, transfer the prize to another Event attendee (the ‘Nominated Participant’).

15. The Promoter, the Prize Supplier, and their associated agencies reserve the right to refuse to allow a winner or Nominated Participant to take part in any or all aspects of the prize, if the Prize Supplier determines, in its absolute discretion, that a winner or Nominated Participant is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner (or Nominated Participant if applicable) agrees to sign, prior to taking part in the prize, a legal release in a form determined by the Prize Supplier or its associated agencies in its absolute discretion.

16. The winner or Nominated Participant will be required to have a blood alcohol reading of zero to be able to participate in assisting with the official start. . If required, the winner or Nominated Participant agrees to participate in a test to determine whether alcohol is present and understands that they will not participate in the flag waving activity if the alcohol reading is above zero.

17. The Nominated Participant may, at the Nominated Participant’s cost (such cost to be reasonable and to be confirmed with the Promoter in writing prior to being incurred), organise and undertake a compulsory medical examination (which may include an ECG test) to obtain medical clearance by the date specified by the Promoter. The Nominated Participant consents to the test results being made available to Confederation of Australian Motor Sport Limited for the purpose of assessing fitness to participate in the Hot Lap Prize.

18. In order to participate in the Hot Lap Prize, the winner or Nominated Participant must also be within the following age, height, weight and body dimension restrictions:
Minimum age: 16 years (anyone under 18 years must have the written consent of a parent or guardian)
Maximum height: 1.8 m (6ft)
Minimum height: 1.58 m (5 ft 2 in)
Maximum weight: 88 kg (14 stone)
Maximum girth (including upper arms): 139.7cm (55 in)


19. The prize must be taken in accordance with these Conditions of Entry.

20. The winner is responsible for making their own way to the Event at the time stipulated by the Prize Supplier or its associated agencies. In the event that the winner does not arrive at the time determined by the Prize Supplier the prize will be forfeited and no compensation will be provided (subject to State Regulations).

21. The winner must comply with the Attendance Conditions to the Event (copies of which are displayed at entrances to the Event or available at www.grandprix.com.au). The winner acknowledges and agrees that those elements of the prize relating to the Event will be subject to any additional conditions or directions imposed by the Prize Supplier, rights holder and race officials, including regarding participation in elements of the prize, attendance times and attending briefings for participation in elements of the prize and the signing of the release and waiver of liability form referred to above, in such form as may be required by the Prize Supplier in its absolute discretion.

22. The prizes must be taken as offered and cannot be varied. The prize is not transferable, exchangeable or redeemable for cash. The prize must be taken during the Event at a time determined by the Prize Supplier. No extension or variation of these dates will be permitted.

23. If for any reason a prize becomes unavailable due to circumstances outside of the Promoter or the Prize Supplier’s reasonable control, the Promoter and/or Prize Supplier reserves the right to award a similar substitute prize of equal value, subject to State or Territory legislation.

24. Entrants must only enter in their own name. The Promoter and/or Prize Supplier reserves the right to request the winner or Nominated Participant to produce appropriate photo identification or other documentation (to the Promoter or Prize Supplier’s satisfaction) in order to confirm their identity, age, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion before issuing or transferring a prize. If the documentation required by the Promoter and/or Prize Supplier is not received by the Promoter and/or Prize Supplier (or its nominated agent) or the winning entrant has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

25. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter.

26. If the winner or Nominated Participant (for whatever reason) is unable to attend the Event on the specified dates or if the prize remains unclaimed within 72 hours of the competition closing date the judges reserve the right to select the next best entry judged from all valid entries received.

27. ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING, WITHOUT LIMITATION, PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN.

28. Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in the prize is at entrant’s (and/or their Nominated Participant’s) own risk. Entrants
acknowledge that the risks associated with attending the Event and participating in the prize (or part of) include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize (or part of) has a degree of danger and, to the extent permitted by law (in particular the Australian Consumer Law and Fair Trading Act 2012 (Vic) and the Competition and Consumer Act 2010 (Cth)), hereby exclude, release and forever discharge the Promoter, the Prize Supplier, the Crown in right of the State of Victoria, the Minister administering the Act, the Minister administering the Crown Land (Reserves) Act 1978 (Vic), Federation Internationale de l’Automobile, Formula One World Championship Limited, Formula One Management Limited, Formula One Licensing B.V., Formula One Asset Management Limited, Formula One Hospitality and Event Services Limited (UK), Allsport Management S.A., Formula One Marketing Ltd, Confederation of Australian Motor Sport Limited (CAMS), Parks Victoria, the State Sports Centres Trust, APP Corporation Pty Limited (ACN 003 764 770), Event sponsors and all other persons involved in the organisation, conduct and promotion of the Event or the prize, including officials, marshals, rescue and medical staff), the competitors and drivers (such parties to include where relevant all directors, officers, employees, agents, contractors and affiliated companies) and their respective personnel (Associated Entities) from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with participation in Recreational Services (as defined below) at the Event, including the prize (or part of).
To the extent permitted by law (in particular the Australian Consumer Law and Fair Trading Act 2012 (Vic) and the Competition and Consumer Act 2010 (Cth)), entrants acknowledge that, to the extent to which they participate at the Event in:
 a sporting activity or similar leisure time pursuit; or
 an activity that:
a. involves a significant degree of physical exertion or physical risk; and
b. is undertaken for the purposes of recreation, enjoyment or leisure,
(Recreational Services), including, without limitation, participation in the prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.
WARNING: If an entrant (including a winner or their Nominated Participant or companion) participates in these activities their rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 (Vic) if they are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in the Conditions of Entry.
NOTE: The change to an entrant’s rights as set out in this notice, does not apply if their death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Australian Consumer Law and Fair Trading (Recreational Services) Regulations 2012 (Vic).
For the purpose of this Condition 28 “the supplier” will mean and include the Associated Entities.
Without limiting any other release or limitation of liability contained in these Conditions of Entry, and except for any liability that cannot be excluded by law, the Promoter, the Prize Supplier and the Associated Egencies and companies (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury or death which is suffered or sustained; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s/Prize Supplier’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or the Prize Supplier; (d) any variation in prize value to that stated in these Conditions of entry; (e) any tax liability incurred by a winner or entrant; or (f) the use of or participation in the prize and attendance at the Event. Entrants expressly acknowledge that the Prize Supplier, and not the Promoter is supplying and administering the provision of the prize to the winner.
Nothing in this Condition 28 or these Conditions of Entry generally affects an entrant’s rights under the Competition and Consumer Act 2010 (Cth), Australian Consumer Law and Fair Trading Act 2012 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions and warranties cannot be excluded by law.

29. In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any applicable laws or written directions made under applicable State or Territory legislation, reserves the right to cancel, terminate, modify or suspend the promotion.

30. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter or the Prize Supplier which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.

31. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for (i) tampering with the entry process (ii) submitting an entry which is not in accordance with these Conditions of Entry and/or (iii) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

32. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

33. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, or any other technical failures including any damage to entrant's or any other person's computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

34. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (and will procure the consent of a their
Nominated Participant if applicable) (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), promoting any products manufactured, distributed and/or supplied by the Promoter, or in the promotion of an event held by the Prize Suppler. The winner agrees to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

35. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained via the website www.ten.com.au.
