LA EXPERIENCE & COMPETITION - TERMS AND CONDITIONS

General Terms & Conditions:

             Entry into the PeepToe & LA Experience Competition is open to all residents of Australia over the age of 21 years of age.
    ·         The Promoter is PeepToe, Unit 4, 19 – 21 Bourke Rd Alexandria NSW 2015.  Information on how to enter forms part of the terms of entry.  Entry into the Competition is deemed acceptance of these terms and conditions.
             The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter and the agencies associated with this Competition are not eligible to enter.
             Competition begins on Monday the 11th November at 1.00pm AEST, and ends on the 9th December at 1.00pm AEST.

To enter the Competition and be eligible to win, entrants must:

             be over the age of 21 years
             Become a fan of the official PeepToe Facebook page – if they are not already.
             Complete the online entry form on the PeepToe facebook page.
             All entries must include the entrant’s name, email address, age and postcode to be eligible for entry. Incomplete entries will be ineligible. The Prize winner will be notified by email address as supplied on the entry form.

Prize Terms & Conditions:

There is 1 prize to be won.  The prize consists of:

             One x 4 night tour with LA Experience for x 1 person valued at USD $4950.00. Inclusions are as per the tour itinerary outlined on www.laexperience.com
             One return flight from Sydney to LAX valued at $1000.00 + (price dependent on exact flight)

o   If you do not live in Sydney you will have to travel to and from Sydney airport at your own expense as this is where your international flights will leave from and return to.

o   Winner will have to liaise with a contact from Kabuki PR to book in their flights for MAY 2014.


             The Prize values are the recommended retail values as provided by the supplier and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed.
             The prize is for the LA Experience tour running May 2014. If this tour does not run due to insufficient numbers, the prize winner will be offered alternative dates.
             Prize-winner may opt to nominate to transfer the prize into someone else’s name. This must be in writing and agreed in writing by LA Experience. Prize-winner’s nominee will agree to all terms as deemed in the Official Rules

Judging and award of the prize:

             The draw will take place online via the services of the Shortstack Pick Random Entries feature (www.shortstack.com). The draw date will be 11:00am Tuesday 12th December 2013. This is a game of chance. Each entry will be entered into the draw. The winner will be drawn at random.
             If the Prize winner cannot be contacted or does not claim the Prize by 18th December 2013, then the Prize will be forfeited and redrawn and a substitute prize will not be offered in lieu of the Prize.

Other Terms & Conditions:                                                                                                       

1.            All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner/s or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered.

2.            The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel or vary the Competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):

(a) a Prize winner does not satisfy the Competition entry requirements; or

(b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.

3. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:

(a)          be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and

(b)          be required to conduct the Competition at any other time.

4.            Entrants are advised that “opt-in” entries will be entered into a database and the Promoter and LA Experience may use the entrant’s personal information for future promotional and marketing. By opting-in, entrants confirm that they allow their details to be used for this purpose by the Promoter and LA Experience. The Promoter will only use this information for their own requirements and will not share this information with any third party as stipulated in the Promoters privacy policy which can be viewed at http://www.laexperience.com.

5.            No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter will accept no responsibility for any delays to entry caused by technical disruptions or malfunctions. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.

6.            The Promoter reserves the right to cancel the award of prize/s to, and/or to disqualify any individual who, as determined in the sole discretion of the Promoter, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition.

7.            Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation.

8.            A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.

9.            Entrants are advised that the Promoter will use their experience in Los Angeles via social media outlets. Photos of them during the trip in LA will be shared by both the Promoter and LA Experience. You agree that LA Experience may take photographs and films of you while on this tour and that those may be used for publicity and promotional purposes without any further consent or compensation to you.

10.          Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.
