Terms & Conditions
Long form terms & conditions1. Information on how to enter and prize details form part of these conditions (Terms and Conditions). Participation in this Promotion is deemed acceptance of these Terms and Conditions.

Entry to the Promotion is open to Australian and New Zealand residents aged 13 years and older (Eligible Entrants). Directors, management and employees (and their immediate families) of the Promoter and suppliers, companies and agencies associated with this Promotion are ineligible to enter
4. Eligible Entrants aged under 18 years must obtain the consent of their parent or legal guardian to participate in the promotion and to provide personal information about themselves. All Eligible Entrants who are under the age of 18 years and participate in the promotion without disclosing (or attempt to conceal) their age (as and where required) and/or do not provide the required parental consent (as and where required) will be deemed invalid. These Terms and Conditions will bind Eligible Entrants who enter the promotion and any parent or legal guardian who gives their consent for Eligible Entrants aged under 18 years.
5. The Promotion commences at 9am AEDT on Friday 6th of December, 2013
and closes at 5pm AEDT on Sunday 15th of December, 2013 (Promotion Period. All entries are deemed to be received by the Promoter at the time of receipt by the Promoter and not at the time of transmission by the entrant.
6. To enter, an Eligible Entrant must, during the Promotion Period, click on the "like" button on the McCain Facebook page at
www.facebook.com/[insert address] and provide in 25 words (or less) what their yummiest summer pizza toppings are. Entries must be posted in the comments section of the McCain Facebook page. Entries must be original and not copied from any copyright works.

Only one (1) entry permitted per individual.8. Incomplete, indecipherable or illegible entries will be deemed invalid.
9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and country of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10.If there is a dispute about the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
11.This is a game of skill; chance plays no part in determining the winners. Each entry will be individually judged, by judges appointed by the Promoter, based on originality and creative merit of the entry. The best twenty (20) valid entries across Australia and New Zealand, as determined by the judges, will each win a limited edition McCain pizza cutter, valued at AUD$18 (Prize).
12.The winning entries will be judged by the Promoter in accordance with clause 11 above on the 18th of December, 2013. Winners will be notified by private message on Facebook and announced via the McCain Facebook page. Winners must provide their full name and postal address to the Promoter upon request in order to receive the Prize.
13.The Promoter's decision in relation to any aspect of the competition and, in particular, the selection of winners, is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries.
14.Prizes for Eligible Entrants will be despatched to the address in Australia or New Zealand supplied by the Eligible Entrants in accordance with clause 12 within 28 days after being notified that they have won a Prize. The Promoter accepts no responsibility for: (a) any damage or loss of the Prize in transit; nor (b) any costs associated with using the Prize.
15.If any Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and substantially the same as the specification of the Prize.
16.Each Prize is valued at approximately AUD$18 being the recommended retail price including GST. The value of the Prize is accurate at the date of the commencement of the Promotion Period. The total prize pool value is valued at up to approximately AUD$180. The Prize is not transferable, exchangeable or redeemable for cash.
17.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
18.All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each Eligible Entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each Eligible Entrant warrants to the Promoter that each entry submitted is an original work of the Eligible Entrant that does not infringe the intellectual property rights of any third party. The Eligible Entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Eligible Entrants consent to any use of their entry which may otherwise infringe their moral rights.
19.It is a condition of entry into the Promotion that Eligible Entrants consent to the Promoter and its related bodies corporate and their agents using the Eligible Entrant's name, likeness, image and/or voice in the event they win a prize (including photographs, films and/or recordings of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or under the Consumer Guarantees Act in New Zealand (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
21.By participating in the promotion, each Eligible Entrant also acknowledges that a further primary purpose for collection of the personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact Eligible Entrants in the future with information on special offers or provide Eligible Entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian and New Zealand related companies and promotional partners who may contact Eligible Entrants with special offers in this way. By entering the promotion, each Eligible Entrant agrees that the Promoter may use personal information in this manner. Eligible Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below or at the contact details stated in the Promoter’s Privacy Policy. All personal information will be stored at the office of the Promoter.
