TERMS AND CONDITIONS OF ENTRY FOR THE VALENTINE’S DAY PROMOTION.
 
By entering the Michel’s Patisserie ‘Valentine’s Day’ Promotion (the “Promotion”) and clicking ‘Post’, you are agreeing to the
following terms and conditions (“Terms and Conditions”)Bad
 
1.1 Information on how to enter and the prizes form part of these Terms and Conditions. All entries must comply with these
Terms and Conditions to be valid.
1.2 The Entrant is responsible for ensuring his or her familiarity with the Terms and Conditions at the time of participation. The
Promoter’s decision not to enforce a specific restriction (whether communicated to an Entrant or not) does not constitute a
waiver of that restriction or of the Terms and Conditions generally.
1.3 All entrants acknowledge that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of a
person’s ineligibility after the Promoter has awarded a prize to the ineligible person. Return of the prize or payment of its
equivalent value to the Promoter may be required by the Promoter if this occurs.
2. Eligible Entrants
2.1 Entry is open to Australian residents only.
2.2 Employees of the Promoter, including all retail staff, and their immediate families (including spouse, ex-spouse, de-facto
spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle,
aunt, niece, nephew, bother, sister, step-brother, step-sister or cousin) and associated agencies, providers and companies of
the Promoter associated with this Promotion are not eligible to enter.
2.3 Entry to the Promotion is only open to individuals aged 13 years or older (and who have their parent/guardian’s permissions
to participate if under 18 years of age) who have a valid and current Facebook account (or who create a valid Facebook
account during the Promotion Period)
2.4 Entrants can only enter in their own name and from their own Facebook account. The Promoter reserves the right to verify
the validity of entries and Entrants (including age and place of residence) and to disqualify any entrant who submits an entry
that is not in accordance with these Terms and Conditions or if the Entrant is engaged in any unlawful or other improper
conduct which jeopardises the proper conduct of the Promotion. The Promoter’s legal right to recover damages or other
compensation in such instances is reserved. If the Promoter suffers loss or incurs any costs in connection with any breach of
the Terms and Conditions or any other legal obligation of the Entrant, the Entrant agrees to indemnify the Promoter for
those losses, damages and costs.
2.5 Individuals who meet the criteria in this Condition 2 are Eligible Entrants.
3. Promotion Period
3.1 The Promotion commences at 5.00pm (AEST) on Thursday 30 January 2014 and closes at 9.00am (AEST) on Wednesday 12
February 2014 (“Promotion Period”).
3.2 The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period.
4. How to Enter
4.1 Entry is via the internet.
4.2 To be eligible for entry, an Eligible Entrant must, during the Promotion Period:
(a) Visit www.facebook.com/michelspatisserie (“Page”) and become a fan of the Page by clicking the ‘like’ button
(if they are not already a fan of the Page);
(b) Provide a response to the following question as posted on the Michel’s Patisserie Facebook Page on Thursday 30 January 
2014: “Describe in twenty five (25) words or less, which Michel’s Patisserie Valentine’s Day product you are going to spoil
your loved one with and why?”
(c) Click ‘Post’ to submit a response so it is received during the Promotion Period (“Entry”).
4.3 By submitting a response, participants are agreeing with the Terms and Conditions posted as a link in the Facebook post
containing the Promotion question.
4.4 Entrants acknowledge that their responses will be viewable by the public.
4.5 Any rude, defamatory, offensive, illegal, incomprehensible, incorrect or incomplete Entries (all of which will be at the
absolute discretion of the Promoter), or which breach any law or infringe any third party rights, including intellectual
property rights will be invalid and may be removed by the Promoter in its absolute discretion.
5. Prize Draw & Notification of Winners
5.1 At 12.00pm AEST on Wednesday 12 February 2014 (“Prize Draw Day”), the Promoter will select the top ten (10) most
creative Entries, as determined by the Promoter (in its absolute discretion and based on these Terms and Conditions) (the
“Winners”) who will each win a Prize. Judging will take place at 1 Olympic Circuit, Southport QLD 4215.
5.2 This Promotion is a game of skill and chance or luck plays no part in determining the Winners. Each Entry will be individually
judged based on creative merit of the answer provided to the question contained in the entry and having considerations for
the Michel’s Patisserie brand.
5.3 The Winners will be announced on the Promoter’s Facebook Page at www.facebook.com/michelspatisserie by 2.00pm AEST
Wednesday 12 February 2014 and remain published for a period of time determined by the Promoter in its absolute
discretion.
5.4 Each Winner will be required to contact Michel’s Patisserie via private message on Facebook and provide their personal
details on or before Thursday 13 February 2014 so that redemption of the prize may be arranged.
6. Prizes
6.1 Each Winner will receive
6.1.1 two (2) x $25.00 Michel’s Patisserie Gift Vouchers which will be valid for one year from the date of issue; and
6.1.2 Michel’s Patisserie Valentine’s Day product range worth $31.50 consisting of the following:
(a) Michel’s Patisserie Valentine’s Day Individual Mud Cake;
(b) 2 x Michel’s Patisserie Valentine’s Day red velvet cupcakes; and
(c) 2 x Michel’s Patisserie Valentine’s Day chocolate cupcakes.
6.2 Each Prize is worth $81.50 based on Recommended Retail Prices. The total prize pool for the promotion is $815.00.
6.3 The 2 x $25.00 Michel’s Patisserie Gift Vouchers will be mailed via Express Post to each Winner at their nominated address
when they confirm their details in accordance with Condition 5.4 above.
6.4 Each Winner will be required to collect their Valentine’s Day products outlined in Condition 6.1.2 above, in person, from
their nominated Michel’s Patisserie store by no later than 4.00pm AEST on Friday 14 February, 2014. Each Winner will be
required to provide formal identification to collect their prize. Once the Prize has left the Michel’s Patisserie franchised
outlet, the Promoter takes no responsibility for any damage or loss that may occur.
6.5 The Promoter requires at least 24 hours’ notice by each Winner to arrange delivery of the prize to the Winner’s nominated
Michel’s Patisserie store.
6.6 If the Prize or a part of the Prize is unavailable, for whatever reason, the Promoter, in its absolute discretion, reserves the
right to substitute and or vary the Prize (or a part thereof) with a prize to the equal value and or specification, subject to any 
direction from a State and/or Territory regulatory authority where necessary.
6.7 The Prize or any unused portion of the Prize is not transferable or exchangeable and cannot be taken for cash. Any ancillary
costs associated with redeeming the Prize is not included and must be borne by each Winner. If for any reason a Winner does
not take a Prize (or any portion of that Prize) by the time stipulated by the Promoter, the Prize (or any unused portion of that
Prize) will be forfeited.
7. Facebook
7.1 Entry and continued participation in the Promotion is dependent on the Entrant following and acting in accordance with the
Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
7.2 This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand
that they are providing their information to the Promoter and not Facebook. The information any Entrant provides will only
be used for the purposes outlined in the Terms and Conditions. Any questions, comments or complaints about this
Promotion must be directed to the Promoter and not to Facebook.
7.3 Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an Entrant, as a result
of participating in the Promotion except for any liability which cannot be excluded by law.
8. General
8.1 The Promoter’s decision in relation to any aspect of these Terms and Conditions and the Promotion is final and binding on
every person who enters. No correspondence will be entered into. Prizes will only be awarded following any winner
validation and verification that the Promoter requires.
8.2 Entries are deemed to be received at the time of receipt into the Promoter’s database, not time of transmission by the
Eligible Entrant.
8.3 Any costs associated or arising in connection with winning a prize or, with accessing the promotional website or Page is the
entrant’s responsibility and is dependent on the internet service provider used. Eligible Entrants must submit their entries
manually using an internet browser.
8.4 The Promoter reserves the right, at any time, to verify the validity of prize claims/entries and entrants (including an entrants
identity, age and place of residence) and to disqualify any entrant who submits a prize claim that is not in accordance with
these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoters
discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8.5 If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the
identity of the Entrant. If the Winner cannot be identified or otherwise contacted by the Promoter, the Promoter reserves
the right to select another Entrant as the Winner.
8.6 Entrants consent to the Promoter using their Creative Responses and agree to transfer all intellectual property in their
Creative Responses to the Promoter once an entry is made.
8.7 If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any
reason beyond the control of the Promoter, the Promoter reserves the right, to the fullest extent permitted by law to (a)
disqualify any Entrant; or (b) to modify, suspend, extend, terminate or cancel the Promotion.
8.8 Nothing in the Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer
guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under similar
consumer protection laws.
8.9 A request by en Entrant to change or modify any information provided should be directed to the Promoter in writing.
8.10 Entrants consent to the Promoter using the Entrants name, likeness, image and/or voice in the event they are a Winner in
any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any
outcome), and promoting products manufactured, distributed and/or supplied by the Promoter. 
8.11 All entries become property of the Promoter. By entering this Promotion, each entrant is taken to consent to the Promoter
and Michel’s Patisserie using the Entrant’s personal information to administer the Promotion, announce the Winners and
disclose the Entrant’s personal information to organisations that assist the Promoter and Michel’s Patisserie with
administering the Promotion and announcing the Winner, and to third parties as required by law (including authorities that
regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by
entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy. Entrants can view the privacy policy
at http://michels.com.au/privacy-policy/. This can also be provided on request.
8.12 Any tax liability arising as a result of accepting any prize is the responsibility of each Winner.
8.13 The use of any automatic entry software or any other mechanical or electronic means that allows an entrant to
automatically enter the Promotion repeatedly is prohibited and will render all entries submitted by that entrant invalid.
8.14 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, agents and related
bodies corporate) shall not be responsible for and excludes all liability (including negligence) for any personal injury, or any
loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the
following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any
theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or
misdirected (whether or not after their recept by the Promoter) due to any reason beyond the control of the Promoter; (d)
any tax liability incurred by the Winners or any Entrant; or (e) taking of and redemption of the Prize.
8.15 If for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs,
network failure, tampering, unauthorised intervention, fraud or any of causes outside the Promoters control including but
not limited to war, terrorism, state of emergency, disaster or which corrupt or affect the administration, security, fairness,
integrity or proper conduct of the Promotion, the Promoter reserves its right, in its absolute discretion, to take any action
that may be available to it, including cancelling, terminating, modifying or suspending this Promotion.
8.16 The laws of Australia apply to this Promotion. Entrants submit to the exclusive jurisdiction of the courts of Australia.
