Glen 20 – Star in the Glen 20 TVC and Westfield Gift Cards ("Competition")

Terms and Conditions


1.Information on how to enter and prizes form part of these terms and conditions. By participating, entrants agree to be bound by these conditions. Entrants must comply with these conditions to be valid.

2.The Promoter is Reckitt Benckiser (Australia) Pty Ltd (ABN 17 003 274 655) of 44 Wharf Road, West Ryde, 2114 NSW Australia. (PH: 1800 022 046).

3.The Competition opens 27 February 2014 at 12:00 AEDT and closes 26 May at 17:00 AEDT ("Competition Period”). All times referred to in these terms and conditions are AEDT unless otherwise specified.
Eligibility

4.Entry is open to residents of Australia who are 18 years and over (Eligible Entrants).

5.5. Employees and their immediate families of the Promoter and its agencies associated with this Competition are ineligible to enter.

The Prizes

6.There will be 3 Major Prize winners who will each win the opportunity to be part of one of the Promoter’s next Glen 20 advertising campaign (Major Prize).

7.There will be a total of 45 Minor Prize winners (selected in accordance with the Judging Criteria) who will each win a retail gift card for Westfield Shopping Centre to the value of $200.00 each (total of 48 prizes) (Minor Prize)

 (the Major Prize and Minor Prize are collectively Prize or Prizes)


Minor Prize

8.Redemption of the Minor Prize is subject to any terms and conditions specified as part of the gift cards and to Westfield’s standard terms and conditions:

9.Defaced, mutilated, altered, lost or stolen gift cards awarded as the Minor Prize will not be replaced, refunded or redeemed. The Minor Prize is redeemable for goods or services at participating retailers within Westfield Shopping Centres only. Some merchants may choose not to accept Westfield Gift Cards. The Minor Prize is not redeemable for cash and cannot be used for payment of credit or retailer accounts.

10.The Minor Prize cannot be reloaded but may be partially redeemable for goods or services. Cash will not be given for any unused balance. Unused balance on expiry of this card will not be refunded or credited.

11.The total Minor Prize value available to each winner is $200.00. If the total cost of the items the winner purchases is greater than the balance on the individual gift cards, the Winner will need to use another form of payment to make up the difference. If the cost of the items purchased by the winner is less than the value of the gift card, the balance of the value of the Minor Prize will not be awarded as cash.

12.The Minor Prize will be valid for twelve months from the date of issue. After the Minor Prize has expired, it is no longer valid and all transactions will be declined and money on the card will be forfeited. The date of issue is stated on the back of the Minor Prize.

Major Prize

13.The Major Prize is to be a part of the Promoter’s next Glen 20 advertisement, in a manner to be determined by the Promoter in its absolute discretion but which may include for example, being featured in either a TVC, print advertisement or online advertisement. The Major Prize is entirely at the Promoter’s discretion including for example the date of shooting for any advertisement and the date the advertisement will be featured online, in print or on air. The Major Prize is to feature in one (1) advertisement only. Details will be confirmed by the Promoter and/or their relevant agencies when winner is confirmed.

14.Upon confirmation of the winner’s involvement, the winner will be bound to terms and conditions covered in a separate agreement prior to production of commercial. Eligible Entrants agree to execute any necessary separate agreement reasonably required by the Promoter in order to feature in any Glen 20 advertisement.

15.The Promoter has the right to change, substitute or cancel the Major Prize at any time.

How to Enter

16.To enter, Eligible Entrants must complete the following during the Competition Period:

a.log onto www.YourGlen20.com ("Competition Website”) or facebook.com/DettolAustralia and go to the Glen 20 One Spray, 101 Uses application

b.share a use for Glen 20 use, upload a photo and complete all required fields on the entry form

c.agree to the Terms and Conditions and to being contacted by the Promoter in conjunction with this Competition

 (collectively Entry or Entries)

17.Any Entries that contain content that the Promoter, in its sole discretion, considers to be one or more of the following content types will not be accepted as eligible Entries into the promotion:

a.content that does not strictly comply with the entry requirements as set out in these Conditions of Entry and/or on the Promotional Page and/or Application (if applicable);

b.content that contains, depicts, alludes to or promotes offensive, lewd or illegal behaviour or any swearing (including masked profanities, e.g. f*@#), alcohol or smoking;

c.content that parodies, disparages or makes fun of in any way the Promoter;

d.content that is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;

e..content that harasses or advocates harassment of another person;

f.content that exploits people in a sexual or violent manner;

g.content that contains nudity, violence, or offensive subject matter or contains a link to an adult website;

h.content that solicits Personal Information from anyone;

i.content that provides any telephone numbers, street addresses, last names, URLs or email addresses;

j.content that promotes information that an Entrant knows is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

k.content that promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

l.content that involves the transmission of "junk mail," "chain letters," unsolicited mass mailing, instant messaging or "spamming";

m.content that furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to, making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

n.content that solicits passwords or personal identifying information for commercial or unlawful purposes from other users;

o.content that involves commercial activities and/or sales without the Promoter’s prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;

p.content that contains any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or Personal Information;

q.content that has been used in previous marketing materials or promotions for any third party or where any third party has been granted use of that content for any purpose whatsoever, including commercial purposes;

r.content that includes an image or reference to another person that you have submitted without that person's consent; or

s.content that uses sexually suggestive imagery or is unfair, misleading or deceptive.

18.By entering this promotion, an Entrant warrants to the Promoter:

a.that the Entry submitted is original;

b.that they have the authority and all permissions necessary to submit their Entry;

c.that they own the content of their Entry for use in any manner in any media and in any form worldwide and in perpetuity;

d.that their Entry does not violate the privacy rights, copyright, contract rights or other rights (including, but not limited to, Intellectual Property Rights) of any person, corporation or entity;

e.in respect of content that includes images or references to third parties or third party property, that:

i.the Entrant has, before submitting their Entry, obtained the required written consents and releases from those third parties (or third party property owners) to include such images or references in the content and submit the content as part of their Entry into the Promotion; and

ii.the third parties have been informed by the Entrant and each agree in writing that such third party’s image or reference may be used by the Promoter in any media and in any form for an unlimited period of time without remuneration or compensation to the third party for the purpose of promoting, publicising or marketing the promotion (including any outcome), promoting any products and services manufactured, distributed and/or supplied by the Promoter and/or the Promoter generally;

f.that their Entry does not contain content that is illegal, contrary to any Laws, indecent, obscene, threatening, discriminatory, harassing, in breach of any confidence, defamatory, libelous, offensive or objectionable;

g.that their Entry does not contain content that has been used in previous marketing materials or promotions for any third party or where any third party has been granted use of that content for any purpose whatsoever, including commercial purposes;

h.that their Entry does not contain content that has any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or Personal Information;

i.that their Entry does not contain content that misrepresents or suggests that any entity has the approval or sponsorship of any other entity which it does not have;

j.content that promotes information that an Entrant knows is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

k.that during the course of creating their Entry (including the content), their conduct was not illegal, contrary to any Laws, indecent, obscene, threatening, discriminatory or harassing to any person; and

l.that they agree that if their Entry is accepted by the Promoter, it may be made available on the Promotional Page and/or Application (if applicable) for public viewing and may be used by the Promoter in any media and in any form for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising and/or marketing the promotion (including any outcome) and/or promoting any products and services manufactured, distributed and/or supplied by the Promoter and/or the Promoter generally.

19.To the extent permitted by law, each Entrant indemnifies, and must defend and hold harmless, the Promoter and its employees, servants, agents and contractors, from and against all Losses arising from: (i) a breach by the Entrant of any of these Conditions of Entry; (ii) any third party claim arising directly or indirectly from a breach by the Entrant of any of these Conditions of Entry; (iii) a negligent, wilful or otherwise wrongful act or omission of the Entrant; (iv) fraudulent or dishonest acts or omissions by the Entrant; (v) any breach by the Entrant of any applicable Laws; (vi) any claim by any third party (including individuals, legal entities and governmental departments or agencies) arising directly or indirectly as a result of the Entrant entering this promotion; (vii) the death of, or personal injury to, any person or any damage to, or loss or destruction of, any real or tangible personal property, to the extent caused by any act or omission of the Entrant; and (viii) any claim or allegation that the Entrant’s Entry infringes a third party’s Intellectual Property Rights or constitutes an unlawful disclosure or misuse or misappropriation of another parties trade secret or confidential information.

20.Each Entrant agrees to grant to the Promoter a royalty-free, perpetual, worldwide, irrevocable, unconditional, non-exclusive, transferable licence (and agree to use their best endeavours to procure any relevant third parties to grant to the Promoter such licence) to use their Entry for the purposes of marketing and promoting the Promoter and/or its goods and services in any manner and in any media whether existing now or in the future, without the further consent of the Entrant and without any further payment or compensation payable to the Entrant. By entering the promotion, each Entrant consents for the benefit of the Promoter to all or any acts or omissions that would ordinarily constitute an infringement of the Entrant’s moral rights in relation to all Intellectual Property Rights in any Entry that the Entrant creates or generates and uploads to the Promotional Page and/or Application pursuant to the Copyright Act 1968 (Cth). This includes the Promoter having an unfettered right to treat their Entry in any manner at its sole discretion, to alter the Entry in any manner and to the Promoter not attributing authorship of the Entry to the Entrant.
Judging Criteria

21.There are 3 Major Prize winners and 45 Minor Prize winners.

 The judging criteria for the Major Prize winners is as follows:

a.creativity of the answer; and

b.originality of the answer

c.suitability to be adapted into the final advertisement concept (concept is subject to change)

22.The judging criteria for the Minor Prize winners is as follows:

a.creativity of the answer; and

b.originality of the answer

23.There are 3 Major Prize winners and 45 Minor Prize winners.

24.The judge's decisions are final and no correspondence will be entered into.

25.This is a game of skill and chance plays no part in the determination of the Winner.
Winner Notification

26.The winners will be judged on 27 May 2014 at 44 Wharf Road, West Ryde, 2114 NSW Australia.

27.Winners will be notified by email at the email address provided in their Entry within 5 working days of the selection of winners.

28.To redeem a Major Prize or Minor Prize, the winner must reply to the notification email with their contact details (full name, postal address and phone number) within 72 hours.

29.Should a winner not reply within 72 hours, the winner will forfeit the Major Prize or Minor Prize and the judges will award the Prizes to the Eligible Entrant who submits the next best entry (according to Minor Prize Judging Criteria ). The Eligible Entrant that is deemed the new winner will be notified by email within 5 working days of the judge’s decision.

30.Prizes will be awarded to the person named on the application form. Minor Prizes will be posted within 28 days to the address provided on the application form.
General Conditions

31.The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.

32.In the event that any Prizes becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize or gift (as the case may be) of equal or greater value, unless to do so would be prohibited by law.

33.The Promoter reserves the right to request verification of age and residential address of a winner. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this Competition.

34.Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry, or Prize that is late,lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these terms and conditions; (e) any tax implications; and/or (f) the Prizes or use of the Prizes.

35.The Promoter collects personal information from entries for the purpose of conducting this Competition which may include disclosure to third parties, including, but not limited to Prize suppliers and to overseas recipients such as the Promoter’s related companies). Entry is conditional on providing this information. The Promoter may also use personal information for promotional purposes including for sending direct marketing material. Eligible Entrants may opt out of receiving direct marketing material and may elect to use a pseudonym to enter this Competition. By entering this Competition, Eligible Entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant, including sending the entrant electronic messages. Eligible Entrants may access, correct and/or update their personal information and obtain a copy of the Promoter’s privacy policy by emailing the Promoter on inquiry@rb.com or by phone on 1800 022 046 during office hours.

c)Should an entrant’s contact details change during the Competition Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

d)The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this Competition.

e)Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate redemption date.

f)It is a condition of accepting a prize that the winner respectively must comply with all the conditions of use.

g)It is a condition of accepting a prize that the Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

h)In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, unless to do so would be prohibited by law.

i)Any cost associated with accessing the Competition Website is the entrant’s responsibility and is dependent on the Internet service provider used.

j)The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

k)If this Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition, unless to do so would be prohibited by law.

l)In participating in the Competition, entrants agree that in the event that they are the winner, they may be required to participate and co-operate as required in all editorial activities relating to the Competition and the ambassador program on-going, including but not limited to being interviewed and photographed. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Winners grant the Promoters a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.

m)Each work submitted as an Entry or part of an Entry (“Work”) becomes the property of the Promoter. Work(s) will not be returned to any entrant. As a condition of entry, each entrant irrevocably grants to the Promoter a sub-licensable, non-exclusive, perpetual worldwide licence to use and exploit all intellectual property rights (including without limitation, copyright) in and to the Work and consents to the Promoter or its agents doing (or omitting to do) any acts in respect of the Work which may otherwise constitute an infringement of the entrant’s moral rights. For the avoidance of doubt, the Promoter may use all or any part of an entrant’s Work(s) for any purposes at its discretion, including, without limitation, using the entrant’s Work(s) for promotional, marketing or publicity purposes, whether in respect of this Competition, the Promoter, or otherwise. Each Eligible Entrant warrants to the Promoter that the Work submitted is an original work of the entrant which does not infringe any rights of any third party. A breach of the warranty set out in this condition will result in the entrant’s entry being invalid. In addition, each entrant indemnifies the Promoter against all loss, damages and costs incurred by the Promoter arising from that entrant’s breach of the warranty set out in this condition.

n)Incomplete or indecipherable entries will be deemed invalid.

o)The laws of New South Wales apply to this Competition to the exclusion of any other law. Eligible Entrants submit to the exclusive jurisdiction of the courts of New South Wales.
