Jonah’s Whale Beach – Facebook Competition
Terms and Conditions1. Information on how to enter and prize form part of these Terms and Conditions of Entry. Participation in this promotion is deemed acceptance of these Terms and Conditions of Entry.
2. The promoter of this Competition is Jonah’s Restaurant and Boutique Hotel (the “Promoter”) (ABN 11126260179 ), 69 Bynya Road Whale Beach NSW 2108

Entry is only open to Australian residents aged 18 years or over. By entering this promotion you are certifying that that you are over 18 years of age. Employees, and their immediate families, of the Promoter and its agencies associated with this promotion are ineligible to enter.
4. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant for tampering with the entry process or for submitting an entry not in accordance with these Terms and Conditions of Entry.
5. The competition commences 12:00am Australian Eastern Standard Time (AEST) on Wednesday 16 April 2014
and closes at 11:59pm AEST on Friday 16 May 2014 (“Competition Period”). Any entry received after the expiry of the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
6. To enter the Competition, you must

b. Entrants will receive an automatic extra entry (bonus entry) for every Facebook friend they refer via the competition app that enters the competition.
7. The Promoter reserves the right to exclude and remove any entry from the competition at any time. Any use of robotic, mechanical, automatic, programmed or like methods of participation will void each entry made by such methods.
COPYRIGHT
8. By submitting an Essay to the Promoter, you grant the Promoter and its licensees and assignees a non-exclusive license to exercise all rights in perpetuity throughout the world in the Essay(s) and all other material provided by you to the Promoter at any time. The winning Essay will be posted on the Jonah’s Restaurant and Boutique Hotel Facebook wall and website
9. You must be the author of any Essay(s) submitted. Your submission of the Essay and entry is your guarantee that you are the author and copyright holder of the Essay.
Draw Dates
10. The winners will be drawn on 20 May 2014 by Jonah’s and winners notified by 23 May 2014.
11. At the end of the promotion period, a panel from Jonah’s Management will choose one winners from the pool of all Essays entered into the Competition over the duration of the competition. Each entry will be individually judged based on originality, creative merit.
12. The winners will be notified by email and the name of the prize winners will be displayed on the Jonah’s Restaurant and Boutique Hotel Facebook wall.
13. The winner will have twelve months to redeem the prize.
14. Decisions of the Promoter and its panel of judges are final and will be binding on each person who enters the Competition and no correspondence will be entered into.
Prizes
15. The Prize winner will receive Overnight accommodation, three course dinner and breakfast the following morning.

The prize does not include any travel or incidental expenses. These will need to be paid for by the prize winner.17. Total prize value is $948
18. No component of the prizes can be transferred or redeemed for cash. In the event that the prizes becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prizes, subject to any applicable laws or written directions made under applicable legislation
19. You warrant that: (i) all details provided with your entry are true and accurate; (ii) you have all necessary rights and licenses to grant the rights set out in these Terms and Conditions; (iii) the Essay(s) is an original work; (iv) you are the copyright owner or authorised licensor of all copyright works and subject matter comprising the Essay(s); (v) the exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties; and (vi) the nature of the Essay(s) is not offensive, inappropriate, or illegal, and you will indemnify the Promoter against any loss or damage resulting from any breach of these warranties.
20. You agree that the Promoter may use your entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee paid to you.
21. In the event that a prize winner is unable to be contacted, the Promoter will retain the prize for two months from the date of the judges’ decision. If any prize is not claimed within two months of the date of the judges’ decision, the judges may determine another winner for the unclaimed prize.
22. Jonah’s Restaurant and Boutique Hotel reserves the right to change or alter the official rules, method of entry and/or prize(s) without prior notification.
23. This promotion is in no way sponsored, endorsed, administered by or associated with Facebook. By participating, you hereby release and hold Facebook from any and all liability associated with this promotion.
