Terms and Conditions
By entering Australia’s Got Talent Wildcard competition (the “Competition”), you are agreeing to
the following terms and conditions:
1) Information on how to enter forms part of the Terms and Conditions. Entry into this
Competition is deemed acceptance of these Terms and Conditions. This Competition will be
conducted in conjunction with the concurrent broadcast by the Broadcaster of the audition
episodes of the television program ‘Australia’s Got Talent’ in 2016 (“Australia’s Got Talent”).
WHO CAN ENTER?
2) The Competition is open to all residents of Australia who are aged 18 years or older who are
available to travel between 12/04/16 and 23/04/16 except employees (and their immediate
families) of the Promoter, the Sponsor, the Broadcaster, the Producer and all companies and
agencies associated with this Competition (“Entrants”).
COMPETITION PERIOD
3) The Competition commences on Monday 1st February 2016 at 8.30pm AEDT and concludes
on Tuesday 22nd February 2016 at 12.00pm AEDT (the “Competition Period”).
4) During the Competition Period, there will be six (6) periods as stipulated in Table A below
during which Entrants can enter the Competition (each, an “Entry Period”). Each Entry
Period will coincide with the period during which viewers can vote for an act in one (1) of the
six (6) Australia’s Got Talent auditions who they would like to send through to the Grand Final
as a ‘Wildcard’ entry.

HOW TO ENTER
5) To enter, Entrants must, during an Entry Period:
a) go to http://campaign.ninemsn.com.au/2016/royalcaribbean/vote.html (“Competition
Website”);
b) follow the prompts on the Competition Website to submit a vote for one (1) of up to six (6)
acts from each audition episode of Australia’s Got Talent, who they would like to see go
straight through to the Grand Final;
c) fully and correctly complete the Competition entry form with their requested details,
including their full name, postcode, state, suburb, current and valid email address and
contact telephone number;
d) agree to the Competition terms and conditions and Promoter’s Privacy Policy; and
e) successfully submit their fully completed Competition entry form.
6) Multiple entries are not permitted within one (1) voting period. Entrants can only cast one
(1) entry (and vote) on one device during the voting period.
7) If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole
discretion, to determine the identity of the Entrant.
Cool All entries are deemed to be received at the time of receipt by the Promoter and NOT at the
time of transmission by the Entrant.
9) The Promoter reserves the right to verify the validity of entries at any time during or after the
Competition Period, and reserves the right to disqualify any Entrant who tampers with the
entry process or who submits an entry that is not in accordance with these Terms and
Conditions. Failure by the Promoter to enforce any of its rights at any stage does not
constitute a waiver of those rights. The Promoter’s decision is final and the Promoter will not
enter into correspondence regarding the Competition result.
10) The Promoter and Sponsor take no responsibility should an Entrant not have internet access
permitting access to and use of the Competition Website. Any cost associated with accessing
the internet is the Entrant’s responsibility and is dependent on the internet service provider
used.
11) In the event that Australia’s Got Talent is cancelled or varied, the Competition will be
cancelled or varied (subject to relevant regulatory approval).
DRAW
12) All entries received during each Entry Period will be pooled into one (1) prize draw. The
Entrant who submitted the first (1st) valid entry drawn from all entries received during the
Competition Period will be deemed the winner. The draw will take place on Monday 29th
February 2016 at 9.00am AEDT at the Promoter’s premises. The Promoter reserves the right
to draw additional reserve entries in the draw (and record them in order), in the event that an
invalid entry is drawn or the Entrant drawn is ineligible.
13) The winner will be within two (2) business days of the draw and the name and locality of the
winner will be published on the Competition Website on Wednesday 2
nd March 2016 for a
period of twenty-eight (28) days.
PRIZE
14) The prize is one (1) x eleven (11) night New Zealand cruise for the winner and one (1) travel
companion aged 18 years or older in one (1) Oceanview cabin on Explorer of the Seas
departing from Sydney on April 12, 2016 and returns to Sydney April 23, 2016 The prize also
includes two (2) return economy flights (where applicable) from/to the winner’s nearest capital
city.
15) The total maximum prize value is $6,000.00. The value is stated in Australian dollars,
representing the recommended retail price (RRP), including GST.
16) If for any reason the winner is unable for whatever reason to accept the prize as stated, the
winner will forfeit the prize and no compensation will be given in lieu.
17) Unless specified otherwise, the winner and their travel companion (if any) are responsible for
all other expenses not expressly stated as being included in the prize, including, without
limitation, transport to and from airport departure point (including but not limited to additional
domestic airfares if required to their nearest capital city), meals and beverages, any
sightseeing, tours or activities, any additional travel or accommodation (including pre- or postcruise
accommodation), tips, transfers, personal spending money, travel insurance,
passports, visas, vaccinations and all other ancillary costs, as well as obtaining any of these.
The prize also excludes medical expenses, items of a personal nature, any on-board
costs/expenditure (including but not limited to spa, shopping, casino, shore excursions, meals
at specialty dining restaurants and anything else purchased on-board), laundry, telephone
calls, additional nights, room or flight upgrades, incidentals, energy surcharges, gratuities,
service charges, in-room charges or other ancillary costs associated with redeeming the
prize, other than those specified. These costs and expenses are the sole responsibility of the
winner and their travel companion (if any). Any extension to the duration of the prize is at the
sole expense of the winner and their travel companion (if any) and is subject to availability at
the time of booking. For the removal of doubt, taxes for domestic travel are included in the
domestic airfares provided by the Promoter as part of the prize.
18) It is the winner and their travel companion’s (if any) personal responsibility to ensure that they
have valid travel and health documentation. Any fines, penalties, payments or expenditures
incurred as a result of such documents not meeting the requirements of those authorities will
be the sole responsibility of the winner and their travel companion (if any). The Promoter and
the Sponsor make no representation as to the safety, conditions or other issues that may
exist at any destination.
19) The prize is valid for two (2) adult passengers and any additional passengers are subject to
the prevailing standard fare for the selected cruise date at the time of making the booking.
The value of the cruise fare is based on the lead-in Oceanview grade cabin and any
upgrades requested will be at the passengers’ own expense (the upgrade cost will be based
on pricing available at the time of the upgrade request minus the value of prize). The prize is
not transferrable to any other ship, cruise or date than that which is listed above.
20) It is a condition of accepting the prize that the winner and their travel companion (if any) must
comply with all the conditions of use of the prize and the prize supplier’s requirements (as
applicable). Without limitation, the winner and their travel companion (if any) will be subject to
the booking terms and conditions as outlined at www.royalcaribbean.com.au.
21) The prize is a single event trip for the winner and their travel companion (if any) and cannot
be separated into separate trips or components. The winner and their companion (if any)
must travel together. The return flights for each route must be utilized at the same time, for
the same travel dates, to and from the same destination. The air tickets are available on
regular scheduled services of airlines and are subject to seasonal embargos. Flight itinerary
may have to be adjusted depending on the airline’s departure city and their current flight
schedule. All travel is subject to availability at all times. The winner and their travel
companion (if any) are responsible for any amendment fees issued by airlines or suppliers
once booking is confirmed and ticketed. Travel suppliers/airlines and booking time of flights to
be chosen at Promoter’s discretion. Blackout periods may apply. Frequent flyer points are not
available from any airline.
22) It is a condition of accepting the prize that the winner may be requested to present their credit
card or a cash deposit upon arrival at any accommodation to cover all incidentals they may
incur during their stay.
23) It is the responsibility of the winner and their travel companion (if any) to ensure they are
checked in for their flights and arrive at the airport on the correct date and at the time
specified by the relevant airline carrier. The Promoter and the Sponsor are not responsible for
any costs associated with the winner and/or their travel companion (if any) missing any of
their flights.
24) The prize value is correct as at the commencement of the Competition Period. The Promoter
and the Sponsor accept no responsibility for change in prize value between the
commencement of the Competition Period and the ultimate date on which the prize is
awarded.
25) The prize must be taken as offered. The prize, or any unused portion of the prize, is not
transferable, exchangeable and cannot be refunded for or redeemed as cash. The prize is
not valid in conjunction with any other offer.
26) As a condition of accepting the prize, the winner and their travel companion (if any):
a) consent to the Promoter, its related entities (including, without limitation, the
Broadcaster), the Sponsor, the Producer and any other entities determined by the
Promoter in its absolute discretion, using (if any of these parties elect to use) the name,
image, likeness and/or voice of each of the winner and/or their travel companion (if any),
in any manner and in any media worldwide for an unlimited period of time without
remuneration, reference or further notification to the winner or their travel companion (if
any), for the purpose of promoting the Competition (including any outcome), Australia’s
Got Talent or the Promoter, its related entities (including, without limitation, the
Broadcaster), the Sponsor, the Producer and/or any such other entities as determined by
the Promoter; and
b) agree to participate in and cooperate with all reasonable media or editorial requests of
the Promoter, its related entities (including, without limitation, the Broadcaster), the
Sponsor, the Producer and any other entities determined by the Promoter in its absolute
discretion, including but not limited to being individually or jointly interviewed,
photographed and filmed, and acknowledge that the Promoter, its related entities
(including, without limitation, the Broadcaster), the Sponsor, the Producer and any other
entities determined by the Promoter in its absolute discretion, may use such interviews,
footage and photographs in any media worldwide for an unlimited period of time without
remuneration, reference or further notification to the winner or their travel companion (if
any). The inclusion of any such interviews, footage or photographs (including but not
limited to creative control of the feature) will remain with the Promoter, its related entities
(including, without limitation, the Broadcaster), the Sponsor, the Producer and/or any
other entities determined by the Promoter in its absolute discretion at all times.
27) In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to
substitute the prize or part of the prize in its discretion with an alternative prize or part of the
prize to the same and equal or greater recommended retail value and/or specification, subject
to any written directions from the various lottery departments.
28) The winner is advised that tax implications may arise from their prize winnings and they
should seek independent financial advice prior to acceptance of their prize.
29) It is a condition of accepting the prize that the winner and their travel companion (if any) may
be required to sign a legal release in a form determined by the Promoter in its absolute
discretion.
UNCLAIMED PRIZE DRAW
30) The Promoter may conduct a further draw at the same time and place as the original prize
draw as necessary on Monday 14th March 2016 in order to distribute the prize if it remains
unclaimed by that date, subject however to all reference to any relevant State and Territory
regulations. The winner (if any) will be notified in writing within two (2) business days of the
draw and the name and locality of the winner (if any) will be published on the Competition
Website on Wednesday 17th March 2016 for a period of twenty-eight (28) days.
GENERAL
31) The use of any automated entry software or any other mechanical or electronic means that
permits the Entrant to automatically enter repeatedly is prohibited and will render all entries
submitted by that Entrant invalid.
32) The Promoter and the Broadcaster are not responsible for any incorrect or inaccurate
information, either caused by the user or for any of the equipment or programming associated
with or utilised in this Competition, or for any technical error, or any combination thereof that
may occur in the course of the administration of this Competition, including any omission,
interruption, deletion, defect, delay in operation or transmission, communications line or
telecommunications, telephone, mobile or satellite network failure, theft or destruction or
unauthorised access to or alteration of entries.
33) If this Competition is not capable of running as planned due to any reason whatsoever,
including but not limited to, programming changes, technical failures (either in the
administration of the Competition or the broadcast of the television program), unauthorised
intervention, fraud or any causes beyond the control of the Promoter which corrupt or affect
the conduct, administration, security, fairness or integrity of the Competition, the Promoter
reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to
any written directions given by a regulatory authority, to: (a) modify, suspend, recommence,
terminate or cancel the Competition; and/or (b) disqualify any Entrant, as appropriate,
including banning an Entrant from participating in future promotions conducted by the
Promoter, for any reason including, but not limited to, behaving in any manner that is, as
determined by the Promoter in its absolute discretion, deemed to be inappropriate or contrary
to any broadcast codes, regulations or any applicable laws including mentioning or promoting
any product, service, venture or item or using inappropriate language or saying anything that
may in the producer's reasonable opinion be abusive, rude, threatening, offensive, harmful or
hurtful to any other third party.
34) The Promoter accepts no responsibility for any entries not received by the Promoter or delays
due to technical disruptions or for any other reason. An entry will only be counted as being
received when it has been received by the Promoter’s software system, not when it was sent
from the Entrant.
35) The Promoter reserves the right to request the winner to provide proof of age and identity.
Identification considered suitable for verification is at the discretion of the Promoter.
36) If the Promoter determines that the winner has breached these Terms and Conditions, their
entry will be deemed invalid and the prize will be forfeited and subject to the unclaimed prize
draw.
37) CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE
INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE
OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL
LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT,
THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST
EXTENT PERMITTED BY LAW.
LIABILITY AND RELEASE
38) Except for any liability that cannot be excluded by law, the Promoter, its related entities
(including, without limitation, the Broadcaster), the Producer and the Sponsor and each of
their respective officers, employees, contractors and agents, exclude all liability (including
negligence) for any personal injury and any loss or damage (including to persons or property
and including consequential loss and loss of opportunity), whether direct, indirect, special or
consequential, arising in any way out of the Competition, including, but not limited to, arising
out of the following: (a) any technical difficulties or equipment malfunction (whether or not
under the Promoter’s control); (b) any theft, unauthorised access or third party interference;
(c) any electronic or human error which may occur in the administration of the Competition;
(d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not
after its receipt by the Promoter) due to any reason beyond the reasonable control of the
Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e)
any tax liability incurred by the winner or an Entrant; (f) entry into and/or participation in the
Competition and/or (g) the prize and/or redemption of the prize. This condition does not
affect, and is not intended to affect, any rights a consumer might have, which cannot be
excluded under applicable consumer protection laws. To the fullest extent permitted by law,
any liability of the Promoter or its partners, servant or agents for breach of any such rights is
limited to the payment of the cost of having the prize supplied again.
39) The Promoter and the Sponsor make no representations or warranties as to the quality,
suitability or merchantability of the prize.
PERSONAL INFORMATION
40) Entrants’ personal information will be collected by the Promoter for the purpose of conducting
and promoting this Competition (including for the purpose of identifying and notifying the
winner). Without limiting the foregoing, the Promoter may disclose Entrants’ personal
information to other parties assisting in the administration of the Competition, including but
not limited to the Promoter’s related entities, prize suppliers, external service providers and
authorities that regulate this Competition. If an Entrant consents, the Promoter’s partners (as
applicable) may also use the Entrant’s personal information for the purpose of sending direct
marketing messages with respect to programs, products and services available through any
or all of them. The Promoter will handle the Entrants’ personal information in accordance with
the Promoter’s Privacy Policy. Entrants may request access to or correction of their personal
information by writing to the Promoter via its address below or by emailing
privacyofficer@mi9.com.au.
41) Sponsor opt-in: The details of all Entrants who opt-in to hear from the Sponsor will be entered
into a database and the Sponsor may use these Entrants’ names, addresses and telephone
numbers for future promotional, marketing and publicity purposes in any media worldwide
without notice and without any fee being paid unless otherwise advised by the Entrant. By
opting-in, Entrants confirm that they allow their details to be used for this purpose. If Entrants
no longer consent to their details being used for future marketing purposes, the Entrant
should contact the Sponsor on their details set out below. Any request to update, modify or
delete an Entrant’s details held by the Sponsor should be directed to the Sponsor via email to
customerservices.au@rcclapac.com.
42) Producer opt-in: The Entrants personal information collected by the Promoter and Sponsor
will also be entered into a database owned by the Producer (such as the Entrants’ names,
addresses and telephone numbers) for the purposes of, such as but not limited to,
encouraging voting and/or promoting Australia’s Got Talent and any future associated events
or products with this program. By opting-in, Entrants confirm that they allow their details to be
used for this purpose. The Producer will handle the Entrants’ personal information in
accordance with the Producer’s Privacy Policy. If Entrants no longer consent to their details
being used for this purpose, the Entrant should contact the Producer on their details set out
below. Any request to update, modify or delete an Entrant’s details held by the Producer
should be directed to the Producer via email to privacy.officer@fremantlemedia.com.au.

43) The “Promoter” is ninemsn Pty Ltd (ABN 33 077 753 461) of Level 6 Tower Building,
Australia Square, 264 George Street, Sydney NSW 2000. You can contact the Promoter in
relation to the Competition by mail to this address.
44) The “Sponsor” of the prize is RCL Cruises Ltd (ABN 54 150 263 086) of Level 12, 157
Walker Street, North Sydney, NSW, 2060.
45) The “Broadcaster” of Australia’s Got Talent is Nine Network Australia Pty Limited (ABN 88
008 685 407) of 24 Artarmon Rd, Willoughby, NSW 2068.
46) The “Producer” of Australia’s Got Talent is FremantleMedia Australia Pty Limited (ABN 42
000 693 282) of 110-112 Christie Street, St Leonards NSW 2065.
47) Subject to State/Territory permit authority restrictions, the Promoter may amend these Terms
and Conditions in its absolute discretion.
