Game of Skill Promotion

 

1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions.  Entries must comply with these conditions to be valid.

2. Entry is open to residents of Australia who are 18 years and over and available to travel between 10/03/2016 -14/03/2016. Employees (and their immediate families) of the Promoter, and its agencies associated with this competition are ineligible to enter.

3. The competition commences at 12.00 EDT on 15/02/16 and closes at 12:00 EDT on 21/02/16 (“Promotional Period”). Entries received after 12:00EDT on 21/02/16 will not be accepted.

4. To enter, participants must do the following during the Promotional Period:

a. visit www.xxxx.com.au and access the online entry form for this promotion, then complete all sections of the online entry form (including full name, postcode, state, email address, date of birth and mobile number); and

b.  answer in 25 words or less the Entry Question: "If you and your mates had a theme song, what would it be?”

c. submit the form during the Promotional Period.

5. Limit applies of one (1) entry per person per day.

6.  The competition is a game of skill. Chance plays no part in determining the winner. All entries will be judged individually on their merits based on creativity and originality. The best entry, as determined by the judges, will receive the prize.

7. Judging will take place at 11.00 EDT on 22/02/2016  at Level 7, 68 York Street, Sydney, New South Wales, 2000. Entries will be judged by a panel of judges appointed by the Promoter. The best entry, as determined by the judges, will receive the prize.

8.    Prize consists of a 2016 ‘CMC Rocks VIP Festival Experience’ for the winner and three (3) guests who are Australian residents aged 18 and over, departing on 10/03/2016 and returning on 14/03/2016.

The ‘CMC Rocks VIP Festival Experience’ includes return economy class flights and/or transfers (depending on winner's residential location) for four (4) adults from the winner's nearest Australian capital city to Willowbank, QLD (RRP up to $1500) Willowbank camping accommodation consisting of a 4-man Camping Site, fully equipped with a pre-pitched 4-man tent for 4 nights (RRP $660); 4 x 3-day VIP Tickets to the CMC Rocks Qld Festival in Willowbank, Queensland ($1,116 value) and $200 worth of drinks vouchers to be redeemed at the XXXX Gold Retreat at the Festival. Total RRP value = up to $3476. All other ancillary costs including but not limited to insurance, taxes (excluding GST), meals, drinks, transfers and any and all other expenses are the responsibility of the winner.

Prizes will be delivered to winners within 20 days of the winner being notified subject to any delivery or processing delays. Winners will be notified of any delay.

9. Winner will be notified by telephone or email by 17.00 EDT on 23/02/16 using details provided in the competition entry form. Winner must accept the prize by phone or email by no later than 8:00pm EDT on 25/02/16 in order to accept the prize.

10. If the prize remains unclaimed in accordance with clause 9, or is otherwise forfeited despite the Promoter making all reasonable efforts to notify the winner, the Promoter may deem any winner as ineligible to receive the prize. In that event, the Promoter will reconvene the judges on 26/02/2016 at the same time and place as the first judging in order to distribute the unclaimed prize. The next most creative and original entry, as determined in the discretion of the judges, will be deemed the replacement winner. The replacement winner will be notified by telephone or email by 17.00 EDT on 26/02/2016.

11.     Prize is not transferable and is not redeemable for cash.  The judges' decision is final and binding - no correspondence will be entered into.

12. To the extent permitted by law, the Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury in connection with the conduct of the promotion whether as a result of:

a.            technical or telecommunications problems, including security breaches, technical website malfunctions or glitches; or

b.            acts or omissions (including negligent acts or omissions) of the Promoter's servants or agents involved in the conduct of this promotion.

In the event of such problems or conduct, the Promoter may modify, cancel, terminate or suspend the promotion.

13. If the prize or any element of the prize becomes unavailable or is otherwise unable to be provided, the Promoter may substitute the prize or element of the prize of equal or greater value at the Promoter’s sole discretion, subject to any written directions from the relevant authorities. The winner will not be entitled to any additional compensation in the event that the prize or element of the prize has been substituted at equal or greater value.

14. The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this promotion.  Verification is at the discretion of the Promoter, whose decision is final.  The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any conduct that involves manipulating, interfering or tampering with this promotion or otherwise preventing the conduct of the promotion as intended by the Promoter. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the promotion.

15. The prize is subject to the terms and conditions of Chugg Entertainment 57 117 628 216 . The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of Chugg Entertainment or otherwise as a result of the winner accepting and/or using the prize, except for any loss, damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.

16. Before the prize is awarded, the winner and any other person(s) sharing the prize with the winner may be required to sign an agreement to release the Promoter from, and indemnify the Promoter against, any loss, damage or injury arising from the use or participation in the prize, except to the extent any loss, damage or injury is due to the negligence or wilful misconduct of the Promoter.

17. Entries will be deemed accepted at the time of transmission if all mandatory fields are completed. Any dispute relating to whether entries have been received or not will be determined by the Promoter, whose decision is final. Any entry that contains content that the Promoter, in its sole discretion, considers to be incomplete, inaccurate, underage, erroneous, ineligible, offensive, misleading, inappropriate or incomprehensible will be deemed invalid, as well as any entry that the Promoter, in its sole discretion, considers to infringe any intellectual property rights or other rights of any person, corporation or entity.

17. In participating in this competition entrants are providing information to the Promoter and not to Facebook. Each entrant acknowledges that this competition is in no way sponsored, endorsed or administered by, or associated with Facebook, and to the extent permitted by law, releases Facebook from any and all liability in relation to this competition. Any queries, comments or complaints about this competition must be directed to the Promoter and not Facebook.

18. Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party. Further, entrants agree that ownership of any intellectual property rights in their entry is hereby assigned to the Promoter without the payment of any further fee or compensation. The entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement as a precondition to being awarded their prize. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.

20. The Promoter may, in its sole discretion, determine whether any of the content will be posted or remain posted on its websites and social media channels. The Promoter reserves the right to vet or remove content from its websites at any time, without prior notice and in its sole discretion (including if properly notified that such content infringes any third party intellectual property rights). Notwithstanding any decision by the Promoter to post any of the content on its websites, the terms and warranties set out in these Terms & Conditions continue to apply.

21. Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws, codes or policies including those of the relevant liquor licensee relating to the responsible service of alcohol. The Promoter supports the responsible service of alcohol.

22. Entrants consent to the Promoter using their name, likeness, entry, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.

23 Any personal property rights in entries are owned by the Promoter. Details from entries will be collected and used for the purpose of conducting this competition (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the competition) and for promotional purposes surrounding this competition. By entering this competition entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant.
