BLUE ILLUSION’S “WIN AN AUSTRALIAN PARADISE ADVENTURE” COMPETITION
TERMS AND CONDITIONS
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
To enter the competition individuals must be:
a) An Australian or New Zealand Citizen; and
b) Aged 18 years old or over at the time of entry.
Employees (and their immediate families) of the Promoter, Blue Illusion, Kirkhope Aviation (ABN 87 007 094 546) and Arajilla Retreat (Arajilla Pty Ltd – ABN 16091 770 866) and all agencies associated with this competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The competition commences on 20th October 2016 and ends at 11.59pm AEDST on 20th November 2016 (“Competition Period”).
To enter, individuals must visit blueillusion.com; follow the prompts to the competition page, answer all questions and provide any personal details requested, then input their answer to “Tell us in 25 words or less which new kaftan is your favourite to take on your Australian Paradise Adventure and why?”, accept the terms and conditions and submit the fully completed online entry form during the Competition Period.
The best valid entry, as determined by the judges, will win a prize which includes return economy airfares for two people ex Melbourne to Lord Howe Island flying with Kirkhope Aviation (valued at approximately $10,600), transfers on Lord Howe Island and 5 nights’ total accommodation including 4 nights at Arajilla Retreat, Lord Howe Island (valued at approximately $4,400).

Accommodation upgrades
Government taxes and charges (excluding GST)
Travel & Overnight accommodation required to meet your tour and any flight connections
The prize is not transferable or redeemable for cash and must be taken during the 12 month period from Dec 2016 to Nov 2017. Accommodation at Arajilla Retreat is subject to availability and blackout periods apply during the months of December, January and Easter. The prize also includes return economy airfares for 2 from any of the following Australian capital cities (Sydney, Brisbane, Adelaide, Canberra, Hobart, Perth or Darwin). Prize winners from Victoria will need to make their way to Melbourne at their own expense. Prize winners from all other Australian states or New Zealand will be responsible for making their own way to the respective Australian state capital cities at their own expense.
Winners must advise Kirkhope Aviation of their preferred travel dates by Tuesday 20th December, 2016. The Prize must be taken by 1st December 2017.
Kirkhope Aviation and Arajilla Retreat are not responsible for any additional or incurred costs while winner is travelling.
The Prize cannot be used towards flights only, travel insurance, items of a personal nature, meals (other than featured in the itinerary), laundry, telephone calls, Internet usage, additional nights or upgrades. The Prize can only be used towards new bookings only.
Accepting the Prize is subject to any prevailing Terms and Conditions of Kirkhope Aviation tours and accommodation at Arajila Retreat. Please refer to the websites kirkhopeaviation.com.au and arajilla.com.au respectively for further details.
If applicable, names as per passport and dates of birth for all travelers are required at the time of reservation.
The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
No purchase necessary to enter.
Only one entry permitted per person.
No responsibility can be accepted for entries that are lost or delayed, or which are not received for any reason.
Incomplete or indecipherable entries will be deemed invalid.
Incorrectly completed entries will be disqualified.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit of the answer provided to the promotional question.
The Judges’, Promoter’s, Kirkhope Aviation and Arajilla Retreat’s decisions will be final, and no correspondence will be entered into.
If for any reason the winner does not take the prize by the time stipulated by the Promoter, Kirkhope Aviation or Arajilla Retreat’s, then the prize will be forfeited.
If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
Total prize pool value is AU$15,000
The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
All entries (which shall include photographs) submitted become the property of the Promoter, Kirkhope Aviation and Arajilla Retreat. Entries will not be returned to any entrant. Each entrant warrants to the Promoter Kirkhope Aviation and Arajilla Retreat that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify the Promoter, Kirkhope Aviation and Arajilla Retreat against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
Entrants consent to the Promoter, Kirkhope Aviation and Arajilla Retreat using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and/or Kirkhope Aviation and Arajilla Retreat.
If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter and/or andKirkhope Aviation and Arajilla Retreat, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter Kirkhope Aviation and Arajilla Retreat reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
Any cost associated with accessing the competition website is the entrant’s responsibility and is dependent on the Internet service provider used.
The Promoter Kirkhope Aviation and Arajilla Retreat collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers, including Kirkhope Aviation and Arajilla Retreat. Entry is conditional on providing this information and entrants can opt out at any time after the competition has ended. The Promoter Kirkhope Aviation and Arajilla Retreat may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter, Kirkhope Aviation or Arajilla Retreat
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, Kirkhope Aviation and Arajilla Retreat (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the PromoterKirkhope Aviation and Arajilla Retreat (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s Kirkhope Aviation and Arajilla Retreat control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the PromoterKirkhope Aviation or Arajilla Retreat) due to any reason beyond the reasonable control of the Promoter (Kirkhope Aviation or Arajilla Retreat(d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or Kirkhope Aviation and Arajilla Retreat in their absolute discretion, including but not limited to a legal release and indemnity form.
The laws of Australia apply to this competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
