RAGING WATERS SYDNEY VALENTINE’S PROMOTION ("PROMOTION")
Terms and Conditions
1. Information on how to enter this Promotion and Prize details form part of these Terms and
Conditions of entry (Terms). These Terms apply to the Promotion and entry into the Promotion
is deemed acceptance of these Terms.
2. The promoter is Raging Waters Sydney (ABN 94 079 214 127) of 427 Reservoir Road, Prospect
NSW 2148, Australia (Promoter).
3. The Promotion will be open from 9:00am Australian Eastern Daylight Time (AEDT) on 8
February 2021 to 11.59pm Australian Eastern Daylight Time (AEDT) on 14 February 2021
(Promotion Period).
4. Entry is open to all Australian residents aged 13 years and over at the time of entry of the
competition, excluding:
(a) management, employees, directors and contractors of the Promoter, its related entities,
and other agencies, firms or companies associated with the Promotion (including
suppliers of Prizes);
(b) a family member (whether natural or adopted), spouse, de-facto spouse, ex-spouse,
parent, step-parent, guardian, child, step-child, grandparent, step-grandparent, sibling,
step-sibling, cousin, uncle, aunt, niece or nephew of a person referred to in
paragraph 4(a) of these Terms;
(c) persons who have won a prize or prizes valued either individually or collectively at more
than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter,
within the 12 months prior to the commencement of the Promotion Period;
(d) persons who have used or attempted to use any more than one name in order to qualify
to win a promotion run by or on behalf of the Promoter (except in the case of a legal
change of name); and
(e) persons who have breached the terms and conditions of any promotion run by or on
behalf of the Promoter,
(Eligible Entrants).
The persons referred to in paragraph 1.1(b) of these Terms includes natural and non-natural
relations (in the opinion of the Promoter) and the Promoter is responsible for determining
whether a person is an Eligible Entrant in its absolute discretion. By entering this Promotion you
represent that you are eligible to enter.
5. Eligible Entrants aged under 18 years must have his or her parent or guardian's consent to enter
the competition. The Promoter reserves the right to request this consent in writing.
If the Winner is under the age or 18 years, they must have consent from their parent or legal
guardian (which the Promoter may request in writing). Minors under the age of 14 years may
use the Prize, but it is recommended they be accompanied by a person aged 16 years or older
when doing so. A parental or guardian consent must include:
(a) consent to the matters referred to in these Terms and Conditions; and
(b) the words "in consideration of the Promoter agreeing to admit the entrant into this
Promotion, [name of Parent or Guardian] agrees to be bound by the Terms of entry into
the Promotion".
6. To enter the Promotion and be eligible to win, Eligible Entrants must, during the Promotion
Period, enter the required details described below in the online form available at
www.ragingwaterssydney.com.au/Valentines-Giveaway:
i. Answer the Question: “In 25 words or less, what do you believe Cupid’s
favourite Raging Waters attraction is and why?” (Promotion Question); and
ii. including their full name, email, and, postcode,
(Eligible Entry).
7. There is a limit of one entry per Eligible Entrant during the Promotion Period. The use of any
automated entry software of any other mechanical or electronic means that allows an entrant to
automatically enter the Promotion repeatedly is prohibited and will render entries submitted
using such means invalid.
8. Eligible Entrants can only enter the Promotion in their own name. By submitting an entry, the
Eligible Entrant agrees that they have the permission of the other person(s) contributing to the
entry as part of this Promotion. If multiple people contributed to the winning entry, the Prize
will be awarded solely to be Eligible Entrant named in the submitted Eligible Entry.
9. The Promoter accepts no responsibility for any entries not received for any reason during the
Promotion Period. Entries will be deemed to be accepted at the time of receipt by the Promoter.
No responsibility will be taken for lost, late or misdirected entries or entries not received for any
reason. The Promoter is not responsible for technical difficulties with the entry mechanism and
does not warrant that the entry mechanism will be available at all times.
10. Any entries determined by the Promoter in its discretion to be obscene, incomplete, illegible,
illegal, indecipherable, inappropriate or incorrect, or entries containing offensive or defamatory
comments, or which breach any law or infringe any third party rights (including intellectual
property rights) are invalid.
11. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry
mechanism in any way, or who does not properly comply with the entry process, will be
ineligible to win. The Promoter reserves the right to disqualify entries in the event of noncompliance with these Terms.
12. Judging of all Eligible Entries received during the Promotion Period will take place on 15
February 2021 at 10:00am (AEDT) (Judging Date). Judging will take place at the Raging
Waters Sydney head office (427 Reservoir Road, Prospect NSW 2148) (Judging). All Eligible
Entries will be assessed in the Judging process.
13. Judging will be conducted by the Raging Waters Sydney Marketing Team. The judges' decision in
relation to any aspect of this Promotion is final and binding on each person who enters this
Promotion. This is a game of skill.
14. The Eligible Entrant with the response to the question “In 25 words or less, what do you believe
Cupid’s favourite Raging Waters attraction is and why?” with the most literary and creative
merit, as determined by the judges in their sole discretion, will win a Prize (Winner).
15. The total prize pool consists of two (2) General Admission Day Tickets to Raging Waters Sydney
and one (1) Beach View Cabana at Raging Waters Sydney valid for use until 28 March 2021, two
(2) Day Tickets to Sydney Zoo valid for use until 31 March 2021, one (1) night accommodation
in the Executive King room and breakfast for up to 2 adults at Alpha Hotel Eastern Creek valid
for use until 31 December 2021, and one (1) Couples Float at City Cave valid for use until 3
February 2024. The total prize is valued at $557.98 including GST (Prize).
16. The Promoter accepts no responsibility for any variation in the value of the Prize, or for any tax
liabilities that may arise from winning the Prize.
17. The Prize is not transferable, non-exchangeable and cannot be sold or exchanged as cash.
Standard ticket terms and conditions apply to the Prize, and the Prize does not include
travel/transfers to Raging Waters Sydney. All other costs associated with the Prize are the
responsibility of the Winner.
18. The Winner will be notified in writing by email on 16 February 2021 at 10.00am (AEDT). Should
an entrant’s contact details change during the promotional period, it is the entrant’s
responsibility to notify the Promoter.
19. The Promoter reserves the right to request that a Winner provides proof of his / her identity,
residency and age prior to awarding a Prize. Proof of identification, residency and age
considered suitable for verification is at the discretion of the Promoter. In the event that the
Winner cannot provide suitable proof, in the timeframe required by the Promoter, the Winner
will forfeit the Prize and no substitute will be offered. In this event, that Winner's Prize will be
awarded to the next best entry as assessed by the judges during the Judging.
20. If the Promoter is unable to contact the Winner to claim fulfilment of the Prize within 28
(twenty-eight) days of the Judging Date (i.e. by 15 March 2021), or a Winner cannot provide
suitable proof as required by clause 19, that Winner will forego their Prize in its entirety.

21. The Prize will be emailed to the Winner. Two (2) General Admission Day Tickets to Raging
Waters Sydney must be redeemed online at
www.ragingwaterssydney.com.au before 28 March
2021, one (1) Beach View Cabana at Raging Waters Sydney must be redeemed before 28 March
2021, must contact venue at least 48 hours prior to booking to reserve. Two (2) Day Tickets to
Sydney Zoo must be redeemed online at
www.sydneyzoo.com before 31 March 2021. One (1)
night accommodation in the Executive King room and breakfast at Alpha Hotel Eastern Creek
must be redeemed before 31 December 2021, must contact venue to arrange date. One (1)
Couples Float at City Cave must be redeemed before 3 February 2024, must email
marketing@citycave.com.au to arrange date. In the event that the Winner does not claim the
Prize during this period, the Winner will forfeit the Prize.
22. In the event that the Promoter is unable to supply the Prize, the Promoter reserves the right to
supply an alternative prize of similar monetary value.
23. The Promoter’s decision is final on all matters and no correspondence will be entered into.
24. Winner must, at the Promoter's request, participate in all promotional activity (such as publicity
and photography) surrounding the winning of the Prize, free of charge, and they consent to the
Promoter using their name and image in promotional material for an unlimited time and without
remuneration.
25. Eligible Entrants agree and acknowledge that all entries and any intellectual property rights
subsisting in their entries become and remain the property of the Promoter.
26. The Promoter collects personal information about entrants to include entrants in the Promotion
and where appropriate award the Prize. If the personal information requested is not provided,
the entrant cannot participate in the Promotion. By participating in the Promotion, each Eligible
Entrant consents to disclosing their personal information to the Promoter and the Promoter
using, and disclosing their personal information to the relevant authorities in the relevant
States, the Promoter's related entities, the Promoter's agencies and other third parties engaged
to provide services in connection with the Promotion (including suppliers of Prizes) for the
following purposes:
(a) conducting the Promotion;
(b) contacting the entrant in relation to the Promotion;
(c) publishing the winners' names and State / Territory of residence in accordance with
these Terms and as required under relevant legislation;
(d) improving the Promoter's or the Promoter's related entities' goods and services;
(e) in the Promoter's and its agencies case, the purposes set out in the Promoter's privacy
policy (available at
https://ragingwaterssydney.com.au/privacy-policy or by writing to
the Promoter at the address set out in paragraph 2 of these Terms).
The Eligible Entrant provides this consent until such a time as they withdraw their consent by
giving notice to the Promoter. Eligible Entrants can also gain access to, update or correct any
personal information held by contacting the Promoter at the details listed in paragraph 2 of
these Terms. Complaints procedure: All customer complaints can be emailed directly to our
Guest Services team at
guestservices@ragingwaterssydney.com.au. Guest complaints will be
handled by Guest Services Team Members and Leaders. All personal information will be stored
at the office of the Promoter.
The Promoter is not responsible for any technical malfunctions or problems with internet or
network congestion, including injury or damage to a participant’s or any other person’s
computer related to participation in this Promotion and problems with transmission of entries
and / or emails over the internet, acts in violation of these terms and conditions, acts in a
disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person.
27. Acceptance and use of the Prize is subject to any terms and conditions imposed by those
involved in providing goods and/or services as part of or in connection with the Prize (Third
Party Terms). The Winner is responsible for complying with all applicable Third Party Terms,
and bears all risk associated with failure to comply with any of them. The Promoter assumes no
liability (and will provide no compensation) as a result of any failure to comply with any Third
Party Terms.
28. All costs associated or arising in connection with participating in the Promotion and the Prize are
the responsibility of the Eligible Entrants. Any costs associated with accessing the internet are
the Eligible Entrant's responsibility, and depend on the internet service provider used.
29. The Promoter will not be liable for any loss or damage whatsoever which is suffered (including
but not limited to indirect or consequential loss) or for personal injury which is suffered or
sustained, in connection with this Promotion or as a result of accepting or using the Prize,
except for any liability which cannot be excluded by law.
30. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably
anticipated due to any reason beyond the reasonable control of the Promoter, including but not
limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the
right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant;
or (b) subject to any written directions from any applicable regulatory authority, to modify,
suspend, terminate or cancel the Promotion, as appropriate.
