Judging Criteria
All valid entries will be judged by representatives of the Promoter (at their sole discretion). The winner will be the entry which the representatives of the Promoter declare.
Announcement Schedule
The Winner each day will be announced at 6pm on a post to the Everything Caravan & Camping Facebook page. On the same date as the announcement on the Facebook page identified above, the Winner will also be sent an email to the email address that they used to subscribe to the Everything Caravan & Camping newsletter as part of entering the Competition. The Winner’s name will be displayed on the everythingcaravancamping.com.au facebook page.
Claim Procedure
The Winner from each day must respond to the email sent to them within one (1) month providing their full name, postal address, contact phone number, email address, and any further information reasonably requested by the Promoter in order to deliver the prize.
Prize Delivery Procedure
The relevant prize will be posted to each winner via our preferred shipping provider within seven (7) days of the Promoter receiving the Winner’s postal address. Privacy Policy Can be viewed by clicking the link in the footer on the website everythingcaravancamping.com.au
Terms and Conditions
In these Terms and Conditions, defined terms have the meaning given to them in the above Schedule. These Terms and Conditions apply in respect of the Competition organised by, and promoted on the Platforms by, the Promoter. By entering the Competition, you agree that you have read, understood and agree to be bound by these Terms and Conditions.
Competition Period Entries to the Competition must be submitted during the Competition Period.
How to Enter a) Entry to the Competition is open to Eligible Entrants. b) In order to enter the Competition, Eligible Entrants must, during the Competition Period, perform the Entry Method. c) No purchase is necessary to enter the Competition. d) The Competition is subject to compliance with all applicable laws and regulations. e) Each entrant may enter the Competition as many times as they like.
Prize Each daily prize for the Competition will be awarded first and in accordance with the Announcement Schedule.
Invalid Entries, Disqualification and Termination a) Entrants must only enter the competition using their own legal name and valid email address. Any entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the sole discretion of the Promoter, be deemed invalid. b) Any entries submitted outside of the Competition Period will be invalid and disregarded. c) All entries that are incomplete or fail to comply with these Terms and Conditions will be disqualified from the Competition. d) The Promoter reserves the right to disqualify an entry at any time if the Promoter reasonably believes that the entrant is not an Eligible Entrant. e) If this Competition is interfered with or tampered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties or unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: i to disqualify any entrant; or ii to modify, vary, suspend, postpone, terminate or cancel the Competition, as considered appropriate by the Promoter.
Drawing of Winner a) All valid entries will be individually judged by representatives of the Promoter during the Judging Period. b) All valid entries will be judged in accordance with the Judging Criteria. c) The Competition constitutes a game of skill, and no element of chance is involved in determining the Winner.
Winner Announcement a) The Winner will be announced in accordance with the Announcement Schedule. c) Unsuccessful entrants of the Competition will not be individually notified that they have been unsuccessful in the Competition.
Claiming the Prize a) In order to claim the prizes, the Winner must undertake the Claim Procedure. b) The prizes are not redeemable for cash and are not transferable. c) The prizes must be taken as offered and will not be varied. d) If any of the prizes are unavailable due to no fault on the part of the Promoter, the Promoter, in its discretion, reserves the right to substitute any of the prizes with another prize of equal or greater value. e) Subject to clause 7(f) of these Terms and Conditions, provided that the Winner in accordance with the Claim Procedure, the Promoter will deliver the relevant prize to the relevant Winner in accordance with the Prize Delivery Procedure. f) The Promoter reserves the right to request any evidence of the identity of any Winner prior to awarding any prize. In the event that any Winner is unable to produce any identity verification evidence requested by the Promoter as requested, the Promoter reserves the right to disqualify that person and select an alternative Winner. g) By entering the Competition, you agree that if you win the prize, you will take a photo of yourself with the relevant prize (“Winner Photo”) and provide it to Everything Caravan & Camping marketing department within one (1) week of receiving the relevant prize.
Redraws a) If the Winner fails to undertake the Claim Procedure as required, the Promoter may disqualify that person from the Competition and select a replacement Winner (as the case may be) (“Replacement”). b) Any further selection required to take place to select a Replacement will take place within seven (7) days of the relevant Winner (as the case may be) failing to undertake the Claim Procedure during the timeframe required. c) The same process set out in clause 6 and 7 will be followed to announce any Replacement and to award the relevant prize to that Replacement, save that the announcement of any Replacement will be within one business day of the Replacement being selected by the Promoter’s representatives.
Personal Information a) In order to conduct the Competition, the Promoter will collect some personal information from you. Your entry into the Competition is conditional on providing the Promoter with the personal information requested. b) The Promoter will handle any personal information collected from you in accordance with the Privacy Policy and these Terms and Conditions. To the extent of any inconsistency between the Privacy Policy and these Terms and Conditions, these Terms and Conditions will apply in respect of personal information collected as part of the Competition.
c) The Promoter may disclose your personal information to third parties, including but not limited to the Promoter’s employees, agents, contractors, platform providers, electronic direct mail providers, service providers, courier and postage operators and any suppliers of any of the prizes. d) By entering into the Competition, you consent to the Promoter using the personal information provided by you for the purpose of administering the competition as well as general ongoing promotional, marketing, publicity, research and profiling purposes, including contacting you or direct marketing the Promoter’s business and product and service offerings to you following the Competition. You may opt-out of any marketing communications using the options available in any communication sent to you by the Promoter.
Intellectual Property By entering the Competition, you irrevocably: a) consent to the Promoter using: i. your name and / or likeness; and ii. any images or video that you appear in and that you provide to the Promoter as part of, in connection with, or related to the Competition (including, but not limited to, any Winner Photo), regardless of whether it formed part of your entry, in its advertising or promotion of the Competition generally, in the Promoter’s public relations, as well as the advertising of any future similar competitions conducted by the Promoter, in any medium, without any payment to you; and b) assign to the Promoter all intellectual property rights in any copy, images or video that you provide to the Promoter as part of, in connection with, or related to the Competition (including, but not limited to, any Winner Photo), regardless of whether it formed part of your entry. c) warrant in favour of the Promoter that your entry and any Winner Photo, and the Promoter’s use of your entry and any Winner Photo in accordance with these terms and conditions will not constitute a breach of any third-party intellectual property rights and you agree to indemnify the Promoter for any liability, loss, cost or expense that the Promoter suffers or incurs as a result of, or arising out of, your breach of this warranty; and d) consent to the Promoter cropping, editing or altering any images or video that you provide to the Promoter as part of, in connection with, or related to the Competition (including, but not limited to, any Winner Photo), regardless of whether it formed part of your entry.
Liability a) Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including, but not limited to, loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition. b) Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including, but not limited to, loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: i any technical failure or related issues (whether or not under the Promoter’s control); ii any entry that is received after the Competition Period; iii any claim of any of the prizes outside of the Claim Procedure requirements; iv unavailability or inaccessibility of the website and / or the entry form during the Competition Period; v electronic or human error; vi an entrant failing to provide accurate contact information at the time of entry or when claiming a prize; vii any entry or claim of any of the prizes that is not received by the Promoter for any reason beyond the reasonable control of the Promoter; vii taking of and use of any of the prizes; viii any theft, unauthorised access or third party interference in the Competition; or ix any tax liability incurred by the Winner. c) To the extent that any liability, loss or damages cannot be excluded, but can be limited, the Promoter limits its liability for them to the minimum amount permitted by law.
d) To the maximum extent permitted by law, the Promoter makes no warranties or representations about the fitness for purpose or suitability of any of the prizes and accepts no responsibility for the quality or fitness for any purpose of any of the prizes, or the failure of any of the prizes to be of merchantable quality. If the Promoter’s liability cannot be excluded but can be limited, the liability of the Promoter is limited to re-supplying the relevant goods or services or paying the cost of replacing them.
General a) The Promoter’s decisions are final and no correspondence will be entered into with any person.
b) You are responsible for any costs associated with accessing the entry form on the website via your internet service provider. c) By entering the Competition, you expressly acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with the Platform/s. In participating in the Competition, you are providing your information to the Promoter. To the extent permitted by law, you release the Platform/s from any and all liability in relation to the Competition. d) The Competition may be promoted through third party websites and various social media platforms, including, but not limited to the Platform/s. You must comply with the terms for those third party websites and social media platforms when using them to participate in the Competition. The Promoter is not responsible for any privacy practices adopted by any third party websites or social media platforms. e) These terms and conditions are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of the State of Victoria, Australia. f) If any term, provision or condition of these terms and conditions is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the rest of these terms and conditions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.
