1. The Promoter
The Trustee for CW Media Trust, ABN 43 913 252 975, 6 Albert Street Preston, Vic 3072, on behalf of the Chemist Warehouse and e-Pharmacy group.
2. Terms of Entry
(a) Competition entries can be made from 9.00am AEST on Thursday 6 July 2023 until 11.59pm AEST on Wednesday 19 July 2023 (“Competition Period”) through the Promoter’s websites.
(b) Entries received outside the Competition Period will not be eligible or accepted.
(c) Entries that are incomplete, illegible or indecipherable will not be valid and will be deemed void.
(d) Entry is conditional upon entrants completing the following steps during the Competition Period:
(i) spend $40 or more on any L’Oreal Paris product(s) [SP1] (inclusive of the men’s range) in a single transaction at any Chemist Warehouse or E-Pharmacy (in-store or online) within Australia; and
(ii) enter online via the corresponding website (outlined above), complete the Competition entry form with their personal details as requested, provide an answer to the promotional question in 25 words or less “What is your favourite at home salon experience?”, and upload a scanned copy or photo of the receipt for the qualifying transaction[KP2] .
Proof of Purchase: The entrant must retain proof of purchase. The proof of purchase required is the original or copied receipt for the qualifying transaction.
(e) The Promoter takes no responsibility for entries that are lost, stolen, illegible, misdirected or damaged however caused.
(f) Submitting an entry constitutes acceptance of these Terms and Conditions.
(g) Limit one (1) entry permitted per qualifying transaction/receipt. Each entry submitted by an entrant must contain a different answer to the promotional question.
3. Who May Enter
(a) The Competition is open to Australian permanent residents aged 18 years of age or over. [SP3]
(b) The Competition is not open to:
(i) Employees of the Promoter;
(ii) Parties to whom the Promoter has contracted work in relation to this Competition;
(iii) Parties who are otherwise directly involved with this Competition; and
(iv) Any immediate family members or any of the abovementioned parties.
4. Prize
(a) The prize is 1 x $10K Visa Card.
(b) The total prize value is $10,000 AUD.
(c) Any ancillary costs associated with redeeming the cash card are not included. Any unused balance of the cash card will not be awarded as cash. Redemption of the cash card is subject to any Terms and Conditions of the issuer including those specified on the cash card.
5. Selecting the Winner
(a) The Competition winner will be determined by 3.00pm AEST on Friday 28 July 2023 at 6 Albert Street, Preston, VIC, 3072.
(a) Chance plays no part in determining the winner. The winner will be selected and judged by internal Chemist Warehouse staff based on a game of skill approach with judges assessing the entrants’ answers to tell us in 25 words or less ‘What is your favourite at home salon experience?’. Entries will be judged based on articulation and conciseness when explaining their response.
(b) The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
(b) The Competition winner will be notified by SMS or email by 5.00pm Friday 28 July 2023. Whilst the Promoter will use its best endeavours to contact the winner within the abovementioned time, the decision not to award an entrant who cannot be contacted a prize is at the sole and absolute discretion of the Promoter, and can be made at any time after the Competition winner has been selected.
(c) If within three months after the determination of the winner of the Competition, a prize has not been claimed by the winner, the Promoter may award the prize to the entry judged next best. The Promoter is under no obligation to award any unclaimed prize.
(d) If the winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.
(e) An individual purporting to be a prize winner may be required to provide proof of identity and to verify any other eligibility requirements.
(f) All reasonable attempts will be made to contact the winner.
6. Publication of winner’s details
The Promoter will publish the Competition winner on the following websites on Monday 31 July 2023 and that information shall remain posted there for at least 28 days.
For the purposes of public statements and advertisements, the Promoter may only publish the winner's surname, initial and State/Territory or postcode of residence.
Privacy and use of personal information
(a) In accordance with the Privacy Act (1988) (Cth), the Promoter notifies entrants that entry to the Competition involves the collection of personal information about entrants, such as their name, address, mobile phone number and email address. This is collected for the purpose of establishing eligibility, carrying out the Competition and notifying the winner. If the information is not provided, the entrant may not participate in the Competition. Entrants’ personal information may be disclosed to State Lottery agencies and winner’s name published[KP4] . The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Competition and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Competition. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Competition. [KP5]
(b) Each entrant consents to the Promoter using their personal information provided in connection with their entry, for the purposes of undertaking any investigation in connection with verifying the identity of an entry or any suspected tampering.
(c) Each entrant consents to the Promoter and its authorised licensees using the entrant’s name, likeness, image and/or photograph and voice in the event that they are the winner, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of promoting the outcome of this Competition.
7. Discontinuation of the Competition or Disqualification of an Entrant
(a) If for any reason any aspect of this Competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute discretion may cancel, terminate or modify the Competition without the need to provide compensation to entrants or attempted entrants.
(b) The Promoter reserves the right, in its sole and absolute discretion to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with (or whom the Promoter reasonably suspects has tampered with) the entry process or the winner selection process or who has otherwise been misleading or fraudulent in the course of the Competition.
(c) The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of a prize, if the Promoter determines in their absolute discretion, that a winner is not in the physical or mental condition necessary to be able to safely participate in or accept the prize. It is a condition of accepting the prize that a winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.
8. Exclusion of Liability
(a) The Promoter makes no representation nor provides any warranties as to the quality or suitability of the prizes offered.
(b) The Promoter is not responsible for any losses associated with any change to the value of any prizes.
(c) To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained by any person or to personal property including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter or its servants or agents, in connection with the arrangements for the supply of any goods or services by any person to the prize winner and where applicable, to any person or persons accompanying the prize winner.
(d) The Promoter’s decision on all matters relating to this Competition will be final.
(e) The Promoter is under no obligation to provide reasons for any of its decisions.
(f) The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants, or their representatives, in any matters relating to the Competition.
(g) To the extent permitted by law, L’Oréal Australia Pty Ltd ABN 40 004 191 673, 564 St Kilda Road, Melbourne, VIC 3004, Australia, its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Competition or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law. L’Oréal Australia Pty Ltd is only the prize supplier for this Competition and the Promoter is responsible for the administration of the Competition.
9. General Terms and Conditions
(a) No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.
(b) If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and specification.
(c) No entry fee is charged by the Promoter to enter the Competition. Where entry is allowed online, there is no additional cost to enter the Competition other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.
(d) Each prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
(e) If a prize is provided to the Promoter by a third party, the prize is subject to the Terms and Conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The Terms and Conditions which apply to the prize at the time it is issued to the winner will prevail over these Terms and Conditions, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Terms and Conditions or otherwise.
(f) All material submitted on entry (e.g. answer(s) to a promotional question) must NOT: (a) be in breach of any laws, regulations and rights, e.g. any laws regarding intellectual property (copyright, trademarks, etc), defamation and privacy; (b) be defamatory, obscene, derogatory,
[Censored]ographic, sexually inappropriate, contain nudity, aggressive, violent, abusive, harassing, threatening, objectionable or discriminate/vilify any section of the community with respect to race, ethnicity, nationality, religion, origin, sexual preference, mental illness, disability or gender or unsuitable for publication; or (c) contain viruses. Entrants warrant that they own or have the right to license the copyright in any entry submitted by them into this Competition, for the purposes of this Competition, that no rights have been granted to any third party in respect of any such entry which would prevent the entry being used as contemplated by this Competition, and that the use by the Promoter of any such entry will not breach any laws or infringe the rights of any person (including without limitation with respect to privacy, intellectual property and defamation). Entrants must obtain prior consent from any person or from the owner(s) of any property that appears in their entry. By entering, all entrants license and grant the Promoter, its affiliates and sub-licensees an exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (including any portion of their entry) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants further agree, upon request by the Promoter, to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter and to sign any legal documentation to confirm such assignment. Entrants agree that their entry is their original work and does not infringe the rights of third parties, or that they have obtained full prior consent from any person who has jointly created or has any rights in the aforementioned material. Entrants consent to any use of their entry that may otherwise infringe their moral rights. Entrants are responsible for all entries they submit on entry. The Promoter will not be liable for any entries, to the extent permitted by law. The Promoter reserves the right to remove, request removal or decline to publish any entry or portion of an entry for any reason whatsoever, including if in breach of these Terms and Conditions. The Promoter will have no liability to entrants if it exercises this right and entrants must comply with any request made by the Promoter pursuant to this paragraph. The entrant warrants and represents that any material sent or provided by the entrant to the Promoter will not infringe any copyright, trademarks or other intellectual property rights of any third party (including moral rights) and that the entrant has all rights to use the materials and has obtained all necessary consents to comply with any relevant privacy and/or confidentiality requirements. Entrants agree to indemnify the Promoter for any breach of the Terms and Conditions including this clause.
(g) The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Competition, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.
(h) The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
