1.1 The AFL x NBA Ultimate Fan Experience is a game of chance hosted by The Sporting News Australia, in which eligible competitors will visit a landing page and fully complete an online entry form in the manner required by providing Name, Email Address and Phone Number.

1.2 By entering this Competition and in consideration for the opportunity to win the prize associated with the Competition, each entrant agrees to be bound by and observe these terms and conditions. Information on how to enter and prize details form part of these terms and conditions.

1.3 The promoter of the Competition is SPORTING NEWS (AUSTRALIA) PTY LTD (ACN 645 885 098) with registered office at Suite 1, 128 Jolimont Road, East Melbourne, Victoria, 3002 (the "Promoter").

Who may enter

2.1 Subject to entry into the Competition is open solely to all permanent residents of  Australia, excluding NT residents aged 18 years or over at the date of entry (“Eligible Entrants”).

2.2 The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter are not eligible to enter the Competition. Employees of the Australian Football League (the “AFL”) and affiliated clubs, including affiliates, agents and immediate families and/or those living the same household of each of the aforementioned, are not eligible to win the Competition. Employees of NBA Properties, Inc., the National Basketball Association (the “NBA”), the NBA member teams, NBA Asia Pty Limited and NBA Media Ventures, LLC (collectively, the “NBA Entities”) including affiliates, agents and immediate family members and/or those living in the same household of each of the aforementioned, are not eligible to enter or win the Competition.

2.3 No purchase or other payment is necessary to enter the Competition.

Competition Period

3.1 The Competition commences at 09:00 Australian Eastern Standard Time (AEST) on 13th September, 2023 and closes at 21:00 AEST on 25th September, 2023. (the "Competition Period").

3.2 To enter, eligible entrants must visit the official online entry form for this Promotion at https://www.sportingnews.com/au/nba/news/nba-afl-ultimate-fan-experience-grand-final/baad39ff4f86605e1c52b4f2, accept these terms and conditions, provide their name, email address and phone number and submit an entry.

How to win the prize

 

4.1 To be eligible to win the prize, Eligible Entrants must have successfully filled out the entry form via the official landing page: https://www.sportingnews.com/au/nba/news/nba-afl-ultimate-fan-experience-grand-final/baad39ff4f86605e1c52b4f2.

4.2 The entrants name will then be drawn at random to win the prize. Participants can enter multiple times. No purchase is necessary to enter the competition.

4.3 The prize draw will be conducted on Tuesday, 26 September 2023 at 10:00 AM AEST, at Bay 5, 2 Locomotive Street, South Eveleigh, New South Wales, 2015.

4.4 The prize draw will be performed in the presence of an independent scrutineer.

Notification of prize winner

5.1 The Prize Winners will be notified by email and phone on Tuesday, 26 September 2023 and the names of the winners will be announced on Sporting News AU/NBA Australia by Wednesday, 27 September 2023.

5.2 The Prize Winners must accept their prize by phone confirmation by Wednesday, 27 September 2023.

Prize details

6.1 Two (2) major prizes and thirty eight (38) minor prizes will be awarded in total. There is a limit of one (1) prize per Eligible Entrant.  The prize(s) are as follows:

(a) Each of the two (2) Major Prize Winners of the AFL x NBA Ultimate Fan Experience promotion will receive the following:

(i) One (1) double pass to the 2023 Toyota AFL Grand Final (Category 4 tickets) to be held at the Melbourne Cricket Ground (MCG), Brunton Avenue, Richmond, Victoria, 3002 on Saturday, 30 September 2023, valued at AUD $8,820 (tickets only).

(ii) Pre-game meet & greet with AFL and NBA Legend for them and their guest (guest must be over the age of 18) on Saturday, 30 September 2023 at AFL House, 140 Harbour Esplanade, Docklands, Victoria, 3008. 

(iii) The prize includes flights from each Major Prize Winner’s closest major airport (excluding Major Prize Winners who reside in Victoria) and accommodation at an Accor hotel for one (1) night, valued at up to $3,400. Prize Winners are responsible for their own airport transfers and any incidentals related to the Prize.

(iv) This also includes access to the post 2023 Toyota AFL Grand Final function, ‘The Final Siren’, including food and beverages, for each Major Prize Winner and their Guest.

(b) This prize is for the 2023 Toyota AFL Grand Final, held at the Melbourne Cricket Ground (VIC) on Saturday, 30 September 2023.

6.2 The thirty-eight (38) minor prize winners will receive one (1) of the following prizes:

(a) One (1) of ten (10) x In-Person Meet and Greet Session with a NBA Legend, valued at AUD$2000. The Meet & Greet Sessions will be held in Melbourne on Friday, 29 September 2023 at the NBA Store located at Emporium Melbourne, Shop L-39, 287 Lonsdale Street, Melbourne, Victoria, 3000;

(b) One (1) of six (6) x Signed Merchandise from NBA Players Dyson Daniels and Xavier Cooks, valued at AUD $1200.00;

(c) One (1) of two (2) x Special Edition jersey of a retired Australian NBA Player, valued at AUD$400; or

(d) One (1) of twenty (20) x NBA League Pass Subscriptions, valued at AUD$3000.

6.3 Total prize pool value is up to AUD $18,820.00.

Further Competition conditions

7.1 This competition is run under NSW Authority NTP/07733, ACT Permit No. TP/23/01849.1, SA Permit No. T23/1437 and AFL Authorised Grand Final Promotion GFAFL23/146

7.2 None of the Promoter, the NBA or the NBA Entities (together, the "Released Parties") accept any responsibility for any variation in the value of the prize.  In the event that any element of a prize is not available, the Promoter reserves the right to substitute a prize of equal or greater value, subject to written directions from relevant regulatory bodies.

7.3 Prizes cannot be transferred, assigned, redeemed for cash, substituted, or altered, except by Promoter at its sole discretion, due to prize unavailability, and then prize may be substituted for one of comparable or similar value.  Particular prizes may be subject to change.  Participants and Winners are solely responsible for all applicable taxes and all other expenses not specified herein. 

7.4 Each Prize Winner acknowledges that their prize may be subject to additional terms and conditions imposed by third party suppliers which will be provided to each Prize Winner. By accepting their prize, the Prize Winner will be deemed to have accepted any such additional terms and conditions in full.

7.5 The Released Parties do not accept responsibility and are not liable for any additional conditions imposed by a third party as referred to in paragraph 8.3.

7.6 If for any reason a Prize Winner does not accept:
(a) an element of the prize;
(b) any part of these terms and conditions relevant to that element; or
(c) any additional terms and conditions stipulated by any third party prize suppliers relevant to that element,

that element of the prize will be forfeited. Cash will not be awarded in lieu of any element of any prize under any circumstances (unless otherwise specified by the Promoter).

7.7 All eligible entrants agree to provide the Promoter or the Promoter’s authorised agent with identification and proof of eligibility if selected as a Prize Winner. The required form of identification and proof of eligibility are at the discretion of the Promoter (acting reasonably).

Unclaimed prizes

8.1 As the major prize is for an event on Saturday, 30 September 2023, and the meet and greet prize event taking place on Saturday, 30 September  2023, and Sunday, 1 October 2023, in the event of either of these prizes not being accepted or claimed by 09:00 AM AEST on Thursday, 28 September 2023, the winner of these individual prizes will be deemed invalid and the Promoter reserves the right to draw another eligible entrant at random to receive the unclaimed prizes. 

8.2 The redraw for the major prize and the meet and greet, if required, will be conducted on Thursday, 28 September at 11:00 AM AEST, at Bay 5, 2 Locomotive Street, South Eveleigh, New South Wales, 2015.

8.3 Prize winners for these prizes will be notified by email and phone on Thursday, 28 September 2023 and the name of the winners will be announced on Sporting News AU/NBA Australia by Friday, 29 September 2023.

8.4 The Major Prize Winner & Winners of the meet and greet must accept their prize by phone confirmation by 10:00 AM AEST on the Friday, 29 September 2023.

8.5 Prizes cannot be converted to cash.

8.6 Additional Unclaimed Prizes: In the event any of the additional prizes are unclaimed by 09:00 AM AEDT on Tuesday, 10 October 2023, an unclaimed prize draw will occur at on Tuesday, 10 October 2023 at 11:00 AM AEDT , at Bay 5, 2 Locomotive Street, South Eveleigh, New South Wales, 2015. Winners will be notified via email and phone on the same day as the draw and published on Sporting News AU/NBA Australia on the same day as the draw. Prizes cannot be converted to cash.

Limitation of liability

9.1    To the fullest extent permitted by law, the Released Parties exclude all liability and will be held harmless from any losses, damages, actions, liability, injury or claims (including, without limitation (but subject to operation of law), personal injury, death to winner or any third party or damage to personal or real property, due in whole or in part, directly or indirectly, by any reason) incurred by any person in connection with the Competition or the promotion, receipt, acceptance, possession, use or misuse of any prize and/or participation in this Competition. The Released Parties also expressly exclude any liability for any loss or damage which may be incurred by you as a result of your breach of these terms and conditions.

9.2    Except as otherwise required by applicable law, the Released Parties accept no responsibility or liability for any entry or claim which for technical or other reasons is unsuccessful, ineligible, late or incomplete. Incomplete, indecipherable or illegible entries will be deemed invalid.

9.3    Nothing in these terms and conditions excludes or limits Promoter’s liability for: (i) death or personal injury arising from the Promoter's negligence; (ii) fraud or fraudulent misrepresentation; (iii) or any other liability which may not be excluded or limited by applicable law, and nothing in these terms and conditions limits, excludes or modifies any statutory right or guarantee provided by Australian law or state law.

Privacy

10.1 By entering the Competition, the entrant understands and agrees that the Promoter and its agents may use and disclose the entrant’s personal information to assist in administering and managing the Competition and prizes (where applicable) and communicating with the entrant in regard to special offers from the Promoter and its related entities. Entrants in the Competition acknowledge that the Promoter may share an entrant’s personal information with the Promoter’s Australian and foreign related entities and the NBA Entities which may contact the entrant with marketing messages and special offers. Without limiting the foregoing, the Promoter may disclose the Prize Winner’s personal information to third parties for the purpose of fulfilling the prize, service providers, contractors and agents. Entry is conditional on providing this personal information. The Promoter will also use and handle personal information collected as set out in its Privacy Policy, which can be viewed at https://sportingnewsholdings.com/privacy-policy.

10.2 The Promoter may, for an indefinite period, unless otherwise advised, use the personal information collected from entrants for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
