www.events.zambrero.com.au/guactober2023 (“Websiteâ€), follow the prompts to the online promotion entry form, input the requested details (including full name, date of birth, valid email address, mobile phone number), complete the “Game of Skill†(finish this sentence in 25 words or less “Guac, Guac who’s thereâ€), upload either a receipt or photographic image showing the purchase of an Eligible Product (ie. photograph of food) and submit the fully completed entry form.
All valid entries received during the promotional period (01/10/2023 - 31/10/2023) will be automatically placed in the prize draw.
Any entry which is incomplete or does not follow all instructions in these Terms and Conditions will be deemed invalid and ineligible to win.
Proof of purchase: Entrants must retain the original receipt or photographic image of the Eligible Product purchased during the campaign period during the promotional period (01/10/2023 - 31/10/2023). If an Entrant fails to produce the Proof of Purchase for a specific entry when requested by the Promotor, the Promoter has the right to invalidate the Entrant’s entry or entries for which the Proof of Purchase cannot be provided. Prize Draw:
• All valid entries received before the competition end date will be entered into the prize draw. The prize draw will take place at Zambrero Head Office, Suite 1 Level 11, 1 Macquarie Place, Sydney, NSW 2000, Australia at 12:00 pm AEST on 8 November 2023 and the winner and runner up will be chosen by two representatives of the Promotor based on creativity merit of the Game of Skill responses and valid proof of purchase.
• The Promoter may draw additional reserve entries and record them for use if an invalid entry or ineligible entrant is drawn.
Total Prize Up to AUD $16,556.00 (inclusive of GST). Pool:
1. The Entrant agrees and acknowledges that they have read the Terms & Conditions and that entry into the Promotion is deemed to be acceptance of these Terms & Conditions. All entries and all responses to the Game of Skill become the property of the Promotor and may be used for marketing purposes (ie. on social media)
2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of order, transmission or deposit by the Entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
3. Only valid and eligible entries will be accepted during the Promotional Period.
4. Employees (and their immediate family members) of Zambrero/agencies/companies directly
associated with the conduct of this Promotion, the Promoter, businesses involved in the determination of the winner/s for the Promotion, businesses involved in the management of the
Winner Notification:
Prize winners will be notified via phone and email within 14 days of the draw. The winner of Guactober will be published at
www.events.zambrero.com.au/guactober2023 by Friday, 17 November 2023. Reasonable efforts will be made to contact the winner and runner up. The winner and runner up must respond to the prize notification to claim their prize within seven (7) days of the date and time of the notification (Prize Collection Period).
Promotion, any organisation benefiting from the Promotion, the Promoter’s distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step- sister or first cousin.
5. Quality control errors will not invalidate an otherwise valid prize claim unless the entry is invalidated due to fraud or ineligibility under these Terms & Conditions.
6. The first valid entry selected will win the Mexico Prize Voucher. The prize is subject to these Terms & Conditions and the Mexico Prize Voucher Terms & Conditions below.
7. The second valid entry selected will win the Darwin Prize Voucher. The prize is subject to these Terms & Conditions and the Darwin Prize Voucher Terms & Conditions below. If the winner of the Darwin Prize Voucher resides outside of Perth, the Promotor will arrange two economy return airfares from the winner’s nearest capital city airport to Perth. If required, the winner can request to fly with Airnorth from Cairns or Townsville (instead of from Perth), subject to availability.
8. Each Entrant may only claim one prize. If any winner elects not to claim their prize (or is unable to) or does not take or claim a prize within the Prize Collection Period or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.
9. The value of the prizes is accurate and based upon the recommended retail value of the prizes (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date.
10. No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.
11. If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority.
12. No entry fee is charged by the Promoter for an entrant to enter the Promotion other than the purchase of the Eligible Product.
13. Each prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
14. Each Entrant acknowledges and consents to their personal information including name, age and address being collected by the Promoter and consents to the personal information being stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at
www.zambrero.com.au/legal-information#privacy-policy. The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about Entrants to enable them to participate in this
Promotion and may disclose the Entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the Entrant does not provide their personal information as requested, they will be ineligible to enter or claim a prize in the Promotion. Personal information collected from Entrants will not be disclosed to any entity located outside of Australia.
15. For the purposes of public statements and advertisements, the Promoter will only publish the winner's first name in isolation, surname with initial and State/Territory or postcode of residence.
16. It is a condition of accepting the prize that a winner may be required to sign a legal document as determined by the Promoter in its absolute discretion, prior to receiving a prize.
17. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The Mexico Prize Voucher Terms & Conditions and the Darwin Prize Voucher Terms & Conditions which apply to the prize at the time it is issued to the winner will prevail over these general Terms & Conditions, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Terms & Conditions or otherwise.
18. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms & Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
19. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of war, terrorism, state of emergency, pandemic or any other kind of disaster, computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to the relevant regulations of the State.
20. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries or incomplete responses to the Game of Skill, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
21. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms & Conditions. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with
the entrant. If the dispute cannot be resolved the Promoter’s decision will be final and no
correspondence will be entered into.
22. The Promoter and its associated agencies and companies will not be liable for any loss
(including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or willful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
23. The winners must participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material on social media, press and/or any other format the Promotor sees fit in its absolute discretion without further reference or compensation to them. Any resulting images belong to the Promotor.
24. Unless otherwise specified, a prize is a single event for the winner (and where relevant, their guests) and cannot be separated into separate events or components.
25. Unless included, the following are not included as part of the Mexico Prize Voucher or the Darwin Prize Voucher: all other out of pocket expenses including meals, beverages; laundry services, spending money, transfers, additional accommodation due to flight schedules, optional excursions, tipping, passports, visas, travel insurance and all other ancillary costs not expressly provided. The costs of obtaining any of these requirements are the responsibility of the prize winner and any travel companion. All taxes payable, airline and government are the responsibility of the prize winner.
26. Travel is not permitted during school holidays or public holidays, and blackout periods apply. A surcharge may apply for flights, payable by the Entrant.
27. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
28. The Promotor will not be liable should either of the prizes not meet the expectations of the winners in any way.
29. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
30. Mexico Prize Voucher Terms & Conditions
30.1 The Mexico Prize Voucher comprises multiple Flight Centre Gift Cards to the total value of $10,000 and are valid for travel booked until 1 October 2026.
30.2 The Flight Centre Gift Cards are redeemable for a trip to Mexico or any other travel products provided by Flight Centre Corporate Benefits to a total value of $10,000. The winner agrees that any costs incurred by the winner in excess of $10,000 (including GST) is the sole responsibility of the winner. Partial redemption of a Flight Centre Gift Card is permitted provided all Flight Centre Gift Cards are redeemed by 1 October 2026.
30.3 The Flight Centre Gift Cards are non-reloadable, non-refundable, non-exchangeable, non- transferable, non-replaceable and non-redeemable for cash, credit or foreign exchange products. The Flight Centre Gift Cards can be used for new bookings only and not for a refund of an existing paid booking.
30.4 The Flight Centre Gift Cards are redeemable by calling Flight Centre Corporate Benefits on 1300 174 589 or by emailing
cy4i@flightcentre.com. The PIN code for each Flight Centre Gift Card must be provided at the time that the Flight Centre Gift Card is redeemed.
30.5 Any unused balance remaining on a Flight Centre Gift Card after 1 October 2026 will be lost and forfeited, and no refund or credit will be provided by Flight Centre or the Promotor.

31.1 The Darwin Prize Voucher is valid for travel up to 30 November 2024 and cannot be extended unless agreed to by Airnorth and the Promotor.
31.2 All travel must be completed by 30 November 2024.
31.3 The Darwin Prize Voucher is subject to Airnorth’s schedule changes and cancellation policies; in the event of cancellations the Voucher cannot be redeemed for cash.
31.4 The Darwin Prize Voucher ID must be quoted when making the booking.
31.5 The Darwin Prize Voucher is non-transferable, non-exchangeable and non-redeemable for cash. 31.6 The Darwin Prize Voucher can be used for new bookings only and not for a refund of an existing 31.7 paid booking.
31.8 The Darwin Prize Voucher cannot be split into separate bookings. Winners must travel on the same flights and dates.
31.9 The Darwin Prize Voucher is not valid during any Northern Territory and Queensland Public and School Holidays.
31.10 Flights must be booked at least ten working days prior to travel and are subject to availability. 31.11 Flights are subject to availability in prize booking class, advised by Airnorth at the time of booking.
31.12 A “no show†will constitute a voluntary forfeit of the airfare.
31.13 Only one change, excluding name change is permitted without penalty.
31.14 Changes inside of 48 hours of travel are not permitted.
31.15 The Darwin Prize Voucher can be used for a child booking (2-11yrs inclusive), the child must travel with an adult parent/guardian.
31.16 Unaccompanied children are not eligible to be booked on the Darwin Prize Voucher.
31.17 No discount or compensation on the value of the airfare will be provided for the child booked on the Darwin Prize Voucher or if the value of the airfare booked is the lesser of the eligible routes included.
31.18 In the event a booked flight is cancelled by Airnorth or a connecting flight arranged by the
