Terms and Conditions - KAS + Miss Amara Giveaway
1. Eligibility: The Miss Amara & KAS Australia competition is open only to legal residents of Australia and New Zealand who are at least 16 years of age at the time of entry. Employees of KAS Australia Pty Ltd and Miss Amara Pty Ltd (the "Sponsors"), their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Competition. The Competition is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
2. Agreement to Rules: By participating, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Sponsors, as final and binding as it relates to the content. The Competition is subject to all applicable federal, state, and local laws.
3. Competition Period: Entries will be accepted online starting on Monday 20th May 2024 at 7:00am AEDT and ending on Sunday 2nd June 2024 at 11:59pm AEDT. All online entries must be received by Sunday 2nd June 2024 at 11:59pm AEDT. All times are (AEST) Sydney & Melbourne
4. How to Enter: The Competition must be entered by submitting an entry using the online form provided on this site or via the Facebook/Instagram entry form. The entry must fulfill all competition requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsors. You may enter only once, and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of the Sponsors.
5. Prizes: The approximate retail value of all prizes combined is $2,000 RRP. The prizes include 1x Miss Amara voucher valued at $1,000 total & 1x KAS Australia voucher valued at $1,000 total. Winners are not guaranteed to win a prize, and their chance of winning is dependent on the total number of eligible entries received. The specifics of the prize shall be solely determined by the Sponsors. No cash or other prize substitution permitted except at Sponsors' discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and local taxes, shall be the sole responsibility of the winner.
6. Odds: The odds of winning are determined by the total number of eligible entries received throughout the Competition Period. As participants are limited to one entry each, the more entries submitted overall, the lower the individual chance of winning, and vice versa. While the exact likelihood of winning for any participant cannot be determined due to the random lottery selection process, it is influenced by the total number of eligible entries received.
7. Winner Selection and Notification: The winner of the Competition will be selected in a random drawing under the supervision of the Sponsors. and will be announced on Monday 3rd June at 9am AEDT. The winner will be notified via email to the email address they entered the Competition with within five (5) days following the winner selection. The Sponsors shall have no liability for a winner's failure to receive notices due to the winners' spam, junk email, or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 14 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited, and an alternate random winner will be selected.
8. Privacy and Data Sharing:
By entering the Competition, participants consent to the collection, storage, and processing of their personal data by both KAS Australia Pty Ltd and Miss Amara Pty Ltd for the purposes of administering the Competition, selecting winners, delivering prizes, and for marketing purposes. Participants acknowledge that their personal data, including name, phone number, and email address, may be shared between KAS Australia Pty Ltd and Miss Amara Pty Ltd for these purposes.
Both companies are committed to protecting the privacy and security of participants' personal data in accordance with applicable privacy laws and regulations. Participants have the right to access, rectify, or delete their personal data held by either company upon request.
While participation in the Competition is voluntary, withholding consent to the collection, storage, processing, and sharing of personal data may affect eligibility to participate or receive prizes. Limitation of Liability: By entering, you agree to release and hold harmless the Sponsors and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Competition and/or your acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software, (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service, (iv) unauthorised human intervention in any part of the entry process or the Competition, (v) electronic or human error which may occur in the administration of the Competition or the processing of entries.
10. Disputes: This Competition is governed by the laws of Australia and NSW, without respect to conflict of law doctrines. As a condition of participating in this Competition, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Competition, shall be resolved individually, without resort to any form of class action, exclusively before a court located in NSW having jurisdiction.
