The Promoter is Newfurn Floor Coverings Ltd (ABN 63 004 650 668), 5-9 Hobbs Court, Rowville, Victoria 3178, Australia ( Promoter ).
Entry into the competition is free and is open to Australian and New Zealand residents aged 18 years and over. Employees, management and directors (and their immediate families) of the Promoter, together with retailers, suppliers, agencies and/or companies associated with this competition are ineligible to enter. “Immediate family” refers to spouse, de facto spouse, parent (including a spouse or de facto spouse of a parent), natural or adopted child, sibling (whether natural or adopted by parent or a spouse or de facto spouse of a parent), grandparent, grandchild, aunt, uncle, niece, nephew or first cousin. An entrant must be an individual and not a company (Eligible Entrant) .
Information on how to enter and prizes form part of these terms and conditions. Entry into the competition constitutes acceptance of these Terms and Conditions and the formation of a contract with the Promoter. The competition commences at 0.01 am AEST on 19 May 2024 and ends at 11.59 pm AEST on 15 June 2024 ( Promotional Period ).
To enter, entrants must: upload a photograph or video of between 15 and 30 seconds to the theme “What happens on your floor when you are not around” using the provided entry form on the Promotor’s website at
https://choicesflooring.com;accurately fill out all required fields in the entry form.
Multiple entries are permitted, provided that each video or photograph may only be submitted once and each entry complies with the entry requirements.
Entries may only be submitted in accordance with these Terms and Conditions.
Entries must be received by the Promoter during the Promotion Period. Any entry received by the Promoter outside of the Promotion Period will not be accepted. The Promoter does not accept any responsibility for late or misdirected entries.
By submitting an entry, the entrant:
grants to the Promoter a perpetual, irrevocable, royalty-free license, with the right to sub-license, to publish, reproduce, communicate to the public, and cause to be seen in public the photo or film submitted as their entry, and consents to such use occurring without attribution of authorship;
warrants that the photo or video is the entrant’s original work and that the entrant owns copyright in that photo or video, and has not been licensed or made available to be licensed to any other person, including by posting on social media or submission with a stock photography or video agency;
agrees to indemnify and hold harmless and indemnify the Promoter, its officers, employees, contractors and licensees against any loss, damage or cost arising from a third party claim that the photo or video infringes their copyright, moral rights, or that it defames or breaches the right to privacy of any person depicted therein, or otherwise arising from or in relation to their entry.
The Promoter reserves the right at any time, to verify the validity of entries and entrants (including an entrant’s identity, birth date and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. The Promoter’s failure to enforce any of its rights at any stage does not constitute a waiver of those rights.
This is a skill-based competition. One (1) winner will be chosen within 7 days of the end of the Promotional Period (the Winner ).

This is a game of skill. Chance plays no part in determining the Winner. Each entry will be individually judged, based upon individual creative merit, originality, entertainment value and suitability or as otherwise specified. All entries must:
be an independent creation by the Eligible Entrant and free of any claims that they infringe any third-party right;
not be generated by or with the assistance of artificial intelligence or other computer-generated imagery. Editing of photographs or videos is permitted to make basic adjustments to white balance, exposure, contrast, sharpening and vibrancy, but may not add or remove objects to or from the photograph or video.
not have been published previously and/or have been used to win prizes in any other competitions;
not have been, or in the future be, commercially licensed including through any stock photography or video agencies.
The Promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the judges, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The Promoter’s decision will be final, and no correspondence will be entered into.
If this competition is not capable of being conducted as reasonably anticipated due to any reason beyond the Promoter’s reasonable control, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
The Winner will be notified via the email nominated on the entry page within 24 hours of having been chosen. The Winner’s name will also be announced on the on the Promotor’s website at
https://choicesflooring.com.
The prize consists of a gift card to the value of AU$2,500 which may be redeemed in any Choices Flooring store in Australia and New Zealand (Prize) within 3 years of winning the prize.
If the Prize is or becomes unavailable for whatever reason, the Promoter will, in its discretion, substitute an alternative prize for the original prize. The substituted prize will be similar to and of the same or greater value than the Prize. The Promoter is not liable for any loss incurred by the prize winner if the Prize is unavailable. The Prize is not transferable or exchangeable and cannot be taken as cash.
Every attempt will be made to contact the Winner to claim their Prize, however, the Winner will have 28 days from the Promoter’s first notification to respond and to provide all releases or consents required by the Promotor, or will be deemed to have forfeited their Prize. Should this occur, the Promoter reserves the right to award the Prize to the next best entry received from another Eligible Entrant, as determined by the judges. In these circumstances, the new Winner will be notified in accordance with these Terms and Conditions.
Entrants consent to the Promoter using the entry and the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
By uploading the picture or video, the entrant takes complete responsibility to obtain permissions from all parties and their parent/guardian in the photo/video and owners or occupiers of any premises visible in the image/s submitted. Choices Flooring – The Promoter will not be liable for any usage issues or permissions that arise from any entry submitted and/or winning entry.
The Promoter will take all reasonable steps to deliver the Prize to the Winner, at the Promoter’s reasonable expense, within 30 days from the date the Winner is selected. The Prize will be sent to the delivery address provided to the Promoter by the Winner, and may be delivered as a virtual gift card to be downloaded or printed by the Winner. Any other ancillary costs or accessories not expressly provided are the responsibility of the Winner.
To the maximum extent permitted at law, the Promoter, their associated agencies and companies associated with this competition take no responsibility for any delay in delivery, damage to or loss in transit of the Prize.
The Promoter makes no express representations or warranties as to the quality, fitness for purpose or merchantability of any Prize any part of any Prize. To the maximum extent permitted at law, including subject to the Australian Consumer Law (contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and the Consumer Guarantees Act 1993 (NZ), the Promoter excludes liability of any kind arising from or relating to the Prize.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all responsibility and liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunctions (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); (d) any tax liability incurred by a winner or entrant; or (e) use by the entrant or any third party of a prize.
The Promoter collects personal information from all entrants (whether Eligible Entrants or not) in order to conduct the competition and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the entrants’ entries and personal information for ongoing promotional, marketing, research, profiling and publicity purposes, without further reference or compensation. The Winner expressly agrees to the use of their name and address for competition purposes, without compensation.
Any entrant, who fails to provide all requested personal information, may be determined by the Promoter, at its sole discretion to be ineligible to win the Prize. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria, Australia. All entrants submit to the non-exclusive jurisdiction of the courts of Victoria, the Federal Court of Australia, and of courts entitled to hear appeals from those courts.
