TERMS AND CONDITIONS
In these Terms and Conditions, the following words have these meanings, unless the context otherwise requires:
“Budget Direct Travel Insurance Policy” means Budget Direct Travel Insurance Cover issued by Travel Insurance Partners.
“Commencement Date” means 24 April 2024.
“Draw Date” means 23 September 2024.
“End Date” means 28 August 2024.
“Unclaimed Draw Date” means 8 January 2025.
The promoter is Auto & General Services Pty Ltd (ABN 61 003 617 909), AFSL 241 411 (operating under the brand Budget Direct) of Level 13, Toowong Tower, 9 Sherwood Road, Toowong QLD 4066 (Promoter). The Promoter’s contact number is 1300 858 747.
These Terms and Conditions apply to the Budget Direct Travel ‘$5,000 Cash’ Draw (Promotion). Subject to these Terms and Conditions, the Promoter is offering participants a chance to win a prize being one (1) x AU$5,000 cash prize (Prize) when they either (i) complete and submit an entry form or (ii) purchase a new Budget Direct Travel Insurance Policy and complete and submit an entry form, as set out under the heading “Eligibility and Participation”.
Information on how to enter, mechanics of entry and the prize form part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
The Promotion commences at 12:01am AEST on the Commencement Date and ends at 11:59pm AEST on the End Date (Promotion Period).
Any offer of Budget Direct Insurance is subject to the insurer deeming that the risk is acceptable in accordance with its underwriting criteria. Budget Direct Travel Insurance is arranged and promoted by Auto & General Services Pty Ltd (ABN 61 003 617 909, AFSL 241411), managed and administered by Travel Insurance Partners Limited (ABN 73 144 049 230, AFSL 360138), and issued by Zurich Australian Insurance Limited (ABN 13 000 296 640, AFSL 232507). Eligibility and Participation
In order to be eligible to participate in the Promotion, participants must meet all of the following criteria (Eligible Participant):
During the Promotion Period:
If participants purchase a new Budget Direct Travel Insurance Policy through the website to ensure the Budget Direct Travel Insurance Policy purchased pursuant to this Promotion remains active and valid for a period not less than 21 days from the purchase date; and
complete the entry form, including by inputting the new Budget Direct Travel Insurance Policy Number, answer the questions provided, and submit the entry form available online and
be a traveller noted in the new purchased Budget Direct Travel Insurance Policy; OR
if participants do not purchase a new Budget Direct Travel Insurance Policy;
complete the entry form, answer the questions provided, and submit the entry form available at the Promoter’s website,
be an Australian resident aged 16 or over at time of entry (participants under the age of 18 are only eligible to enter the Promotion subject to parental/guardian consent);
provide the participant’s full name and valid email address;
not be an officer or employee of the Promoter, its related bodies corporate, or their immediate family; and
not be an officer or employee of any agents or service providers of the Promoter directly associated with the conduct of the Promotion, or their immediate family.
For avoidance of doubt, persons who purchase a Budget Direct Travel Insurance Policy via another website or platform other than the website detailed in Clause 7A(a), for example via third party aggregation platforms such as Compare the Market or iSelect, and validly complete and submit the entry form via the Promoter’s Website, will only be eligible for one entry pursuant to Clause 9A.
Each Eligible Participant will be awarded a maximum of:
one (1) entry into the Promotion for completing and submitting an entry form during the Promotion Period as per Clause 7(A)(b) of these Terms and Conditions. Additional entries will not be awarded for multiple form completions in the Promotion Period. The maximum number of entries that will be awarded for form completions is one (1); and
five (5) entries into the Promotion per Budget Direct Travel Insurance Policy purchased and for completing and submitting an entry form during the Promotion Period as per Clause 7(A)(a) of these Terms and Conditions. Additional entries will be awarded for multiple Budget Direct Travel Insurance Policy purchases with the relevant corresponding entry form submitted,
with each entry having an equal chance of winning the Prize.
The Prize draw will take place at 9 Sherwood Road, Toowong QLD 4066 (Draw Location) at 10.30am (AEST) on the Draw Date.
The total maximum prize pool for the Promotion is AU$5,000. A total of one (1) Eligible Participant, who has provided evidence of their eligibility and the validity of their entry, upon request, to the reasonable satisfaction of the Promoter (Eligible Winner) will be drawn at random via electronic draw on the Draw Date or Unclaimed Draw Date, as is relevant. An additional five (5) reserve entries will be drawn in the same manner, location, date and time as outlined in clause 10 and this clause, and will be recorded in the order drawn, for use in the event that the Eligible Winner does not pass their cooling-off period, declines to receive the Prize or is ineligible to accept the Prize. In such an event, the Prize will be awarded to the next reserve entry drawn.
The Eligible Winner will be notified in writing via their nominated email address within two (2) business days of the Draw Date. The Eligible Winner’s name will be published on the terms and conditions page of the Promoter’s Website within 28 days of the Draw Date and will remain on the Promoter’s Website for no less than 28 days. All reasonable steps will be taken by the Promotor to notify the Eligible Winner.
The Prize will be deemed unclaimed if the Promoter is not reasonably able to contact the Eligible Winner within three (3) months and one (1) day of the relevant Draw Date via the Eligible Winner’s contact details provided at the time of entry into the Promotion.
If the Prize remains unclaimed, an unclaimed prize draw (Unclaimed Prize Draw) will be held at the Draw Location, at the same time and via the same method advised in clauses 10 and 11 on the Unclaimed Draw Date, subject to any written directions made under applicable State or Territory Legislation.
The Unclaimed Prize Draw Eligible Winner will be notified in writing via their nominated email address within two (2) business days of the Unclaimed Draw Date. The Unclaimed Prize Draw Eligible Winner’s name will be published on the terms and conditions page of the Promoter’s Website following the draw and will remain on the Promoter’s Website for no less than twenty-eight (28) days.
The cash Prize will be awarded via electronic funds transfer. The Eligible Winner, or Unclaimed Prize Draw Eligible Winner, must provide the Promoter with their correct and valid Australian bank account details, including bank account name, BSB and account number, to receive the Prize.
The Promoter will arrange for the Prize to be delivered to the Eligible Winner’s (or Unclaimed Prize Draw Eligible Winner’s) nominated bank account within 10 business days of receiving the winner’s bank details. The Promoter has no further responsibility in terms of delivering the Prize once the Prize has been delivered to the nominated bank account using the details as provided by the Eligible Winner (or Unclaimed Prize Draw Eligible Winner).
Unless expressly stated within these Terms and Conditions, all other expenses become the responsibility of the winner.
Privacy Statement and Marketing Consent
The Promoter is committed to protecting Personal Information and agrees to be bound by the Privacy Act 1988 (Cth). The Promoter’s privacy policy is available on the website
www.budgetdirect.com.au. It contains information about how participants can complain about a breach of the Australian Privacy Principles and further details of how the Promoter will collect, store, use and disclose Personal Information can be found there. In these Terms and Conditions, Personal Information has the meaning given to it in the Privacy Act 1988 (Cth). Entrants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter’s Privacy Officer at
privacyquery@autogeneral.com.au.
Personal Information is collected by the Promoter in order to conduct this Promotion and for the purpose of facilitating the delivery of the Prize. If the Personal Information requested is not provided, then a person will be ineligible to participate in this Promotion. By entering into the Promotion, the participants consent to the Promoter disclosing the Personal Information to any regulatory authorities or to the Promoter’s related entities, using the Personal Information to process and validate the participant’s claim for the Prize, and to arrange delivery to the participant (if eligible).
By entering the Promotion, participants acknowledge that a further primary purpose for collection of the participant’s Personal Information is to contact the entrant in the future with information about the Promoter, including special offers, market research or to provide marketing materials via any medium including mail or any other form of non-real time electronic, emerging, digital or conventional communications channel whether existing now or in the future.
The Promoter will never sell an Entrant’s Personal Information to other companies, however, the Promoter may share an Entrant’s Personal Information with its Australian and overseas related companies, promotional partners, servants, employees, agents and trusted third parties, who may contact the Entrant for their legitimate commercial purposes. Some of these parties may be located outside of Australia, including but not limited to Japan, Philippines, Singapore, South Africa, United Kingdom, Canada, Israel, and the United States of America and participants understand and acknowledge that Australian Privacy Principal 8.1 will not apply to such disclosures of their personal information. By entering the Promotion, Entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.
General
This Promotion is not available in conjunction with any other promotion or offer, and the Promoter reserves the right to disqualify any person from receiving the Prize if any of the following occurs:
If it suspects fraudulent activity; or
for a breach of these Terms and Conditions; or
if it decides the person has not acted in good faith; or
for any false or misleading conduct of any kind.
Incomplete, indecipherable or illegible entries will be deemed invalid. Any incorrect details submitted by a participant may render the corresponding entry invalid.
The Prize is not refundable, reloadable, transferable or exchangeable and cannot be taken as physical cash. All taxes which may be payable as a consequence of receiving the Prize, are the sole responsibility of the winner.
To the extent permitted by law, the Promoter reserves the right in its sole discretion or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw, or cancel the Promotion, including varying the Terms and Conditions at any time without notice.
The Promoter reserves the right to request that an Eligible Participant provides supporting documentary evidence of their identity (e.g. driver’s licence, passport, birth certificate). If the Eligible Participant fails to do so, or the Promoter determines the policy does not meet the eligibility criteria of the offer, the Eligible Participant will not be eligible for the Prize.
The Promoter (including their officers, employees and agents) will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) including any theft, unauthorised access, third party interference, any technical difficulties or equipment malfunction, or personal injury (including loss of opportunity) suffered or sustained in connection with the Promotion, or the receipt, acceptance, or use of the Prize (whether negligent or not), except for any liability that cannot be excluded by law. The Promoter reserves the right to substitute the Prize with another incentive of the same value, unless to do so would be prohibited by law.
In the event of a dispute concerning the conduct of the Promotion or claiming a prize, participants agree that the decision of the Promoter will be final.
