1, This competition (“Competition”) is conducted by the promoter, The Royal Automobile Club of Tasmania Limited (ABN 62 009 475 861) of 179 Murray Street, Hobart, TAS 7000 (“RACT”).
2. Entry to the Competition constitutes acceptance of these Terms and Conditions.
3. The Competition Period opens on Monday, 2 September 2024 at 12:01am, and closes on Monday, 31 October 2024 at 11:59pm (“Competition Period”) with a total of one (1) individual winner. All times and dates are in Hobart, TAS, Australia.
4. An Eligible Entrant may enter the Competition one (1) time only within the Competition Period.
5. This competition is only open to “Eligible Entrants”. An Eligible Entrant is an individual who:
· purchases an RACT together with pet insurance online, during the Competition Period and remains an active policy holder with all premiums paid at the time the prize draw takes place
is an RACT Member or non-member residing in the state of Tasmania;· at the time of entry, is not an employee of RACT or any of its related companies in which it has an equity interest or that trade under the RACT brand; and
· at the time of entry, is not a spouse, de-facto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
6. The prize consists of one (1) $500 AUD physical Visa gift card.
7. The gift card is valid for 3 years from the date of activation.

10. This is a game of chance; skill plays no part in determining the winner. The winner will be chosen at random from eligible pet insurance policies purchased online through
www.ract.com.au within the Competition Period.
11. The prize winner will be notified by telephone and email (where email is held by RACT) within 5 business days of the draw.
12. The Promoter accepts no responsibility for lost, misdirected or delayed mail or email.
13. Should the prize winner decide to accept the prize they must, at RACT’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and consent to RACT using their name and image in promotional material (which may include publication within Journeys magazine and/or on the RACT website and social media pages).
14. In the event of the prize being refused, not accepted or claimed within 30 days of notification, the draw will be declared null, and void and a further draw will take place at RACT House, 179-191 Murray St Hobart on Friday 6th December 2024 at 12:00pm.
15. Unless otherwise agreed by both parties, the prize must be collected from RACT House Hobart on any business day with two business days notice, or from another RACT branch on any business day with at least seven business days notice.
16. The prize cannot be exchanged or taken as cash.
17. RACT’s decision is final and binding, and no correspondence will be entered into.
GENERAL
18. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of RACT (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), RACT reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
19. RACT assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) RACT or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise).
20. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. RACT RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
21. To the full extent permitted by law, RACT, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Competition and Consumer Act 2010.
22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, RACT (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or in relation to the Competition.
23. If any provision of these conditions is unenforceable for any reason, it will be severed, and the remaining provisions will remain in full force and effect.
24. The entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winners and, if an entrant consents, may be used to market its products to the entrant. The personal information of the winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact RACT by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by RACT.
