1. To be eligible to enter, individuals must spend $40 or more (excluding tobacco, gift cards & commission sales such as phone re-charge, dry cleaning & continuity sales) and purchase a specially marked product (‘Participating Product’) in one transaction at any participating Drakes Supermarket Store in South Australia or Queensland during the promotional period, 30th April – 27th May 2025, to have a chance to be a contestant on Tipping Point Australia.
a. Full list of Drakes Supermarkets Stores (69) can be found online.
b. Full list of participating products listed in Schedule A
2. Participants can enter by:
a. Online entry form and follow the links to enter your details as prompted. Entrants must keep an original copy of their receipt as proof of purchase.
b. myDrakes App: Automatic entry into the promotion is triggered upon scanning your myDrakes App in an eligible transaction at the register during the promotion.
TERMS AND CONDITIONS
1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions including the Terms and Conditions set out for applicants of Tipping Point Australia. Tipping Point Australia T&C’s
2. This competition is only available to Australian citizens or be a permanent resident of Australia for at least 2 years (and be able to demonstrate this by providing documentation upon request) and be over the age of 18 years at the time of entering the competition.
3. Employees (and their immediate families) or associates of the Promoters (Drakes Supermarkets, Nine Entertainment Co and Endemol Shine Australia), participating Drakes Supermarkets, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: parent, sibling, child or spouse, anyone living at usual place of residence.
a) Associates of any television broadcaster, news or media organisation including web-based media or other online platforms or outlets, either in Australia or elsewhere; now and during the last 2 years are also illegible to enter this promotion.
4. The Promoters reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoters’ discretion. Failure by the Promoters’ to enforce any of their rights at any stage does not constitute a waiver of those rights.
5. Incomplete, indecipherable, or illegible entries will be deemed invalid.
6. Multiple entries permitted, subject to the following: (a) only one entry permitted per purchase receipt; and (b) each entry must be submitted separately and in accordance with entry requirements.
7. If there is a dispute as to the identity of an entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the entrant.
8. Promotion commences on 30/04/2025. Final entries close at close of business or 9:00pm (local time) (whichever is first to occur) on 27/05/2025.
9. The prize draw will take place at Drakes Supermarkets Head Office (Level 1, 159 Henley Beach Road, Torrensville, South Australia 5031) on 02/06/2025 at 1pm.
10. The winners details (last name, first initial and postcode) will be notified by email, telephone and posted online within 48 hours of the prize draw being completed.
11. The Promoters’ decision is final, and no correspondence will be entered into.
12. The first valid Ten (10) entries drawn will be provided to EndemolShine Australia “The Producer” for final contestant cast.
a) Shortlisted entrants will need to provide general details (name, age, DOB, contact details) as well as a photo and accompanying 30-60 sec video explaining ‘if you won $20k on Tipping Point what would you spend it on?’
b) Shortlisted entrants will then be contacted for a 1-2 minute interview where they will be required to explain to producers about themselves, their story.
13. Shortlisted entrants acknowledge and consent that the Producer will conduct or arrange bankruptcy checks, background checks including criminal, financial or personal, and/or undertaking an online or in-person interview, the Producer may request further information, failure to provide said information will void entry into the competition.
a) Pending criminal charges, court orders or other tribunal or commensurate proceedings, criminal charges, having pleaded or found guilty or convicted of any criminal offence, or being the subject of any order or agreement as to domestic protection (other than “spent convictions” that are no longer disclosed under applicable local law).
b) Shortlisted entrants acknowledge that any of the above conditions will their chances of being selected by Endemol Shine Australia for participation on Tipping Point Australia.
14. One of the Ten (10) valid entries will then be chosen by the Producer who will then appear on an episode of Tipping Point Australia within the 2025 or 2026 season.
15. The Producer has final decision on entrant chosen for program participation. The Producer may disqualify an entrant at any time from participation in any stage of the process without providing any reason.
16. The prize or any unused portion of the prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
17. A draw for the prize, if unclaimed may take place on 16/06/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winners details (last name, first initial and postcode) will be notified by mail/email and telephone and posted online within 48 hours of the prize draw being completed.
18. Subject to Clause 14, if for any reason a winner does not redeem the prize by the time stipulated by the Promoters, then the prize or that element of the prize will be forfeited.
19. If the prize is unavailable, the Promoters, in their discretion, reserve the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
20. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.
a) The entrants grant Producers, its licensees, successors and assignees, a royalty-free licence to communicate, adapt and exploit any photographic or video material (including all copyright subsisting in the same) that you may upload and/or submitted if requested at a later time, at their sole discretion, including connection with the Program; and
b) Consent to editing, amending or adapting of any such material regardless of whether such act is an infringement of any moral rights, anywhere, at any time, in any media, even if are not selected to participate in the Program and without requiring any further consent from or receiving any payment.
c) Consent to being photographed, filmed and/or recorded as part of the application process for the Program and to using your name, likeness, voice, appearance and performance (in whole or in part) in the Program (including broadcast of the Program), in publicity and promotion for the Program, and at any time and in any media throughout the world without requiring any further consent or receiving any payment.
21. Entrants acknowledge and agree that you will be required to sign a separate Participant Agreement with the Producer and that such Agreement will provide that in consideration of participation in the Program, the Producer will own all rights in the Program including any contribution and performances which will be freely available for broadcast and all other media purposes without restriction (inclusive of promotion and publicity of the Program and all other ancillary purposes associated with the Program) and without receipt of any payment.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate, or cancel the promotion, as appropriate.
23. Except for any liability that cannot be excluded by law, the Promoters (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; or (e) participation in/use of the prize.
24. In the event of war, terrorism, pandemic, state of emergency or disaster, the Promoters reserve the right to cancel, terminate, modify, or suspend the promotion, subject to any written directions from a relevant regulatory authority.
25. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoters in their absolute discretion, including but not limited to a legal release and indemnity form.
26. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). The Promoters collect personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, as otherwise required by law, including to any Australian regulatory authority. Entry is conditional on providing this information and if entrants do not provide the information requested they may not be able to enter the Promotion. The Promoter will not transfer the entrant’s personal information overseas, except upon the entrant’s request, or if the Promoter is permitted or authorized to do so by law.
a) The Producer is also bound by the Privacy Act 1988 (Cth) in respect of the personal information you provide, which shall be used in accordance with this Collection Statement and their Privacy Policy at
http://www.endemolshine.com.au/privacy-policy. You understand the Producer collects personal information for the primary purpose of selecting participants for the production of the Program and may share your personal information (including “sensitive information” as defined by the Act) with its related bodies, corporate or broadcast partners, including the broadcaster of the Program, any of its related companies, associates or affiliates, for this purpose and authorise its service provider, Casting Networks LLC (trading as Cast It Reach), to process and store your personal information securely on servers accessible by the Producer and located in the USA and/or India. You also understand that your personal information may be stored by the Producers’ third party data storage provider on secure servers location in the European Union, which are accessible by the Producer and its parent company, Banijay Group Holding S.A.S., who is located in France and subject to the data production safeguards contained in the General Data Protection Regulation (EU) 2016/679. You consent to these uses, disclosures and storage arrangements and agree that the Producer may retain your personal information as part of its record of individuals who have applied to be participants in the Program and may use this information as part of its record of individuals who have applied to be participants in the Program and may use this information to contact you in the future in relation to the Program and/or about other offers, events and programs. You acknowledge that you may update or request access to the personal information you have provided to the Producer by emailing
info@endemolshine.com.au and including your name, mobile number and email address in that request.
27. Confidentiality:
a) Entering the Competition you understand that all information regarding the Program or any part of the process to consider you as a participant in the Program is not available to the public and remains strictly confidential unless and until the relevant information is broadcast as part of the Program or
28. Release:
otherwise official released to the public by the Producer, its broadcast licensees or persons authorised
by them. This is all “Confidential Information”
b) You undertake that at all times to keep the Confidential Information secret and confidential, and not
disclose, except to the extent required by law, any of the Confidential Information to any other person or allow or make it possible for any other person to see any Confidential Information that may be in Your possession or control.
a) To the maximum extent permitted by law, unconditionally release and hold the Producer, its licensees and their respective employees, officers, contractors and agents (“Released Parties”) harmless from and against any actions, claims and any other remedies whatsoever including injunctive relief in connection with any loss, bodily damage or injury, property damage, reputation damage in connection with the participation in this Competition or in the Program.
29. The Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. If an entrant wishes not to receive information from the Promoter, they can ‘opt-out’ by clicking on the ‘unsubscribe’ link at the bottom of the email, or phoning the Promoters on (08) 8415 6100 or by emailing
Privacy@drakes.com.au. All entries become the property of the Promoter.
30. The Promoter is Drake Supermarkets Pty Ltd (ABN 57 109 544 416) Upper Level 159 Henley Beach Road, Torrensville, SA 5031.
31. The Producer is Endemol Shine Australia Pty Ltd (ABN 20 136 451 208) which includes its related bodies corporate and all their employees, contractors and agents.
