1. GENERAL TERMS
1.1 By submitting an entry to the Competition, you acknowledge that you have read and agree to be bound by these Terms & Conditions and that the decisions of SharkNinja Pty. Ltd. ABN 87 147 260 197 trading as SharkNinja (the Promoter, we, us or our) as Promoter in connection with the Competition are final and you warrant that you satisfy all eligibility requirements set out in these Terms & Conditions. The Promoter's privacy policy available on its website (see further clauses 9 and 10 below) forms part of these Terms & Conditions.
1.2 The Competition is open to residents of Australia only who are 18 years or older at the time of entry. Employees of the Promoter, its respective parent, subsidiaries, affiliates, advertising and promotion agencies, distributors, and merchants involved with this competition, along with their immediate family members and/or those living in the same household, are not eligible to enter or win. The competition is governed by Australian law and subject to all applicable federal, state, and local laws and regulations, and is void where prohibited by applicable law. No purchase is necessary to enter or win. A purchase will not improve your chances of winning.
1.3 The Competition is not available in conjunction with any other promotion or offer by the Promoter or any related body corporate.

2.3 To be valid, all entries must comply with, and be received in accordance with, these Terms & Conditions between 9:00 AM AEST on 23 July, 2025, and 11:59 PM AEST on 13 August, 2024 (“Competition Entry Period”). Online entrants are subject to all notices posted online, including but not limited to the sponsor's privacy policy.
2.4 The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these Terms & Conditions or which contravene any applicable laws or regulations. Entries which are to be published on a website will be subject to a moderation process before being visible on the website.
2.5 If the Competition involves uploading a photograph or other content onto a website or social media or providing content as entry, by entering the Competition, each entrant agrees to their entry being made available for public viewing and warrant that they:
Are the sole author and owner of the intellectual property rights to the submitted content which is original, true and accurate, and does not infringe the intellectual property rights of any third party. This includes any information that references other websites, addresses, persons, email addresses, contact information or phone number;
Have obtained the necessary permissions for any third-party materials included in the content, including if the entry involves a photograph, that they have obtained the prior consent of any person depicted in the photograph; and
Understand that your personal information provided and the submitted content may be used by the Promoter for promotional purposes for both the Shark® and Ninja® brands to conduct campaigns, research and marketing activities (including informing you about special offers from the Promoter), and otherwise will be used in accordance with our privacy policy (see below)
3. PRIZES & APPROXIMATE RETAIL VALUES (“ARV”)
3.1 The first valid entry drawn will win the following prize bundle, valued at up to $2,709.92 AUD:

3.2 Total prize value: $2,709.92 AUD inclusive of GST. If the winner is unable to receive the prize, it will be forfeited, and an alternate winner may be selected.
4. ODDS
4.1 Odds of winning depend on the total number of eligible entries received during the competition entry period. All prize draws are final and no correspondence will be entered into.
4.2 There will be only one winner.
5. WINNER SELECTION & NOTIFICATION
5.1 The winner will be selected in a random drawing from all eligible entries on 15 August, 2025, at 10:00 AM AEST at SharkNinja Pty. Ltd. headquarters in Sydney.
5.2 The winner will be notified by email that they have won a prize and instructions on how to claim their prize. It is the responsibility of each winner to comply with the Promoter's instructions. Subject to any liability which cannot be excluded by law, a winner's use of the prize is entirely at their own risk. Before the prize is delivered, subject to applicable law, the Promoter may ask the winner to sign an acknowledgement formally confirming receipt of the prize.
5.3 If the winner cannot be contacted or does not respond, or if the prize remains unclaimed by 30 August, 2025, a redraw will take place at 10:00 AM AEST at the same location.
5.4 Winner details will be announced via the email database and the Promoter's social media platforms for the Shark® and Ninja® brands in Australia.
5.5 The prize must be taken as stated and no compensation will be paid if a winner is unable to use the prize.
6. ADDITIONAL TERMS
6.1 Prizes are non-transferable and non-exchangeable, except at the sponsor's discretion. The prize is not redeemable for cash.
6.2 The winner is responsible for any taxes or other expenses not expressly covered in these terms.
6.3 Entry and acceptance of the prize constitutes permission to use the winner's name, likeness, and city of residence in all publicity activities relating to the competition as the Promoter may reasonably request and without further compensation, except where prohibited by law.
6.4 To the maximum extent permitted by law, by participating in the competition, once the prize has been provided by the Promoter to the winner, the Promoter takes no responsibility for the prize being damaged, lost or stolen, subject to any applicable legislation, regulations or directions from a regulatory authority.
6.5 Except to the extent required by any law, including the Australian Consumer Law, the Promoter and its associated companies make no warranties or representations about the fitness for purpose or suitability of any prize and will not accept responsibility for the quality or fitness for any purpose of any prize or the failure of any prize to be of acceptable quality.
6.6 If participation in the Competition is via Facebook and/or Instagram or other social media or if the Competition is promoted on Facebook and/or Instagram:
Participants agree to act in accordance with the applicable platform Terms and Conditions:

Participants acknowledge that the Competition is in no way sponsored, endorsed, administered by or associated with Meta, Facebook and/or Instagram and each participant agrees to grant Meta, Facebook and/or Instagram (as applicable) a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Participants acknowledge and agree that:
any information they provide in connection with the Competition is provided to the Promoter and not to Meta, Facebook and/or Instagram or any other social media network; and
any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Meta, Facebook and/or Instagram or any other social media network; and
the Promoter is not responsible or liable for any loss, damage or injury suffered by any participant as a result of the conduct of Meta, Facebook, Instagram or any other social network, including any decision by the applicable social network to remove or not remove any content, except for liability which cannot be excluded by law.
7. GOVERNING LAW
7.1 This Competition is governed by the laws of New South Wales, Australia, without regard to its conflict of laws provisions.

9.1 By entering this Competition, participants consent to the Promoter handling each participant's personal information for the purposes set out in clauses 2.5 and 10, and (unless you tell us not to do so) to receive marketing communications from the Promoter. Without limiting the foregoing, personal information (including name, contact details, and where applicable, any images provided in connection with the Competition) will be collected, used and handled according to the privacy policies of both brands and applicable laws. If you do not provide your personal information, the Promoter will not be able to process a participant's entry into this Competition.
