THE AUTO SALON COROLLA PROMOTION - TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet only.

2. Entry is free and open to residents of Australia aged 18 years or older (“Eligible Entrant”) who log onto www.autosalon.com.au/corolla (“Promotional Website”). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion.

3. The promotion commences at 9:00 am (AEST) on 10th June 2010 and closes 3:00 pm (AEDT) on 21st November 2010 (“Promotional Period”). The Major Prize winner will be notified by telephone and in writing (mail and email) and their name will be published in The Australian on 3rd December 2010. All reasonable steps to notify the Major Prize winner will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

4. To participate in the promotion Eligible Entrants must, during the Promotional Period, log on to the Promotional Website and correctly complete and submit the online registration form as required, which may include providing the Eligible Entrant’s full name, date of birth, gender, residential address, phone number and current and valid email address (“Registration”). Successful completion of the online Registration during the Promotional Period automatically enters the Entrant into the Major Prize Draw. Maximum of one entry per day per person.

Eligible Entrants may also participate in the promotion at one of the promotion’s computer terminals at Auto Salon’s 2010 events that fall within the Promotional Period. These computer terminals provide access to the Promotional Website to complete and submit the online registration form as required.  The dates and venues for these events are: Auto Salon Perth (24-25 July 2010) Perth Convention Exhibition Centre; Auto Salon Adelaide (7-8 August 2010) Adelaide Event & Exhibition Centre; Auto Salon Melbourne (28-29 August 2010) Melbourne Showgrounds; Auto Salon Gold Coast (18-19 September 2010) Gold Coast Convention & Exhibition Centre; Auto Salon Final Battle Sydney (20-21 November 2010) Sydney Showgrounds, Olympic Park.

5. There are no limitations on the number of Registrations permitted per household, however only one (1) Registration permitted per Eligible Entrant per day. For the purposes of this promotion a ‘household’ is deemed to be the residential address stated in an Eligible Entrant’s online registration entry form.

6. Any subsequent entry into the Major Prize Draw on the same day after the first one (1) received (as the case may be) will be deemed invalid. Entries must be received by the Promoter during the Promotional Period. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission.

7. Major Prize Draw: Each Eligible Entrant who submits a valid entry into this promotion in accordance with these Conditions of Entry will automatically be entered into the Major Prize Draw. The Major Prize Draw will take place at 10.00AM (AEDT) on 22nd November 2010 at Telads Australia, Level 20 644 Chapel Street. South Yarra. Victoria. 3144

8. The first eligible entry randomly drawn from all eligible entries received will win the Major Car Prize of one (1) 2010 Model Modified Toyota Corolla Levin ZR 5-door hatchback with 6-speed manual transmission valued at $28,900 (recommended retail price in Australian dollars including GST) fitted with $20,000 (recommended retail price in Australian dollars including GST) in modifications and aftermarket accessories Total Prize Value $48,900.00

9. (a) The Major Car Prize is ineligible for any form of warranty whether from the Promoter or vehicle factory warranty and Toyota’s Service Advantage program, and is provided in ‘as is’ condition with no liabilities for compliance with the Winner’s local and State road and transport regulations and laws. The Car Prize Winner accepts full responsibility of any correspondence, notifications, testing or certification that may be required for, but not limited to, registration and insurance eligibility. The Car Prize Winner accepts full responsibility for any alterations and modifications required to the 2010 Model Modified Toyota Corolla to comply with all Australian Design Rules and the Winner’s local and State road and transport regulations.

9. (b) The major prize winner will be required to sign an acknowledgement of risk and waiver of liability in respect of the Major Prize, and will be required to acknowledge that Toyota Motor Corporation Australia Limited is not responsible for, and does not provide any warranty in respect of the prize vehicle or modifications.

10. The Major Car Prize is provided with on road costs, vehicle registration, however no Comprehensive Third Party insurance. Any future costs, ancillary costs (including but not limited to travel to and from the nearest capital city where the Car Prize is delivered to), which are the responsibility of the Car Prize Winner. The odometer of the motor vehicle may record up to 500km at time of delivery or transfer. The Car Prize Winner must claim the Car Prize within three (3) months from the date the winner is notified that they have won.

11. To be eligible to claim the Major Car Prize, the winner must be capable of obtaining motor vehicle registration of the motor vehicle prize in his or her name in accordance with the applicable legislation in the Australian State or Territory in which the motor vehicle is collected. It is a condition of accepting the Major Prize that the winner may be required to sign a legal release in a form determined by the Promoter and 'Toyota Motor Corporation Australia Limited' in their absolute discretion.

12. Total maximum prize pool value is $48,900.00 RRP including delivery of the vehicle to the valid address of the Car Prize Winner at an agreed time and date. The Promoter accepts no responsibility for any variation in prize values. The prizes are non-transferable, non-refundable and non-redeemable for other goods or services. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.

13. If any prize or element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable State or Territory legislation.

14. Eligible Entrants can only enter in their own name. Eligible Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of the household of an Eligible Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request an Eligible Entrant produce, within the requested time and before issuing a prize, appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) to verify an Eligible Entrant’s identity, age, residential address and email address, eligibility to enter and claim a prize and any information submitted by an Eligible Entrant in entering the promotion. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Eligible Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Eligible Entrant will be ineligible and deemed invalid.

15. Subject to any written direction by State Gaming Authorities, should any prize remain unclaimed an unclaimed prize draw from all non-winning entries will take place on the 24/02/11 at 10.00 am AEST at Telads Australia Pty Ltd Level 20, 644 chapel Street South Yarra Victoria 3141. Any winners will be notified in writing and published in the public notice section of The Australian on 28/2/11

16. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any prize or using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

17. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for: (a) tampering with the entry process and game play; or (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

18. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the websites of the Promoters, associated agencies and companies, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.

19. The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

20. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under applicable State or Territory legislation.

21. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.

22. The Promoter reserves the right, in its sole discretion to terminate, modify, cancel or suspend registrations if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other causes that may corrupt the administration, security or proper participation of the Registration process, and if terminated, award the Major Car Prize from among all eligible, non-suspect entries received up to time of cancellation.

23. The use of any automated entry software or any other mechanical or electronic means or which otherwise allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant and all entries from their household invalid.

24. In the event of any conflict with any promotion details contained in these Conditions of Entry and in any other promotional materials (including but not limited to point of sale, television, and print advertising, promotional packaging and other promotional mediums), the details of the promotion contained in these Conditions of Entry shall prevail.

25. As a condition of entering this promotion, an entrant consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

26. An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. The Promoter collects personal information about an entrant to include the entrant in the promotion and where appropriate award the Major Car Prize. If the personal information requested is not provided, the entrant cannot participate in the promotion.

27. (a) By participating in the promotion, an entrant also acknowledges that a further primary purpose for collection of the entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the entrant in the future with information on special offers or provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the entrant with special offers in this way. By entering the promotion, an entrant agrees that the Promoter may use the entrant’s personal information in the manner set out in this condition.

27. (b) By ticking the opt-in check-box on the online registration form, Eligible Entrants agree that their personal information may be used to supply latest news, events and offers. The Promoter and Toyota may disclose the information to Toyota dealers, to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses). The Promoter and Toyota are bound by the National Privacy Principles contained in the Privacy Act (Cth) 1988. A copy of Toyota’s privacy policy can be viewed at www.toyota.com.au. To request access to, or to update personal information Toyota holds about them, entrants can contact the office of Australia (an administrative fee may be imposed to access personal information).

28. An entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant State or Territory lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter at the address below. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.

If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under applicable State or Territory legislation.

21. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.

22. The Promoter reserves the right, in its sole discretion to terminate, modify, cancel or suspend registrations if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other causes that may corrupt the administration, security or proper participation of the Registration process, and if terminated, award the Major Car Prize from among all eligible, non-suspect entries received up to time of cancellation.

23. The use of any automated entry software or any other mechanical or electronic means or which otherwise allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant and all entries from their household invalid.

24. In the event of any conflict with any promotion details contained in these Conditions of Entry and in any other promotional materials (including but not limited to point of sale, television, and print advertising, promotional packaging and other promotional mediums), the details of the promotion contained in these Conditions of Entry shall prevail.

25. As a condition of entering this promotion, an entrant consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

26. An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. The Promoter collects personal information about an entrant to include the entrant in the promotion and where appropriate award the Major Car Prize. If the personal information requested is not provided, the entrant cannot participate in the promotion.

27. (a) By participating in the promotion, an entrant also acknowledges that a further primary purpose for collection of the entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the entrant in the future with information on special offers or provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the entrant with special offers in this way. By entering the promotion, an entrant agrees that the Promoter may use the entrant’s personal information in the manner set out in this condition.

27. (b) By ticking the opt-in check-box on the online registration form, Eligible Entrants agree that their personal information may be used to supply latest news, events and offers. The Promoter and Toyota may disclose the information to Toyota dealers, to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses). The Promoter and Toyota are bound by the National Privacy Principles contained in the Privacy Act (Cth) 1988. A copy of Toyota’s privacy policy can be viewed at www.toyota.com.au. To request access to, or to update personal information Toyota holds about them, entrants can contact the office of Australia (an administrative fee may be imposed to access personal information).

28. An entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant State or Territory lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter at the address below. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
