NINE NETWORK AUSTRALIA (“THE PROMOTER”)
TODAY – SANTA VITTORIA COMPETITION (“THE COMPETITION”)
CONDITIONS OF ENTRY (“THE RULES”)

1. Information on how to enter and prizes form part of these Conditions of Entry. Entries not
completed in accordance with the Conditions of Entry or received after close of entry will
not be considered. Incomplete or inaudible entries will be disregarded. The judge’s
decision in relation to any aspect of the promotion is final and binding on every person
who enters. No correspondence will be entered into.

2. The promotion is open to people who are residents of Australia who are 21 years
or older
except for employees of the Promoter, 5th Finger Pty Ltd and their immediate
families, and all companies and agencies associated with this promotion.

3. The promotion commences on Monday, August 9, 2010 at 05:30 AEST and concludes
on Friday, August 13, 2010 at 16:00 AEST
. The draw will take place at 5th Finger Pty
Ltd, L9 Australia Square, 264 George Street, Sydney, NSW 2000 on Friday, August 13,
2010 at 16:30 AEST. The winners will be notified by mail using contact details provided
in their entry and their name will be published in the public notices section of The
Australian on Thursday, August 19, 2010.

4. There are two ways of entering the promotion:

a. 1-90 Call: Participants can enter the promotion by calling and registering their full
name, address and a daytime telephone number on 1902 555 800 Maximum 1-
90 entry cost per message is 55c including GST. Calls from mobiles and pay
phones may attract a higher rate.

b. SMS: Text their full name and address to 199 55 800 Maximum SMS entry cost
per message is 55c including GST. The SMS entry mechanic is only open to
consumers with a SMS compatible mobile phone connected to a service provider
which permits text messaging to the promotional SMS number. It is
recommended that entrants check with their individual service provider in this
regard.


5. Multiple competition entries are permitted, subject to the following: (a) only one entry
permitted per SMS message or 190 call; and (b) each entry must be submitted separately
and in accordance with the entry requirements.


6. No responsibility accepted for late, lost, misdirected, incomplete or inaudible entries.

7. The winner of the promotion will be determined by the first valid entry randomly drawn by
the Promoter.

8. The first (1) valid entry drawn by the Promoter from all entries received will receive the
following prize;

PRIZE DETAILS:

• Two (2) x return business class tickets with Qantas to San Francisco
O Business class tickets valued at up to $30,920.00
O Must be used prior between the designated travel period of 16 Oct – 31 Oct
2010.
o Direct flights from with Qantas from Sydney to San Francisco operate only on
Mondays, Wednesdays, Fridays and Saturdays.
o Taxes, fees and travel management $2753.44
o Total of tickets, taxes, fees and travel management is valued at up to $33,673.44

• Two (2) x Domestic transfers from the winner’s nearest capital city to Sydney
(economy)
O Only valid if the winner is not from Sydney, this part of the prize will
not be included if the winner is a resident of Sydney.
O Valued at up to $2,680.00

• Return airport transfers in San Francisco –$125 each way which incl. Gratuities.
o Valued at up to $250.00
o Transfers to/from the airport will be pre-booked and pre-paid by Vittoria Coffee

• Four (4) nights consecutive stay for two (2) at the Grand Hyatt San Francisco,
Union Square
O Valued at up to $1,630.00
O Must be used between the designated travel period of 16 Oct – 31 Oct 2010.

• Return transfers to the French Laundry restaurant in the Napa Valley in private car
(7 hours including dinner) which includes private car, driver, waiting time during
dinner, gratuities and fees.
o Transfers to/from Napa Valley will be pre-booked and pre-paid by Vittoria Coffee
o Valued at up to $600.00

• Dinner for two at multi-award winning restaurant French laundry (3 Michelin star
awarded)
O Valued at up to $600.00
O Must be used prior between the designated travel period of 16 Oct – 31 Oct
2010.
o Restaurant bookings at The French Laundry are taken 2 months in advance to
the calendar date (i.e. Reservations for 20 October are taken 20 August).
o Dress code for restaurant – jacket required for gentlemen. No jeans, tennis
shoes, shorts or T-Shirts permitted.

• AUD$1000 spending money
O Valid for the trip only –must be used between designated travel period of 16 Oct
– 31 Oct 2010.
o The money will be transferred via EFTPOS straight into the winner’s nominated
bank account

9. The total prize package over the entire promotional period is valued at up to
AUD$40,433.44 including GST.


10. If a prize winner is under the age of 21 years, the prize will be forfeited.

11. The winner (and their companion) are responsible for all other expenses including
spending money, meals (unless specified), drinks, transfers (unless specified), laundry
charges, activities (unless specified), incidentals, energy surcharges, gratuities, services
charges, passports, visas, travel insurance and all other ancillary costs.

12. It is a condition of accepting the prize that the winner may be requested to present their
credit card or a cash deposit upon arrival at any accommodation to cover all incidentals
they may incur during their stay.

13. Prize values are based upon the full fare prices at the time of printing in the relevant
brochure. The Promoter accepts no responsibility for change in prize value between now
and the ultimate prize redemption date.

14. Unless expressly stated in these conditions of entry all other expenses (including travel to
and from the departure point) become the responsibility of the winner.

15. Travel restrictions may apply. Prize does not include travel insurance, which is required.
Travel insurance is highly recommended to protect against the additional costs incurred
in the event of unforeseen circumstances.

16. The prize (or any part thereof) cannot be sold, is not transferable or exchangeable and
cannot be taken for cash.

17. A valid passport is required for all international journeys. All Passports must have
minimum of 6 Months travel.

18. Flights and accommodation are valid for the designated travel period of 16 Oct – 31 Oct
2010 and cannot be taken with any other offer.

19. The two (2) flights must be utilized at the same time, for the same travel dates, to the
same destination.

20. The winner needs to present the original letter announcing their success when redeeming
flight tickets – the letter will be forwarded to the winner. This is a validity issue to ensure
the recipient of the flight(s) and accommodation is the actual winner of the competition.

21. Adequate travel insurance for the duration of the trip must be organised by the winner at
his/her own expense. Meals or tips, transfer fees (other than specified), excess baggage,
government taxes, airport charges and any other personal expenses not specified in the
prize package must be paid for by the winner.

22. If the prize or portion of the prize is unavailable, for whatever reason, the Promoter
reserves the right to substitute the prize for a prize of equal or greater value, subject to
State Regulation.

23. The Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

24. Prize winners are advised that tax implications may arise from their prize winnings and
they should seek independent financial advice prior to acceptance of their prize. In the
event that a potion of the prize is awarded to the winner in the form of a voucher / ticket /
pass, redemption of that portion of the prize will be subject to the terms and conditions
stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher /
ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
Redemption of the prize subject to the terms and conditions of the venue / service
provider.

25. By entering the promotion via SMS an entrant consents to the Promoter using the their
personal details for the purposes of sending one (1) mobile terminated (MT) reply
message which includes a confirmation of your entry in the promotion AND details of a
special offer made by one of our partners.

26. The prize winner will be notified within 2 days of the end of the prize draw by telephone,
and will also be notified in writing.

27. The Promoter makes no representation as to the safety, conditions or other issues that
may exist at any destination. International travel advice can be obtained from various
sources, including government, local consular offices and the web site of the Australian
Department of Foreign Affairs and Trade and www.smartraveller.gov.au/.

28. It is a condition of accepting a prize that the winner agrees to be interviewed,
photographed and filmed at any time during the acceptance of the prize by the Promoter
or their agents for a story or feature on this promotion to be developed and featured on
the Nine Network (or any other form of media it deems suitable) without further
remuneration or reference to the participant. Details may feature on Nine Network on a
date to be determined by the Promoters. The inclusion of any such feature (including but
not limited to creative control of the feature) will remain with the Promoter at all times.

29. Participants must ensure that all care is taken when dialing or sending messages to the
promotional number. It is the complete responsibility of the participant to ensure that they
dial or SMS the correct number, in the event that an error occurs the Promoter accepts
no responsibility for either, costs incurred, responses received or all other consequences.
This is the responsibility of the participant.

30. The Promoter accepts no responsibility for any SMS messages not received by the
Promoter or delays in the delivery of the SMS message due to technical disruptions or for
any other reason. An entry will only be counted as being received when it has been
received by the Promoter’s software system, not when it was sent from the handset.

31. If a medical circumstance in some way restricts your ability to enter the competition
through the required mechanic, you are still eligible to enter however you must briefly
state your circumstances upon entry.

32. If your entry is selected as a winning entry, validation of your circumstances/ the validity
of your entry will be undertaken by the Promoter. Method of validation (without limitation)
will be determined by the Promoter in its complete discretion. If the winning entry is
deemed to be a winner, the winner will be notified as per the terms and conditions herein.
In the event that the Promoter requests the entrant to sign any legal documents relating
to the verification of their medical circumstance, the legal documents will take the form
determined by the Promoter. It is a condition of accepting the prize that the winner signs
any such legal documentation.

33. The Promoter reserves the right to refuse to allow a winner to take part in any or all
aspects of the prize, if the promoter determines, in their absolute discretion, that a winner
is not in the mental or physical condition necessary to be able to safely participate in the
prize. It is a condition of accepting the prize that the winner may be required to sign a
legal release in a form determined by the promoter in its absolute discretion.

34. The Promoter reserves the right to verify, at any time during or after the closing of the
promotion, the validity of all entries and to disqualify any entrant who tampers with the
entry process, including techniques designed to avoid payment of call costs. SMS
entries via the internet are not valid and will not be accepted. The use of any automated
entry software or any other mechanical or electronic means that permits the participant to
automatically enter repeatedly are not valid and will not be accepted.

35. As this is an event based promotion the Promoter may conduct such further draws at the
same place as the original draw as are necessary at 10am AEST on Friday, 1st October
2010 in order to distribute the prize if it remains unclaimed by that date, subject however
to all reference to any relevant state and territory regulations. In the event of a winner in
the unclaimed prize draw, the winner will be notified in writing and their name will be
published in The Australian on Thursday, 7th October, 2010.

36. The Promoter is not responsible for any incorrect or inaccurate information, either caused
by the phone user or for any of the equipment or programming associated with or utilised
in this competition, or for any technical error, or any combination thereof that may occur
in the course of the administration of this competition including any omission, interruption,
deletion, defect, delay in operation or transmission, communications line or telephone,
mobile or satellite network failure, theft or destruction or unauthorised access to or
alteration of entries.

37. If for any reason this competition is not capable of running as planned (including but not
limited to) technical failures, unauthorised intervention, fraud or any other causes beyond
the control of the Promoter which corrupts or affect the administration, security, fairness,
integrity or proper conduct of this competition, the Promoter reserves the right in its sole
discretion to disqualify any individual who tampers with the entry process, and, subject to
any written directions given by the various Lottery Departments, to cancel, terminate,
modify or suspend the competition.

38. All entries and other information provided in the course of this competition become the
property of the Promoter and the Sponsor. The collection, use and disclosure of personal
information in connection with this promotion are governed by the Promoter’s Privacy
Notice available from Channel 9 and these Conditions of Entry. The Promoter may use
information it collects in relation to you to provide you with information regarding further
offers, promotions or goods and services provided by the Promoter and/or the Promoter’s
partners and sponsors. The Promoter may also disclose information about you to its
service providers to enable the Promoter to provide you with services. Your personal
information may be disclosed to State and Territory lottery departments and winners’
names published as required under the relevant lottery legislation. You consent to the
Promoter’s use and disclosure of information about you as contemplated by this
condition. To remove your information from the Promoter’s records, please send an email
to competitions@nine.com.au with your name, mobile phone number and your request to
cancel the service. If you wish to update or modify your details, please email
competitions@nine.com.au with your name, mobile phone number and your request to
update or modify your details.

39. To the full extent permitted by law, The Promoter will not be liable to you in respect of any
claim for any loss or damage whatsoever (including, without limitation, any consequential,
indirect, special, punitive or incidental damages) or for any personal injury suffered by
you as a result of or in connection with the Promoter’s provision of the Service. Certain
legislation may imply warranties or conditions or impose obligations (collectively
Provisions) in relation to the Promoter’s provision of services to you which cannot be
excluded, restricted or modified except to a limited extent. If those Provisions apply, to
the extent that the Promoter is entitled to do so, the Promoter’s limits its liability in respect
of any claim under those Provisions to, at the Promoter’s option, the supply of the
relevant services again or the payment of the costs of having the services supplied again.
