CONDITIONS OF ENTRY

Promoter: Jupiters Limited ABN 78 010 741 045 trading as Treasury Brisbane, top
of the Queen Street Mall, Brisbane QLD 4001 ph (07) 3306 8888 (“Treasury”).
Promotion period
1. The “August MGF” promotion (“Promotion”) will be held at Treasury,
commencing at 12.01am on Sunday 8 August 2010 and finishing at the
conclusion of the 9pm prize draw on Saturday 11 September 2010
(“Promotion Period”). All times are listed in Australian Eastern Standard
Time.
2. Twenty (20) prize draws will be held on the Main Gaming Floor Stage, level 1
at Treasury (“Draw Location”) during the Promotion Period. Prize Draws will
be held on Friday 13, 20 27 August and 3 and 10 September and Saturday
14, 21, 28 August and 4 and 11 September 2010 (each a “Draw Day”).
3. Two (2) Prize Draws will be held on each Draw Day at 7pm, and 9pm (“Prize
Draw”).
Entry requirements
4. Participation in the Promotion is open to persons who are:
a. 18 years of age or older;
b. members of the Casino Rewards program operated by the Promoter
and have a current Rewards or The Club membership card
(“Membership Card”); and
c. not the subject of an exclusion direction or self exclusion order
pursuant to the Casino Control Act 1982 (Qld).
People who meet the above conditions and continue to satisfy the conditions
during the Promotion Period are referred to as “Eligible Members” and will
be entitled to enter the Promotion.
5. The Promoter reserves the right to refuse any person entry in the Promotion.
Earning entries in a Prize Draw
6. Eligible Members will be eligible for one (1) entry for every two Casino Dollars
earned for gaming machine play or equivalent table play during each Entry
Period (when the Eligible Member’s Membership Card is correctly inserted
into the gaming machine and removed from the gaming machine during the
relevant period (“Entry”).
7. Entries generated by rated table game play will be entered via TableLink and
electronically uploaded into the Casino Management System and will
automatically generate entries based on a formula calculated according to the
time played with a minimum average wager of $10. A Member’s session of
table play ends when the table game dealer swipes their Rewards
membership card to finish off their play (failure to do this at least 30 minutes
before the next Prize Draw on a Prize Draw Day may result in an entry not
being included in the Prize Draw). It is the Member’s responsibility to request
the table game dealer to finish off their session of play so that their Entry may
be included in the next Prize Draw.
8. Entries may be earned during the following times (each a “Entry Period”):
a. 12.01am Sunday 8 August 2010 to 8.30 pm Friday 13 August 2010 to
enter the Prize Draws on Friday 13 August 2010.
b. 12.01am Sunday 8 August 2010 to 8.30 pm Saturday 14 August 2010
to enter the Prize Draws on Saturday 14 August 2010.
c. 12.01am Sunday 15 August 2010 to 8.30pm Friday 20 August 2010 to
enter the Prize Draws on Friday 20 August 2010.
d. 12.01am Sunday 15 August 2010 to 8.30pm Saturday 21 August 2010
to enter the Prize Draws on Saturday 21 August 2010.
e. 12.01am Sunday 22 August 2010 to 8.30pm Friday 27 August 2010 to
enter Prize Draws on Friday 27 August 2010.
f. 12.01am Sunday 22 August 2010 to 8.30pm Saturday 28 August 2010
to enter Prize Draws on Saturday 28 August 2010.
g. 12.01am Sunday 29 August 2010 to 8.30pm Friday 3 September to
enter Prize Draws on Friday 3 September 2010.
h. 12.01am Sunday 29 August 2010 to 8.30pm Saturday 4 September to
enter Prize Draws on Saturday 4 September 2010.
i. 12.01am Sunday 5 September 2010 to 8.30pm Friday 10 September
to enter Prize Draw on Friday 10 September 2010.
j. 12.01am Sunday 5 September 2010 to 8.30pm Saturday 11
September 2010 to enter Prize Draw on Saturday 11 September
2010.
9. Eligible Members who have earned entries in accordance with Conditions
7,8 and 9 must swipe their current Rewards or The Club membership card
from 9am each Draw Day at a Member Kiosk at least 30 minutes before each
Prize Draw to be eligible to enter that Prize Draw and all subsequent Prize
Draws on the Draw Day. The Member Kiosks will close 30 minutes before
each draw and will reopen 5 minutes after each draw. Eligible Members who
have earned entries during the week must swipe on each separate Draw Day
to be included in the Draw. Entries are only valid for the Prize Draws as
stated in Condition 6 and 7.
10. Entries generated according to these Conditions of Entry will be included in
the relevant Prize Draw after being redeemed at the Member Kiosk and will
be included in all subsequent Prize Draw/s held on the relevant Draw Day.
Prize Draws and Prizes
11. Each Entry will be allocated a unique individual entry number. The number
range programmed into an approved Random Number Generator (“RNG”) will
be set for each Prize Draw to include all the entry numbers for Entries
included in that Prize Draw.
12. At each Prize Draw, the name and membership number of the Eligible
Members will be selected by random selection using the relevant entry
numbers for that Prize Draw (“Selected Entrant”). The name (and
membership number if applicable) of the Selected Entrants will be announced
at the Draw Location. Selected Entrants must be “present at the Prize Draw”
pursuant to Condition 13.
13. To be deemed “present at the Prize Draw”, the Selected Entrant must present
themselves to a Treasury representative at the Draw Location, Platinum Suite
Bar or VIP Services Desk within three (3) minutes of their name being
announced and provide suitable identification in accordance with Conditions
20 or 21 within five (5) minutes of presenting themselves. Selected Entrants
are not permitted to send a proxy to claim a Prize. Selected Entrants that are
‘present at the Prize Draw’ are “Identified Selected Entrants”.
14. If a Selected Entrant at a Prize Draw does not satisfy Condition 13 or does
not otherwise satisfy these Conditions of Entry, the Prize Draw will be
declared closed and the Prize available will jackpot to the following Prize
Draw (except the 9pm Prize Draw on 11 September). For example, if a
Selected Entrant is not present at the 7pm Prize Draw on 11 September to
claim a Prize, the Prize at the 9pm Prize Draw on 11 September will be
$10,000 plus $10,000 from the previous Prize Draw. The Selected Entrant at
the next Prize Draw on that Draw Day who satisfies these Conditions of Entry
will win the base prize amount for that Prize Draw plus any jackpot amounts
which may have attached to that Prize in accordance with this Condition.
15. If at the 9pm Prize Draw on the 11th of September, the Selected Entrant
does not satisfy Condition 13 or does not otherwise satisfy these Conditions
of Entry, a re-draw will take place immediately at the Draw Location. The
Promoter will conduct up to ten (10) redraws if required. Each Eligible Entrant
drawn in a re-draw under this Condition 15 will have three (3) minutes to
present at the Draw Location and confirm their identity within five (5) minutes
of presenting themselves in accordance with Conditions 20 or 21 in order to
claim a Prize. Selected Entrants are not permitted to send a proxy to claim a
Prize. If after ten (10) redraws in this manner an Selected Entrant who
satisfies Condition 13 and this Condition 15 cannot be located to claim the
Prize, the Prize will be awarded to the Selected Entrant drawn first at the 9pm
Prize Draw on the 11th of September and that Selected Entrant will not be
required to satisfy Condition 13 (“Default Selected Entrant”). The Selected
Entrant so selected will be notified of their win by phone or mail in accordance
with their membership details held by the Promoter. The Selected Entrant will
be required to collect their Prizes from the VIP Services Desk on level 2 at
Treasury and provide identification in accordance with this Condition 15 and
Conditions 20 or 21 at the time of collection.
16. An Identified Selected Entrant or Default Selected Entrant will be eligible to
win a Prize (“Winner”).
Prizes
17. The Winners of each Prize Draw, subject to compliance with these Conditions
of Entry, win $10,000 (“Prize”).
18. Winners may choose to take the Prize in the form of cash or a cheque or a
combination of both.
19. The total prize pool for this Promotion is $200,000.
Identification
20. A Selected Entrant or Default Selected Entrant must produce valid
identification acceptable to the Promoter in order to receive a Prize. Valid
identification acceptable to the Promoter will be either one form of valid
photographic identification (passport or Australian driver's licence) with a
clearly visible and undamaged photograph or two other forms of nonphotographic
identification acceptable to the Promoter.
21. The Promoter reserves the right to waive or vary the identification
requirements in circumstances where the identity of a Selected Entrant or
Default Selected Entrant is determinable by the Promoter at its discretion
without the assistance of these or any other form of identification.
General
22. Directors, management and employees of the Tabcorp Holdings Ltd Group of
companies (including any related body corporate as defined in the
Corporations Act 2001) or of any suppliers or agencies associated with this
Promotion and their immediate families are not eligible to participate in this
Promotion. “Immediate family” has the same meaning given to that phrase in
the Charitable and Non-Profit Gaming Rule 1999 (Qld). The Tabcorp Holdings
Ltd Group comprises, but is not limited to, the businesses of Star City Casino,
Jupiters Hotel and Casino, Treasury Casino and Hotel, Jupiters Townsville,
Tabaret, and Jupiters Keno.
23. Prizes in the Promotion must be taken as stated and are not transferable and
cannot be exchanged or redeemed for alternate prizes. Any tax liability or
implication which attaches to a Prize is the responsibility of the person
claiming or using that Prize.
24. Unless otherwise stated, all other costs associated with taking and using the
Prizes, are the responsibility of the Winners.
25. While the Promoter intends to conduct the Promotion as offered, the
Promoter reserves the right to cancel or change the Promotion or prize
offered in the Promotion if it can no longer continue the Promotion or offer a
prize due to the circumstances outside the Promoters control.
26. The Promoter reserves the right to disregard all Entries of, and disqualify, any
person who has tampered with the entry mechanisms or processes of the
Promotion in any way, including by way of an Entry that is fraudulent.
27. The Promoter does not guarantee the continuous or fault-free operation of the
entry or draw processes, including entry validating and Draw, during the
Promotion. In the event of any technical difficulties with the kiosk, the
Promoter reserves the right to adopt a manual process of generating Entries.
If a manual process is adopted, Eligible Members may visit the VIP Services
Desk on level 2 at Treasury to have a representative of the Promoter check
their entitlement to an Entry.
28. The Promoter is not responsible for any loss, damage or injury suffered or
claimed (including, but not limited to, indirect or consequential loss or
damage, personal injury or death, and direct or indirect loss or damage by an
entrant, in relation to entering or participating in this Promotion or the taking
or using of Prizes offered or taken except where that loss damage or injury
was caused by breach of these terms and conditions by the Promoter or the
wilful or negligent acts or omissions of the Promoter. To avoid any doubt, the
Promoter shall not be liable for the loss caused by technical or mechanical
malfunction which is outside the control of the Promoter.
29. Conduct of the entire Promotion, including decisions on the eligibility of
persons to enter, shall be the responsibility of the Promoter.
30. The Promoter cannot guarantee that announcements can be heard in all parts
of the Draw Location or throughout the remainder of Treasury.
31. To the extent that a situation or issue arises for which these terms and
conditions make no provision or in relation to which the relevant terms and
conditions are unclear, the Promoter reserves the right to make a decision
regarding such situation or issue which is not inconsistent with these terms
and conditions.
32. Winners may be asked to participate in publicity or advertising at the request
of the Promoter. Participation in any such publicity or advertising is at the sole
discretion of the relevant Winner. The names of Winners will not be published
without their consent except in accordance with these Conditions of Entry,
and entry into this Promotion constitutes consent to publication in accordance
with these terms.
33. The information recorded on tickets, entry forms or computer systems at
Treasury Casino and Hotel is collected by the Promoter for business analysis
and promotional purposes. If an entrant does not provide the information
requested then the Promoter may deem the entry invalid. Privacy law allows
entrants to access the personal information that the Promoter holds about
them, in certain circumstances. The Promoter’s privacy statement can be
viewed on their website www. treasurybrisbane.com.au.
34. A copy of these Conditions of Entry governing the Promotion will be available
at the Customer Service Desk, Level 1 throughout the Promotion Period.
Participation in the Promotion indicates acceptance of these Conditions of
Entry governing the Promotion.
