Information on how to enter and the prizes form part of these conditions of entry. Entry into the competition is deemed acceptance of the terms and conditions.


Entry is open to all residents of Queensland aged 18 years or over who fulfil entry requirements.


The following persons are ineligible to enter:



a). employees of, or contractors to, the Promoter or any of its related bodies corporate; and b). the spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), of such employees and contractors (whether or not they live in the same household).



All Contestants acknowledge that even if the Promoter only learns of a person’s ineligibility after the Promoter has appeared to award the prize to the ineligible person, it may require the return of the prize or payment of its value to the Promoter to be dealt with as an unclaimed prize.


Competition commences 5pm (AEST) Friday, 13th August and closes 5 pm (AEST) on Wed, 15th September 2010 (“Promotion Period”). Entries received after closure of the Promotion Period will not be eligible.


To enter, participants must:  a). fill in the online entry form on one of the participating 19 newspaper websites during the Promotion Period: Daily Mercury (Mackay), Morning Bulletin (Rockhampton), The Observer (Gladstone), NewsMail (Bundaberg), Fraser Coast Chronicle (Hervey Bay), Gympie Times (Gympie), Sunshine Coast Daily (Sunshine Coast), Queensland Times (Ipswich), The Chronicle (Toowoomba), Warwick Daily News (Warwick), Whitsunday Times (Airlie Beach), cqnews (Emerald), Central Telegraph (Biloela), Noosa News (Noosa), Coolum News (Coolum), Gold Coast Mail (Gold Coast), Ipswich Advertiser (Ipswich), The Reporter (Ipswich), The Satellite (Ipswich), Tweed News (Tweed).         



b). Those entrants who elect to complete optional questions 2, 3 and 4 will automatically receive an additional two entries to go into the draw. All entries completed and submitted during the Promotion Period with a valid email address will go into the draw.



Contestants may only submit one entry.


Any form of automated electronic entry that does not meet the entry requirements will be deemed invalid and not counted as a valid entry.


All entry times are considered as the time the entry is received by the Promoter’s database.


The prize consists of $2000 cash, payable as a cheque or Electronic Transfer to bank account details supplier by the winner.


The prize winner will be selected by random draw at 12.00pm AEST on Thursday, 16th September 2010 at the Promoter’s office, Level 3, 33 Park Road, Milton QLD 4064.


Judges’ decision is final and no correspondence will be entered into.


Winner will be contacted by phone, and published in The Australian public notices.


All prize winners acknowledge that the Promoter has the right to publicise and publish his / her name, character and likeness.  All prize winners must avail themselves for a photo if required by the Promoter and acknowledge that the Promoter has the right to utilise publicity photos in any reasonable manner it sees fit without compensation to the prize winner.


Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of that winner.  Prizes are non-transferable and may not be redeemed for cash.  If the specified prize becomes unavailable due to unforeseen circumstances, the Promoter may substitute a prize of similar nature and/or like or greater value.


All prizes that remain unclaimed 90 days after notification will be redrawn by random draw in an unclaimed prize draw to be held at 12:00pm (AEDT) on Monday 8th November 2010 at the same place as the original and names of winners of the second draw will be published in the public notices section of The Australian on Saturday 13th November 2010.


Upon request by the Promoter a copy of these conditions of entry and/or a signed receipt and acknowledgement must be signed and endorsed by any winner to indicate his/her understanding and acceptance of these terms.


If for any reason the competition is not capable of running as planned including (but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the Promoter’s control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, we are entitled in our sole discretion to cancel, terminate, modify or suspend the competition.


The Promoter is not responsible for the loss of prizes due to incorrect or imprecise delivery details provided by a winner.  The Promoter also takes no responsibility for prizes lost or stolen after they have been released for delivery via postage or courier. 


The Promoter acknowledges that there are implied warranties and conditions in relation to the goods and servicers that form part of the prize which the Promoter may not exclude. Where the Promoter is liable for breach of any implied warranty or condition that may not be excluded, the Promoter’s liability will, to the extent permitted by law, be limited to any one or more of the following (at the Promoter’s option):

      The prizes will be awarded in the form of a letter posted to each prize winner informing them of the win.  It is the entrant’s responsibility to advise the Promoter of any change of personal details. A Dux Hot Water representative will contact each prize winner to organise product selection and installation, which must be carried out by the recommended Dux installer.

   9.


      Dux Hot Water will cover standard installation costs up to the value of $650 for an Airoheat heat pump or $1,500 for a Sunpro Solar hot water system. Any additional costs will be covered by the winner. These include but are not limited to, tank relocation and additional pipework costs.

  10.


      The winners agree to assign any REC’s (Renewable Energy Certificates) generated by their system to Dux Hot Water.

  11.


      Winners acknowledge that having being provided a free environmental hot water system, they may be ineligible for some or all Government rebates normally on offer in their state of residence.It is the ultimate responsibility of the contestant  to determine their rebate eligibility, by reviewing the guidelines on the relevant government website.

  12.

(ii) in the case of the supply of services:


   (A)           the supplying of the services again; or


   (B)           the payment of the cost of having the services supplied again.

      Except for liability for a breach of the warranties mentioned above, and to the extent permitted by law, the Promoter makes no representations or warranties as to the quality, suitability or merchantability of any of the goods offered as prizes, and the Promoters are not liable for any loss suffered or sustainedto personal property, including but not limited to consequential (including economic) loss, by reason of any act or omission, deliberate or negligent, by the Promoters or their servants or agents, in connection with the Competition.

      By entering this competition you agree to allow the Promoter and its partners in this promotion to contact you for any future promotional, marketing and publicity purposes. All entries become the property of the Promoter.
