*1 TERMS AND CONDITIONS OF ENTRY
1. Instructions on "How to Enter" form part of these Terms and Conditions. 2. Participation in this Promotion constitutes acceptance of these Terms and Conditions. 3. Each enterprise carrying on business at each Harvey Norman complex under a name or style including the words "Harvey Norman" or at Harvey Norman PhotoCentre Online, is operated by an independent franchisee (Franchisee) pursuant to a franchise granted by a subsidiary of Harvey Norman Holdings Limited ACN 003 237 545 (Harvey Norman) (Franchisor). 4. The Promotion is open to all residents of Australia aged 18 years and over, except employees, officers and immediate families of officers and employees, of the Promoter, Franchisees, the Franchisor, any other organisation associated with this Promotion including their related entities. 5. This Promotion may be advertised in ACP Publications (including in Woman's Day, The Australian Women's Weekly, Madison, House & Garden, Real Living and Shop For Kids magazines) and on national television, radio and online. 6. When completing an entry form, entrants must include a "caption" that best describes the moment captured in their Photograph. 9. Entry forms are available from any Harvey Norman PhotoCentre located in a Harvey Norman Complex or are available to download or complete electronically from Harvey Norman PhotoCentre Online at www.harveynormanphotos.com.au/photocomp.html. 10. To enter the Promotion, entrants must complete an entry form and submit their entry by any of the following methods: (a) attach a hard copy of their Photograph (with their full name written on the back of the Photograph) to their completed entry form and either: (i) place their completed entry in an official entry box located at a Harvey Norman PhotoCentre in any Harvey Norman Complex; or (ii) post their completed entry to "Harvey Norman Shutterbug Kids Promotion", Po Box 449 Eastern Suburbs MC NSW 2004; or (b) by the entrant registering to become a member of Harvey Norman PhotoCentre Online, or otherwise where the entrant is already a member by logging into the Harvey Norman PhotoCentre Online, and by the entrant uploading a soft copy of their Photograph and following the instructions to send the completed entry electronically to the Promoter (or to shutterbugkids@acpmagazines.com.au). 11. By submitting their entry into this Promotion each entrant, consents to receiving a discount offer from Harvey Norman PhotoCentre Online. If the entrant further indicates its consent on the entry form to receive further information and marketing material from Harvey Norman, the entrant consents to receive this information and marketing material from or on behalf of the Franchisees, the Franchisor or their related entities, unless the entrant opts out by giving notice to the sender. 12. By entering this Promotion, each entrant consents to their entry (including but not limited to their name, their child's name and their Photograph) being used in any feature created by the Promoter. The Promoter is entitled to use any such feature for any purposes at its discretion, including for any future promotion, marketing and publicity purposes in any form of media. Features may appear in/on the Promoters media and/or on media advertising or promoting the Harvey Norman brand. 13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, proof of age, place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any time does not constitute a waiver of those rights. 14. Entries that are incomplete, indecipherable, illegible, or do not comply with these Terms and Conditions are invalid. 15. Only one (1) entry is permitted per child. 16. This is a game of skill and chance plays no part in determining the winner. 17. Judging of the entries will commence on 5 October 2010 at the Promoter's premises. The Promotion will be judged by a panel of judges appointed by the Promoter. Each entry will be individually judged based on literary and creative merit and suitability for the Promotion. 18. Winners will be notified by phone using contact details provided in their entry 19. The best entry as determined by the judges will be deemed the Major Prize winner and will receive the $10,000 Commonwealth Bank Education Savings Plan. This prize will be awarded in the form of a single payment of AUD $10,000 deposited directly into an Education Savings Plan with the Commonwealth Bank*2. The child (1) as nominated by the winner will be the nominated child of the Plan. The winner (or the nominated child's parent or legal guardian) will be the nominated investors of the child's Plan and will have full control of the Plan. Redemption of the prize is subject to the standard business guidelines of the Commonwealth Bank and the standard terms and conditions of Commonwealth Bank Education Savings Plan. 20. The next best 25 entries as determined by the judges will be deemed Runners Up and will each receive a Runners Up Prize pack valued at $148.90. This pack consists of a 16 x 16 inch canvas art of the winner's Photograph provided by Harvey Norman PhotoCentre Online (RRP $89.00), a copy of The Australian Women's Weekly's, More Cakes for Kids (RRP $29.95) and Kid's Cooking (RRP $12.95). The Promoter is not responsible if the value of the prizes change between the date of publication of these Terms and Conditions and the date the prizes are awarded. 21.Prizes do not include any ancillary costs associated with redeeming the prize. These are the responsibility of the winner. 22. The Promoter's and the judge's decision in relation to this Promotion is final and binding on entrants and the Promoter will not enter into any correspondence. 23. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification. 24. Prizes, or any unused portion of the prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 25.If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate. 26.Where the prize is awarded in the form of a gift card / voucher/ letter, the Promoter will not be liable for any gift card / voucher /letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the gift card / voucher/ letter is subject to the terms and conditions specified on the voucher / gift card /letter. 27.Except for any liability that cannot be excluded by law, the Promoter, Harvey Norman Holdings Limited, their related entities and their officers, employees and agents, exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) redemption of the prizes and/or (g) participation in the Promotion. 28. If the Promoter, in its absolute discretion, considers a Photograph is in violation of any laws, the Promoter may report the entrant to the appropriate law enforcement authority and the entrant will have no claim against the Promoter for any loss or damage it may suffer as a result. 29.All entries and Photographs submitted become the property of the Promoter. Entries, including hard and soft copies of the Photographs, will not be returned to any entrant. By entering the Promotion each entrant warrants to the Promoter that each entry submitted (including but not limited to Photographs) is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter, Harvey Norman, their related entities and their officers, employees and agents, against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The entrant grants to the Promoter, and their related entities an irrevocable and unrestricted right to use and publish any of the entries (including but not limited to the Photographs), for any purpose at their discretion and in any manner and/or medium, to alter the Photographs without restriction and to retain all copyright in the Photographs, including (but not limited to) for any future promotion, marketing and publicity purposes. 30.By entering the Promotion, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter's other publications, products, services and events and to promote third party goods and services the Promoter considers the entrant may be interested in receiving.31.By entering the Promotion, entrants consent to their personal information being used by the Promoter and the Franchisor or their related entities on any of their behalf for the purpose of conducting this Promotion and supplying any prizes, notifying the winners, and for any other purpose contemplated by these terms and conditions. 1. For a student under 18 there will normally be no tax payable as long as the sum of eligible education expenses withdrawn, plus investment income (from any source), is less than $3,000. If you wanted to take out more than this for education expenses for the nominated student, the first $3,000 comes from investment earnings (which isn't charged tax provided the student has no other assessable investment income for the year). The remaining balance comes from capital on which no tax is payable either. When the nominated student turns 18 there is normally no tax liability, as long as the sum of the education expense reimbursements, together with the student's employment and investment income from all sources, falls below $15,000 in a financial year 2. If you establish a regular savings plan, the minimum monthly contribution is $100 per investment option. A minimum of $500 per investment option applies for lump sum contributions. 3. The information provided on each investment option is a suggested guide only and is not intended as investment advice. Please refer to the Product Disclosure Statement and your investment advisor for more information. Within the first 24 months of the prize being awarded, access to funds held in the Education Savings Plan ("Plan") is restricted to payments for approved education expenses in accordance with the product disclosure statement dated 15 June 2010. Lifeplan Australia Friendly Society Limited ABN 78 087 649 492 and its related bodies corporate ("Lifeplan") are otherwise under no obligation to release or arrange for the release of funds held in the Plan within the first 24 months. Should the winner seek the release of funds for purposes other than to pay for approved education expenses within this period, the prize will be invalidated and the competition winner shall have no further claim to and shall in perpetuity release Lifeplan from all claims and any obligation to make payment of any balance held in the Plan. A formal request for withdrawal of funds by the prize winner will invalidate the prize. The prize winner may seek approval from the bank to reinstate the prize. If approval is given by the bank, the original term for access will continue. In the event of forfeiture, the prize money will be returned to the bank and any earnings will be paid to the prize winner and will be treated as a non education payment. The prize winner shall forfeit any Education Tax benefit.
