Terms and Conditions1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.
2. The promoter is Jetstar Airways Pty Limited (ABN 33 069 720 243) of Level 1, 473 Bourke Street, Melbourne VIC 3000 (Promoter).
Eligibility
3. Entry is open to Australian residents aged 18 years and over (Eligible Entrants), excluding directors, management, employees and their immediate families of the Promoter and its related bodies corporate and registered travel companions of employees of the Promoter and its related bodies corporate.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrant’s personal details (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry process that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights under these terms and conditions at any stage does not constitute a waiver of those rights.
5. The Promotion commences at 10:00 am (AEST) on Wednesday 11 August 2010 and closes at 11.59 pm (AEST) on Monday 23 August 2010 (Promotion Period).
Competition entry
6. To enter, Eligible Entrants must during the Promotion Period:
visit
www.jetstar.com/powderfinger;register their name, suburb, postcode, contact phone number, email address, age, video title and video description;
upload a 90 second long video, no larger than 15Mb in size, which was filmed by the Eligible Entrant and captures the public’s excitement and anticipation of the Powderfinger Sunsets Farewell Tour; and
upload a sample of their writing, no more than 600 characters in length, (the Entry Process).
7. Each Eligible Entrant is permitted one entry into the promotion. Multiple entries are not permitted.
8. Hard copy videos will not be accepted.
9. After completing the Entry Process, each Eligible Entrant will receive an email advising them whether their video has been approved or rejected. If the video is approved, it will appear in an on-line gallery (see
www.jetstar.com.au/powderfinger). When someone clicks on your video and views it in the gallery, a larger version of the video will appear with the title, description and the Eligible Entrant’s name.
10. Incomplete, indecipherable, or illegible entries will be deemed invalid and will be rejected. The Promoter reserves the right to disqualify, in its sole discretion, any entry that it reasonably suspects is prohibited by these terms and conditions, any relevant law, or is otherwise deemed inappropriate. Videos that are considered unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, contain objectionable content or are otherwise inappropriate will be deemed invalid and rejected. The Promoter, in its absolute discretion, reserves the right to notify relevant authorities including law enforcement bodies and provide them with the objectionable entry and the entrant’s personal information.
11. The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
12. Each Eligible Entrant warrants to the Promoter that: (a) his or her entry (including the entrant’s video) is an original artistic work of the entrant that does not infringe the rights of any third party, including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal or proprietary rights; and (b) he or she has provided a copy of these terms and conditions to any individual whose identity is apparent in the video, or can reasonably be ascertained from looking at the video, ensuring that the individual understood the terms and conditions, and obtained their consent for the entrant to submit the video and for it to be used as outlined in these terms and conditions. The Eligible Entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of these warranties. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
13. As a condition of entering into this promotion, each entrant grants to the Promoter a non-exclusive, perpetual, irrevocable, royalty-free, world-wide license to use their entry in any media (including banners, signage, posters, television, magazine, Internet, MMS, DVD or other digital or print formats) for an unlimited time for any purpose, including but not limited to publishing the entries on the Promoter’s website, promoting future promotions and competitions of a similar nature, and whether or not in connection with the Promoter’s promotions, advertising or marketing. The entrant must, at its own cost, do all things and execute all documents necessary to ensure that this licence is effective.
14. By qualifying to be the official Jetstar Powderfinger Sunsets Farewell Tour Blogger, you grant Jetstar full rights to record your identity, likeness and voice in connection with the Jetstar Powderfinger Sunsets Farewell Tour, and to use this in any manner as Jetstar may choose, in any and all media and manner throughout the world now known or later developed, for any purpose whatsoever including (but not limited to) production, distribution, broadcast, advertising and promotion.
15. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
16. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
17. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
18. The exclusion of liability in clause 17 does not apply to limit or exclude liability:
for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter’s Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or
to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
19. Entry details remain the property of the Promoter. The name and image of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes. The Promoter may disclose such information to third parties, including, but not limited to prize suppliers and as required, to Australian regulatory and enforcement authorities. The Promoter will store videos at an external hosting site, which may be used by the Promoter at a later date for promotional purposes, and the entrant consents to such collection by the external hosting site. By ticking the relevant ‘Jetmail’ opt-in box when you register to participate in the promotion as either an entrant you consent, until you advise us otherwise, to receiving future marketing communications from the Promoter for an indefinite period, including via electronic communications and via phone. Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available at

Judging:
22. The Promoter will award one prize to the Eligible Entrant who submits the most creative entry, as judged by a panel, appointed by the Promoter, at 3pm on Wednesday 25th August at the Promoter’s offices, Level 1, 473 Bourke Street, Melbourne VIC 3000.
23. The winning entry must also demonstrate strong communication, writing and presentation skills and the judges will be looking for entries that demonstrate creativity, combined with originality of thought and technical excellence.
24. The result of the judging is final and no correspondence will be entered into.
25. The winner will be notified by phone and email by Thursday 26 August 2010 and their name will be published in The Australian on Friday 27th August 2010.
26. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming a prize. For any prize that remains unclaimed on Monday 30 August 2010 the Promoter will award the prize to the Eligible Entrant with the next most creative entry as judged by the Panel at 3pm on Monday 30 August at the Promoter’s offices, Level 1, 473 Bourke Street, Melbourne VIC 3000. A winner awarded the prize by this method will be notified by phone and email by Monday 30 August 2010 and their name will be published in The Australian on Wednesday 1 September 2010.
Prizes:
27. The prize is travelling with the Powderfinger Sunsets Farewell Tour from Wednesday 1 September to Saturday November 13 (the Tour) as the official blogger. There will be some breaks during the tour, during which the winner will be flown back to their nearest capital city until the tour recommences. The official blogger role includes:
return economy airfares for the winner flying Jetstar and Qantas from the winner’s nearest capital city to all destinations on the Powderfinger Sunsets Farewell Tour;
ground transportation and accommodation throughout the Powderfinger Sunsets Farewell Tour;
venue entry and access passes for the 34 performances comprising the Powderfinger Sunsets Farewell Tour; and
a cash payment of $100 per day to cover meals and expenses when on tour.
28. Throughout the tour, the winner is expected to behave in a manner that reflects the promoter’s core principles and values. Failure to act in such a way may, at the Promoter’s sole discretion, lead to the winner forfeiting the remainder of the prize.
29. Pursuant to instructions given by the Promoter, the winner may be responsible for:
producing daily blogs, video diaries and twitter updates;
the onsite delivery of various ticket giveaways, conducting fan activities and consumer promotions; and
conducting media interviews with Powderfinger, support acts and fans.
30. The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The prize is not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person.
31. If the prize (or any part of the prize) cannot be provided, the Promoter, in its sole discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification.
32. The winner cannot sell, transfer or award any part of their Powderfinger Sunsets Farewell Tour prize package to any other person. In the event that a prize winner is unable to attend, the entire prize package will be forfeited unless a suitable alternative agreement can be reached with the Promoter.
33. The winner will be given exclusive Jetstar apparel, which he or she will be required to wear whenever he or she is participating in any official Powderfinger Sunsets Farewell Tour activities or participating in any Jetstar event (as requested by a Jetstar representatives).
34. The maximum total prize value is $20,000 based on the recommended retail value at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prize.
