MISS SHOP 25 YEAR CELEBRATION COMPETITION - MISS MISS SHOP COMPETITION
1.Information on how to enter this Competition and the prizes forms part of these Terms and Conditions.  Entry into this Competition is deemed to be an acceptance of these Terms and Conditions. This is a game of skill, such that chance plays no part in determining the winners of the Competition.
2.The Promoter is Myer Pty Ltd, 800 Collins Street, Docklands, VIC 3008 (ABN 83 004 143 239).
PROMOTIONAL PERIOD
3.The Competition commences on 23 July 2010 at 9:00am (AEST) and concludes at 20 August 2010 at 11:59pm (AEST) (Promotional Period). 
ELIGIBILITY TO ENTER
4.Entry into the Competition is open to Australian residents aged 18 - 25 years during the Promotional Period and at the time of judging the winners.  Directors and employees of the Promoter and their immediate families (including spouse, parent, child or sibling whether or not they live in the same house) and printers, suppliers, providers and agencies associated with this Competition are not eligible to enter.
HOW TO ENTER
5.To participate in the Competition entrants must during the Promotional Period:
a.create a “look” using either the 70's, 80's, 90's or today-inspired fashion;
b.take a digital photo of themselves (or a friend) wearing the look;
c.visit www.myer.com.au/missshop (Website);
d.complete the online entry form available on the Website, which includes providing details such as (but not limited to), the entrant’s first and last names, address, phone number, email address, age and favourite Myer store;
e.upload the digital photo to complete the registration.  Entrants may add up to four (4) additional photos or videos to their entry.
6.Only one (1) entry may be made from a particular email address and entrant’s name.  Different entrants may not use the same email address. 
7.Subject to these Terms and Conditions, upon acceptance of an entry by the Promoter, the entrant's photo will be displayed on the Website for viewing by the general public.
8.The Promoter reserves the right not to accept or display on the Website, and to remove from the Website, any materials submitted by an entrant (including any information, comments, images or videos provided, entered or uploaded as a part of this Competition) (Entry Materials) at its sole discretion.  For example, any Entry Materials containing inappropriate, distasteful or offensive material may be refused to be accepted or displayed on the Website by the Promoter or removed from the Website at anytime.  The Promoter also reserves the right to disqualify any entries at its sole discretion. 
9.The Promoter’s decision in relation to any aspects of the Competition, including content displayed on the Website and disqualification, is final and binding on all entrants and no correspondence will be entered into.
10.Photos and/or videos submitted by entrants as part of their Entry Materials must:
a.be taken by entrants themselves;
b.not exceed 1024 Kb (1 megabyte) for each photo; and
c.not exceed 1 GB for each video.
11.All Entry Materials (including photos and videos) become and remain the property of the Promoter upon submission and will not be returned to entrants.
12.Entrants may elect to have their entry withdrawn from the Competition at any time during the Promotional Period if they no long wish to participate as an entrant, and the Promoter will remove their Entry Materials from the Website within a reasonable time from receiving the request.  All votes received up to the time when the Entry Materials are removed will be forfeited, and the entrant will no longer be eligible for any prizes in the Competition.   
VOTES
13.Valid entrants will receive one (1) vote towards their total number of votes upon acceptance of their entry. Voting is open to Australians of all ages who have access to the internet and register for voting on the Website. 
14.To vote, voters must during the Promotional Period:
a.visit the Website;
b.complete the voting profile form, which will include providing details such as their full name and a valid email address;
c.select their favourite entry;
d.submit their vote for that entry.
15.A voter can vote for more than one entry, but a voter may only vote for a particular entry once.
16.Voters may post comments in relation to entries.  The Promoter reserves the right not to display or to remove or modify any comments in its sole discretion. 
17.Entrants cannot vote for their own entry.  Entrants found to have voted for themselves will have their entry disqualified and all votes for that entry will be voided.
CHALLENGES AND BONUS VOTES
18.Entrants will have the opportunity to complete weekly fashion challenges throughout the Promotional Period, and be awarded bonus votes.
19.It is not compulsory to complete each or any challenge to be eligible for the Major Prize, however if an entrant completes a challenge and submits the relevant materials during the designated Challenge Period, and the material is accepted by the Promoter, then the entrant will be allocated bonus votes.  Only one allocation of bonus votes will be made per entry, per challenge. 
Challenge #1 – Vote for Me!
20.The Challenge Period for Challenge #1 is from 3 August 2010 9:00am (AEST) – 10 August 2010 11:59pm (AEST).  An entrant may participate in Challenge #1 by:
a.printing the VOTE FOR ME card, available for download from the Website;
b.taking the VOTE FOR ME card into a Miss Shop department at a Myer store;
c.taking a digital photo (or video) of themselves holding the VOTE FOR ME card in the Miss Shop department;
d.uploading the “Vote for Me” photo to their registered entry via the Website.
21.Entrants who complete Challenge #1 during the designated Challenge Period, and whose  “Vote for Me” photo is accepted by the Promoter for display on the Website, will receive 25 bonus votes to the tally of their votes.  Other than the bonus votes, there is no prize component for Challenge #1. 
Challenge #2 – Happy Birthday Miss Shop!
22.The Challenge Period for Challenge #2 is from 11 August 2010 9:00am (AEST) – 18 August 2010, 23:59pm (AEST).  An entrant may participate in Challenge #2 by:
a.visiting a Miss Shop department at a Myer store;
b.selecting up to three (3) ultimate party pieces (which could be clothing or accessories) from the Miss Shop range, to wear to a birthday party;
c.taking a digital photo of each of the selected items (or one photo of all items together); 
d.uploading the ultimate party pieces photo/s to their registered entry via the Website;
e.describing, in 25 words or less, why the items selected are perfect to wear to a birthday party, in their registered entry via the Website.
23.Entrants who complete Challenge #2 during the designated Challenge Period, and whose Happy Birthday photo is accepted by the Promoter for display on the Website, will:
a.receive 100 bonus votes to the tally of their votes; and
b.will be considered for the Challenge #2 Prize (details below).  The Editor of Shop Til You Drop magazine will conduct the judging of entries for Challenge #2 on 19 August 2010, at the magazine’s offices in Sydney.  Entries will be judged on creative merit, taking into account the items selected.  Subject to paragraph 25, the most creative Challenge #2 entry will be awarded the Challenge #2 Prize. The winner of Challenge #2 will be notified on 19 August 2010 via telephone and email, and announced on the Website on 25 August 2010.
PRIZE POOL
Challenge #2 Prize
24.The winner of Challenge #2 will receive the opportunity to participate in 5 days of work experience with Shop Til You Drop magazine published by ACP Magazines Ltd (ABN 18 053 273 546) (STYD) in Sydney at 54-58 Park St, Sydney, NSW 2001. 
25.In order to be confirmed as the winner of Challenge #2, an entrant must by 24 August 2010 (or such other date agreed with the Promoter):
a.enter into an agreement with STYD in relation to participation in the work experience on terms specified by STYD; and
b.enter into an agreement with the Promoter on terms specified by the Promoter, which will include:   
i.requirements not to sell or otherwise provide their story and/or photographs to any media or organisation other than the Promoter without the Promoter’s express prior written consent;
ii.requirements to participate in, and co-operate with the Promoter in relation to, such editorial and promotional activities reasonably required by the Promoter relating to the Competition, including but not limited to being interviewed and photographed for the purpose of promoting the Competition (including any outcome) and promoting any products manufactured, distributed and/or supplied by the Promoter;
iii.a photo/image release covering the use of all materials generated during the winner's participation in editorial and promotional activities; and
iv.a general release and indemnity.
Entrants who are not able to comply with this paragraph will be disqualified from eligibility as the winner of Challenge #2.
26.If the winner of Challenge #2 does not reside in Sydney at the agreed time of the work experience, the winner will also receive one return economy flight from the Australian capital city airport which is nearest to the winner’s usual place of residence, plus transfers to and from the airport in Sydney, plus four (4) nights accommodation in Sydney.
27.The Challenge #2 Prize is valued at up to $1,500.
28.The work experience must be taken in a period constituting 5 consecutive days before 31 December 2010, at a time agreed between the Challenge #2 Prize winner and the relevant representative of STYD.
29.The work experience, travel and accommodation components of the Challenge #2 Prize is provided by STYD and not the Promoter. 
MAJOR PRIZE
30.Subject to paragraph 31, the winning entry in relation to the Major Prize will be the entry with the greatest number of valid votes as at the close of the Promotional Period, and as determined by the Promoter on 21 August 2010. The winner of the Major Prize will be notified on 23 August 2010 via telephone and email, and announced on the Website on 26 August 2010.
31.In order to be confirmed as the winner of the Major Prize, an entrant must by 25 August 2010 (or such other date agreed with the Promoter):
a.enter into an agreement with STYD in relation to participation in the photo shoot on terms specified by STYD;
b.enter into an agreement with the Promoter on terms specified by the Promoter, which will include:   
i.requirements not to sell or otherwise provide their story and/or photographs to any media or organisation other than the Promoter without the Promoter’s express prior written consent;
ii.requirements to participate in, and co-operate with the Promoter in relation to, such editorial and promotional activities reasonably required by the Promoter relating to the Competition, including but not limited to being interviewed and photographed for the purpose of promoting the Competition (including any outcome) and promoting any products manufactured, distributed and/or supplied by the Promoter;
iii.a photo/image release covering the use of all materials generated during the winner's participation in editorial and promotional activities; and
iv.a general release and indemnity.
Entrants who are not able to comply with this paragraph will be disqualified from eligibility as the winner of the Major Prize.
32.The winner of the Major Prize will receive:
a.$25,000.00 in Myer Gift Cards.  See below for the key terms and conditions applying to Myer Gift Cards; 
b.a Flip Mino II HD Camcorder valued at $299;
c.the opportunity to participate as a fashion assistant at a photo shoot with Shop Til You Drop magazine in Sydney on a day to be agreed by the winner and STYD; and
d.two (2) tickets to the Rosemount Sydney Fashion Festival Myer Miss Shop Show on 28 August 2010.
33.If the winner of the Major Prize does not reside in Sydney as at 28 August 2010, the winner will also receive return economy flights for two (2) from the Australian capital city airport which is nearest to the winner’s usual place of residence, plus one (1) night twin share accommodation in Sydney, which will be paid for and arranged by the Promoter.
34.If the winner of the Major Prize does not reside in Sydney on the agreed day for the photo shoot with STYD, the winner will also receive return economy flights for one (1) from the Australian capital city airport which is nearest to the winner’s usual place of residence, plus one (1) night’s accommodation in Sydney, which will be paid for and arranged by STYD.
35.The Major Prize is valued at up to $27,200.00 (incl GST).
36.The total prize pool is valued at up to $31,400.00 (incl GST).
GENERAL PRIZE CONDITIONS
37.Prizes must be taken as offered and cannot be varied unless authorised by the Promoter. Prizes are not transferable to another person or exchangeable.  Prizes cannot be redeemed for cash, other goods and services or sold to a third party including online auctions and private sales.  Unused portions of prizes will be forfeited and no compensation will be paid in lieu of that element of the prize.
38.The Promoter and its associated agencies, and companies associated with this Competition take no responsibility for prizes damaged or lost in transit.
39.The prize value includes GST and is in Australian dollars and is correct at the time of publishing these Terms and Conditions.  The Promoter accepts no responsibility for any variation in prize value.
40.If a prize or part of a prize is unavailable, for whatever reason, despite the Promoter’s reasonable endeavours to procure the prize, the Promoter reserves the right to substitute all or part of the prize for a prize of equal value, subject to any written directions from any relevant regulatory, judicial or government authority.
41.The Promoter reserves the right to request winners to provide proof of age and identity prior to awarding any prize.  Identification considered suitable for verification is at the sole discretion of the Promoter.
42.The Promoter’s responsibility for the provision of any prize is limited to the prize described in these Terms and Conditions. 
43.Winners (and any companions) accept and/or participate in components of the prizes at their own risk. To the maximum extent permitted by law, the Promoter accepts no liability for any failure of the Promoter’s suppliers, agents or contractors to supply the prizes as stated or for any loss or liability (including but not limited to indirect or consequential loss) that may be suffered or incurred or personal injury which may be suffered or sustained (whether or not arising from any person’s negligence) by any person as a result of a winner (or their companion) accepting, using or participating in a prize. 
44.Each entrant agrees to accept responsibility for any loss or liability (including but not limited to indirect or consequential loss) that may be suffered or incurred or personal injury which may be suffered or sustained by any person howsoever caused whether as a direct or indirect consequence of entering the Competition or accepting a prize. 
45.The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with any prizes except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).  The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this Competition if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures. 
GIFT CARDS KEY CONDITIONS OF USE
46.Gift Cards are treated like cash. Lost or stolen cards will not be replaced or refunded. Gift Cards cannot be used for the payment of credit or store accounts. Gift Cards are not redeemable for cash and cannot be exchanged. Gift Cards expire two years from the issue date. Any unused amount after the expiry date of the Gift Card will not be refunded or credited.  Gift Cards are not reloadable.

TRAVEL COMPONENTS OF PRIZES
48.Any air travel referred to in paragraph 33 relating to the attendance at the Rosemont Sydney Fashion Festival component of the Major Prize will be paid for by the Promoter, and booked through Myer Travel Pty Ltd (ABN 33 134 032 590) (Victorian Travel Agent Licence No. 32872).  The winner of the Major Prize must be able to travel on 28 and 29 August 2010 in order to attend the Rosemount Sydney Fashion Festival Myer Miss Shop Show.
49.Any air travel component associated with the Challenge #2 Prize work experience referred to in paragraph 26 or the photo shoot component of the Major Prize referred to in paragraph 34 will be paid for and arranged by STYD (or their delegate).  Any travel associated with the Challenge #2 Prize work experience or the STYD photo shoot component of the Major Prize must be taken and completed by 31 December 2010.
50.No extensions will be made to these travel periods.  Failure to travel during the specified travel periods will result in the relevant travel component of that prize being forfeited and no compensation or refunds will be given.  Travel during peak season is excluded (including school or state specific public holidays, major sporting events or travel blackout periods).
51.Where a travel component is awarded as a part of a prize and allows for a travelling companion, the winner and their travelling companion must travel together on all prize flights, and stay at the same properties in each destination.
52.Flights and accommodation are subject to availability and will be coordinated in consultation with the winner.  Flight schedules are subject to change without notice.  The Promoter and Myer Travel Pty Ltd make no representation as to the safety, conditions or other issues that may exist at any destination.  The winner (and any travel companion) is strongly encouraged to seek advice in relation to any safety concerns they may have in relation to travel from appropriate authorities, including government websites. 
53.Unless expressly stated in these Terms and Conditions all other expenses become the responsibility of the winner (and their companion) including:
a.spending money, meals, transfers (unless otherwise stated) including travel to and from departure point to airport, travel insurance), energy surcharges, gratuities, and all other ancillary costs.
b.incidentals charged to the winner’s and travel companion’s accommodation, such as meals, mini bar, laundry room services, telephone calls etc.
54. A credit card imprint or cash deposit may be required from the winner (or companion) at check-in to the relevant accommodation hotel.
CONSENTS AND PERMISSIONS
55.Entrants are responsible for obtaining all necessary licences, consents and approvals in relation to their Entry Materials (including in relation to the use of the image or likeness of any person who appears in a photo or video included in the Entry Materials) to enable entrants to enter their Entry Materials in this Competition and to permit the Promoter to deal with their Entry Materials in the manner outlined in these Terms and Conditions.
56. By entering this Competition all entrants:
a.consent to the Promoter using and publishing (and authorising others to use and publish) their name, character, likeness, image, voice or anything else that identifies them for the purposes of any promotion or matter incidental to the Competition, including future similar Miss Shop competitions, and at any time during or after the Promotional Period and via any means (including without limitation in national print media, on the Promoter's website and in other promotional material);
b.if any of their photos contain the image of a friend, warrant that they have obtained the consent of their friend to the Promoter using and publishing (and authorising others to use and publish) their friend's name, character, likeness, image, voice or anything else that identifies their friend for the purposes of any promotion or matter incidental to the Competition, including future similar Miss Shop competitions, at any time during or after the Promotional Period and via any means (including without limitation in national print media, on the Promoter's website and in other promotional material);
c.assign (and, if necessary, will in the future assign) all intellectual property rights (including copyright) in their Entry Materials in relation to all media (including, without limitation, the internet) and whether in existence now or created in the future; 
d.unconditionally and irrevocably:
i.consent to any act or omission that would otherwise infringe any of their moral rights in the Entry Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given; 
ii.waive all moral rights that arise outside Australia; and
iii.agree not to institute, maintain or support any claim or proceeding for infringement of their moral rights in the Entry Materials;
e.warrant to the Promoter that their entry is the original independent creation of the entrant and free from any claims, including copyright or trade mark claims, by other persons.
57.The Promoter accepts no responsibility or liability where an entrant’s photos, images or other Entry Materials are downloaded from the Website by any persons, and for any matters after such download.
PRIVACY AND INFORMATION
58.The personal information provided by entrants when entering or participating in this Competition (including in their Entry Materials) will be used by the Promoter to conduct the Competition, to contact entrants if they are winners, to conduct research and marketing activities (including to inform entrants about special offers from the Promoter such as the MYER one Program or new products or promotions and to become part of databases maintained by the Promoter or associated entities), unless the entrant opt-outed of participating in such activities in the section provided on the entry form, and otherwise in accordance with the Promoter’s Privacy Policy.  Entrants can advise the Promoter at any time if they no longer wish to participate in any such research and marketing activities.  Otherwise, their consent will remain current until specifically withdrawn.  The Promoter may disclose entrants' personal information for the above purposes to other companies associated with this Competition, related bodies corporate of the Promoter, the Promoter's information technology providers and database service providers and other entities which provide research and marketing services to the Promoter.
59.If entrants do not provide the personal information requested by the Promoter, they may not participate in the Competition (except where the provision of that information is optional). Winners’ names will be published and retained as required under relevant legislation. An entrant may request to access, update or correct any information, or to have their details removed from the Promoter’s database/s, at any time and such requests should be directed to the Promoter at its address set out above.  The Promoter’s Privacy Policy can be viewed at http://www.myer.com.au.
GENERAL TERMS AND CONDITIONS
60.It is a condition of accepting a prize that a winner (and/or their companion) comply with all the terms and conditions of use of a prize and prize supplier's requirements. 
61.The Promoter reserves the right in its sole discretion to verify the validity of entries and to disqualify any entrant or voter who tampers with the entry or voting process, or who submits an entry which is not in accordance with these Terms and Conditions, or who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition.  The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
62.The Promoter accepts no responsibility for any tax implications that may arise from acceptance of the Prize winnings.  Entrants may wish to seek their own independent financial advice prior to entering the Competition. 
63.Entries will be deemed to be accepted at the time of receipt by the Promoter’s delegated website representative.  No responsibility will be taken for unsuitable, lost, deleted, late or misdirected entries.  The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.  Each entry will be subject to a moderation process before being visible on the Website.  Entries are deemed to be received at the time they are received by the Promoter and not the time they are published on the Website.
64.The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period.  The Promoter is not liable for any losses if, for any reason, this Competition is not capable of being executed as planned, including in relation to any technical issues or incompatibilities which prevent an entry from being completed or a vote being received or properly allocated, and including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, malfunction of any telephone, computer, internet network or line or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness or integrity or proper conduct of this Competition. 
65.In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the activity and recommence it from the start on the same conditions.
66.The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained (whether or not arising from any person’s negligence) by any person arising out of or in connection with this Competition or the promotion of this Competition, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 
MISS MISS SHOP COMPETITION
Voting Terms and Conditions
1.Voting for the Miss Miss Shop Competition (Competition) is open to Australians of all ages who have access to the internet and complete and submit this Voting Form.
2.A voter can vote for more than one entry, but a voter may only vote for a particular entry once.
3.Voters may post comments in relation to entries.  Voters must not post inappropriate, distasteful, offensive or defamatory comments.  Myer Pty Ltd (Myer) reserves the right not to display or to remove or modify any comments in its sole discretion.
4.Entrants cannot vote for their own entry.  Entrants found to have voted for themselves will have their entry disqualified and all votes for that entry will be voided.
5.Privacy Statement:  The personal information provided on this Voting Form will be used by Myer to conduct the Competition and to conduct research and marketing activities (including to inform voters about special offers from Myer such as the MYER one Program or new products or promotions and to become part of databases maintained by Myer or associated entities), unless the voter opt-outed of participating in such activities in the section provided on the voting form, and otherwise in accordance with Myer's Privacy Policy.  Voters can advise Myer at any time if they no longer wish to participate in any such research and marketing activities.  Otherwise, their consent will remain current until specifically withdrawn.  Myer may disclose voters' personal information for the above purposes to other companies associated with this Competition, related bodies corporate of Myer, Myer's information technology providers and database service providers and other entities which provide research and marketing services to Myer.
6.If voters do not provide the personal information requested by Myer, they may not vote in the Competition (except where the provision of that information is optional).  A voter may request to access, update or correct any information, or to have their details removed from Myer's database/s, at any time and such requests should be directed to Myer at 800 Collins Street, Docklands, Victoria 3008.  Myer's Privacy Policy can be viewed at http://www.myer.com.au.
7.Myer reserves the right in its sole discretion to disqualify any voter who tampers with the voting process engages in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition.
