Terms & Conditions

1. ACCEPTANCE OF TERMS
1.1 Information on how to enter the competition and prizes form part of these Terms and Conditions

1.2 By entering the competition, you are deemed to accept these Terms and Conditions.

2. ELIGIBILITY
2.1 Entry is open to all Australian and New Zealand residents aged 18 years and over.

2.2 EziBuy Group employees, and employees of any company associated with the competition, together with their immediate family members, are ineligible to enter.

3 ENTRY
3.1 The competition commences on 00:01 (AEST) on August 1 2010 and concludes at 23:59 (AEST) on August 31 2010 (“Monthly Promotion Period”).

3.2 To enter the monthly prize draw, a current EziBuy Customer will be required to:
a) visit http://www.ezibuy.co.nz/share or www.ezibuy.com.au/share, then
b) ‘Tell a Friend’ about EziBuy by completing the online referral form.
OR
a) Pass on a customer registration form to non-EziBuy customer, recording their customer number on this form.
b) The friend must register to become an EziBuy customer by completing the form and freeposting back to EziBuy.

3.3. Current EziBuy Customers: For every unique friend a Current EziBuy Customer refers during the Monthly Promotion Period, they will receive one (1) entry into that month’s prize draw for the chance to win a $500 Gift Card

3.4 Referred Friends: For all Referred Friends who sign up to the EziBuy database during the Monthly Promotion Period, they will receive a $20 discount on their first purchase of $75 or more.

4 PRIZES AND WINNING
4.1 The monthly prize draw will take place at 10:00 (AEST) on September 02, 2010 at EziBuy, First Floor 1G Marine Parade Abbotsford 3067 Victoria Australia.

4.2 The first entry drawn from the database of Current EziBuy Customers will win a Major Prize of a $500 Gift Card. Total prize pool is valued at $500 AUD / NZD.

4.3 The Gift Card is redeemable for merchandise sold by either EziBuy or subsidiary, Sara Apparel Limited. It is not returnable or redeemable for cash and cannot be used towards the purchase of another Gift Card. A Gift Card expires 12 months from the date of issue. Any unused balance remaining on the Gift Card at expiry will not be refunded or credited. A Gift Card cannot be replaced and neither EziBuy nor Sara shall be responsible for any Gift Card that may be lost, stolen or damaged.

4.4 The winners will be notified by phone and mail within two (2) days from the prize draw, using the details provided upon entry.

4.5 Prizes are not transferable, nor redeemable for cash. The winner of a prize is responsible for any tax or other costs arising in relation to, or associated with, the prize.

4.6 The judge’s decision is final and no correspondence will be entered into.

4.7 We may refuse to award a prize to any person who has, in our view, acted in a fraudulent manner; or breached these Terms.

5 PUBLICITY
5.1 Each winner agrees to the use of their name and photograph/s for publicity purposes, without compensation, and agrees that we will own copyright in any such photograph/s and in all material incorporating the photograph/s.

6 GENERAL
6.1 If for any reason this promotion is not capable of running as planned, we reserve the right, in our sole discretion and at any time, to replace or amend these Terms or to modify, suspend, terminate or cancel the competition, subject to written directions from State Regulatory bodies.

6.2 You authorise us to collect and hold personal information, to be used to conduct the competition and for future promotional purposes by us and our promotional partners. You understand that you have a right of access to, and may request correction of, personal information held by us about you, at any time. Failure to provide the personal information requested on the entry form will result in the entry being invalid.

6.3 The information submitted by existing EziBuy customers in this promotion will be used for the purposes of drawing winners only. If you wish to update any of the details attached to your EziBuy customer account, please login to your account at our website or call 0508 500 500 (from within NZ) or 1800 148 148 (from within Australia).

6.4 Should a prize remain unclaimed after 3 months of the original prize draw, an unclaimed prize draw will take place at 10:00 (AEST) on December 6 2010 at the same time and place as the original prize draw. Any second chance winners will be notified by phone and mail within two (2) days from the prize draw, using the details provided upon entry.

7 DEFINED TERMS AND INTERPRETATION
7.1 In these Terms, the following words have the following special meanings:
a. “Terms” means these competition terms and conditions (as amended from time to time);
b. “We”, “our”, “us” means EziBuy Limited; and
c. “You” means a person entering the competition.
d. “Current EziBuy customer” means someone that has an EziBuy customer number and has also purchased from EziBuy in the last 24 months.
e. “Referred Friends” means someone that has not registered for an EziBuy customer number or has an inactive customer account whereby they have not purchased against their customer number in the last 24 months.

7.2 For convenience, these Terms have been grouped under different headings, but the headings do not affect the meaning of these Terms.

7.3 These Terms will be interpreted in accordance with, and governed by, the laws of New Zealand and Australia.
