TERMS & CONDITIONS OF ENTRY
THE CIRCLE – THE WIGGLES AT DREAMWORLD
1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
2. Entry is open to all residents of Australia. However, employees and their immediate families of Network TEN and their associated agencies and companies are not eligible to enter.
3. The competition commences on Monday 30th August 2010 at 00:01 (AEST) and concludes on Friday 3rd September at 15:00 (AEST).
4. To enter, participants must tell us in 25 words or less tell us less “If you were a Wiggle, what colour would you be and why” at www.ten.com.au/the-circle where they will be directed to log in and register their details including (but not limited to) name, address, phone number, e-mail address, age, gender.
5. Incomprehensible and incomplete entries will be deemed invalid.
6. Entrants may only enter once per day.
7. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
8. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
9. Entries must be received by 15:00 (AEST) on Friday, 3rd September. The time of entry will in each case be the time entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
10. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
11. 2 x Major winners will receive a family holiday for 2 adults and 2 children (0-13yrs) to the Gold Coast to see The Wiggles at Dreamworld on Saturday 11th September 2010. Prize includes return economy airfares from the winner’s nearest major airport to the Gold Coast (max value $4000), 5 nights’ accommodation in a Surfers Paradise family holiday resort (minimum 3 star) (max value $1000, 5 days car hire (max value $750), 5 days unlimited entry to Dreamworld and WhiteWater World (value $345) and the chance to meet The Wiggles. Each major prize is valued at $11,095 each ($22,190 total major prizes)
10 x Runner ups will each receive The Wiggles “Let’s Eat” DVD ($20 RRP each) and a family pass to Dreamworld and WhiteWater World (2 adults and 2 children 3-13yrs inclusive - valid 12 months) ($259 RRP per pass) Total runner up prizes is valued at $279 each.
12. Total prize pool valued at up to $24,980
13. Prizes cannot be transferred, exchanged or redeemed for cash
14. Selection of airline, departure and arrival destination, flight times and accommodation venue is at Ardent Leisure Limited’s discretion upon time of booking.
15. Travel must be taken to co-incide with The Wiggles appearance on 11th September 2010. Dates of travel are subject to availability. Validity date of this prize cannot be extended.
16. Flight may only be taken from the winners nearest Australian major airport to the Gold Coast or Brisbane.
17. The prize winner will be required to provide one week notice of intent to travel.
18. If the winner resides within a 3-hour drive or 240km from Dreamworld, airfares and car rental are not included in the prize.
19. Once booked, any changes made to the booking may incur a cancellation fee of amendment fee, at the cost of the winner. The winner of the prize (and their travel companions) will not accrue any frequent flyer points from taking the prize.
20. The car hire vehicle will be available upon arrival at Queensland, for pick from the airport and drop off on departure. It is a condition that the hirer be 25 years and over, and hold a current Australian or New Zealand license. Provisional licences and learners permits will not be accepted. The Promoter accepts no responsibility for damage, mistreatment or ill manor to the hire car caused by the hirer. The Promoter will not be liable for any additional expenses incurred by the hirer through mistreatment, illegal behaviours, or a violation of the car hire's terms and conditions of use. The car hire only covers the day rate hire of the car, all insurance, petrol and damage costs will be the responsibility of the prize-winner. Prize winner will need to present a current credit card for security purposes upon collection of the vehicle.
21. All components of the prize must be taken together. Travel Insurance is not included. Travel Prize does not include meals, spending money or transport to and from departure and arrival points. All other ancillary and travel costs are the winner’s responsibility. All additional costs incurred whereby the prize winner wishes to make variations to the travel are the winner’s responsibility and must be booked separately by the winner. All travel variations are subject to approval by Ardent Leisure Limited upon booking. Travel variations include, but are not limited to extension of travel duration, travellers outside of the age restriction and additional travellers.
22. Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
23. If the winner is under the age of 18 years the prize may be awarded, at the absolute discretion of the promoter, to their parent or legal guardian. In the event that the winner is under 18 years of age, the winner must be accompanied by an adult aged 21 years and over.
24. Any change in the value of the prize between publishing date and the date prize is claimed is not the responsibility of the promoter. Value indicated is a maximum value permitted for prize fulfilment. Where actual costs do not reach this limit, the
difference will not be reimbursed, transferred or allowed to be taken in additional prizing.
25. The winner and their companion are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
26. The winner and travel companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Brisbane, Adelaide, Melbourne or Perth). If the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be not be included in the prize package.
27. Government taxes are an additional cost to the winners and their travelling companions and are required prior to ticketing.
28. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
29. By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in the prize should they be chosen as major winner. The winner releases the promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the car experience or any other aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize.
30. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
31. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
32. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
33. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
34. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
35. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Network TEN or
the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
36. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
37. Prize values are based upon the recommended retail prices at the time of printing. The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
38. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
39. Each valid entrant who has entered the competition over the duration of the promotional period will be entered into the major prize pool. The judging for the major winner will take place at the premise of the Promoter on Friday, 3rd September at 15:30 (AEST). All judging will be based on the most creative/funniest/original answer/s as determined by the Promoter. Judges/Promoters decision is final and no correspondence will be entered into.
40. The winners will be notified of their prize in writing by a phone call.
41. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry.
42. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
43. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
44. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
45. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
46. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
47. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
48. The Promoter reserves the right in its sole discretion to disqualify any individual who
the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
49. Network TEN and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
50. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
51. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
