"WIN A MAKEOVER BY TRINNY & SUSANNAH" PROMOTION
TERMS AND CONDITIONS

    * Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
    * Entry is only open to Australian residents aged 18 years or over.
    * Employees of the following (and their immediate family) are not eligible to enter this promotion: the Promoter, participating Westfield retailers and the agencies associated with this promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    * Promotion commences 9am AEST on Monday 23 August 2010 and closes 5pm AEST on Friday 10 September 2010 (“Promotional Period”).
    * To enter, you must, during the Promotional Period, visit www.westfield.com.au, follow the prompts to the competition entry page, fill in the requested details including your name, address, age, email and contact telephone numbers answer all of the questions provided including describing why you should win in 25 words or less and electing the participating Westfield Centre you are able to attend should you win, and submit the fully completed entry form. Entrants must upload with their entry a recent, clear, colour photograph of themselves and entrants will also have the opportunity to upload an optional short video about themselves.
    * As a condition of submitting an entry, entrants agree that they will be signed up to the email newsletter of the participating Westfield Centre they nominate in their entry (if they are not already signed up).
    * Only entries received via www.westfield.com.au will be accepted and only one entry per person is permitted. Incomplete or incomprehensible entries will not be included in the judging.
    * The Promoter reserves the right, at any time, to verify the validity of entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant that submits an entry that is not in accordance with these Terms and Conditions or tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    * All entries (which shall include the photographs and any optional videos submitted) become the property of the Promoter. As a condition of entering into this promotion, each entrant agrees to, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display the entry for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants further acknowledge and agree that elements of their entry may be displayed on the Promoter’s website during the Promotional Period and for a period of up to six (6) months afterwards. Entrants agree not to assert any moral rights in relation to such use by the Promoter. Entrants warrant that they have the full authority to grant these rights.
    * Each entrant warrants to the Promoter that (a) each photograph and any optional video submitted is an original work which does not infringe the rights of any third party; (b) any information submitted as part of their entry is true; and (c) the photograph (and optional video) and entry submitted is of the entrant. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranties set out in this condition. The Promoter is entitled to use any of the entrants’ entries for any purposes at its discretion, including using the photographs (or videos) for future promotional, marketing and publicity purposes, without further remuneration.
    * Entries will be divided into the following nine (9) groups based on the participating Westfield Centre nominated at the time of entry: Eastgardens (NSW), Burwood (NSW), Penrith (NSW), Hornsby (NSW), Southland (VIC), Carindale (QLD), Marion (SA), Whitford City (WA) and Carousel (WA).
    * This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on creative merit and originality, as well as the compulsory photograph and any optional video submitted. The judging will take place at 100 William Street, Sydney NSW 2011 from Tuesday 14 September to Friday 17 September 2010.
    * The best three (3) valid entries in each of the nine (9) groups will each win a makeover and prize pack valued at up to $2,000, consisting of the following:
      (a) 1 x voucher for one pedicure and one manicure from a retailer at the winner’s nominated Westfield Centre;
      (b) 1 x voucher for a one hour massage and one hour facial from a retailer at the winner’s nominated Westfield Centre;
      (c) 1 x voucher for one hair cut, hair colour and blow dry from a retailer at the winner’s nominated Westfield Centre;
      (d) 1 x $500 Westfield Gift Card; and
      (e) 1 x on-stage makeover with Trinny and Susannah at the winner’s nominated Westfield Centre.
    * There will be a total of 27 prizes awarded in this promotion. The judges reserve the right to select additional reserve entries which they determine to be potential runner up winners, and record them in order of merit for use in case of an invalid entry or ineligible entrant. The Promoter’s decision is final and no correspondence will be entered into.
    * Winning entrants (“Winners”) will be notified by telephone and email on Friday 17 September or Monday 20 September 2010.
    * Winners will be notified of the day of their makeover event, which they must attend to participate in their on-stage makeover, as well as receive all other elements of the prize pack. Winners must be available to attend the event on the date specified, which will be a date in late September / October 2010 to be determined by the Promoter in its absolute discretion and subject to Trinny’s and Susannah’s availability. If a Winner is not available to attend on the date specified they will be deemed invalid and a new Winner will be selected from the reserve entries.
    * Winners (and any companions) are responsible for all costs associated with attending their makeover event, including but not limited to travel to and from the participating Westfield Centre nominated in their entry form.
    * Any ancillary costs associated with redeeming any voucher or gift card forming part of the prize are not included. Any unused balance of any voucher or gift card will not be awarded as cash. Redemption of any voucher or gift card is subject to any terms and conditions of the issuer including those specified on the voucher or gift card.
    * If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
    * Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
    * By accepting a prize, each Winner acknowledges and agrees that:
      (a) they must not act in an illegal or inappropriate manner during the course of the on-stage makeover event;
      (b) they may be contacted by the Promoter via telephone and/or email during or after the promotion;
      (c) during the course of the on-stage makeover event they: (i) will follow all reasonable directions of the Promoter; (ii) will not be involved in any illegal or scandalous behaviour which could bring the Promoter or its products into disrepute; and (iii) understand that they may be interviewed, photographed, filmed and recorded during the entire duration of the on-stage makeover event.
      (d) that the Promoter may use the content recorded during the on-stage makeover event ("Materials") for any purpose, including for the Promoter's future promotional and marketing purposes without further reference or compensation to them, including but not limited to, displaying the Materials in any form of media including on digital advertising, WAP sites, outdoor advertising, using it in PR, radio, TV, on Facebook, My Space, and YouTube;
      (e) the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
      (f) where they have any intellectual property rights in the Materials, they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
      (g) they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
      (h) they waive all Moral Rights in the Materials that arise outside Australia;
      (i) they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials; and
      (j) they agree to participate in any further publicity activities for the purposes of promoting this promotion (including any outcome) as determined by the Promoter in its absolute discretion, including, but not limited to, appearing as talent in a “Style TV” episode to be displayed on westfield.com.au and other digital media as determined by the Promoter.
    * Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
    * Internet Clause: If, for any reason, this promotion is not capable of running as planned, including as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupts or affects the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or another person's computer related to or resulting from participation or downloading any materials in this competition. Any attempt to deliberately damage any website, or to otherwise undermine the legitimate operation of this promotion, may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
    * Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the appearance of either Trinny and/or Susannah is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a Winner or entrant; or (g) use of, or participation in, a prize.
    * As a condition of accepting a prize, Winners must sign any legal documentation as and in the form required by the Promoter in its absolute discretion including but not limited to a legal release and indemnity form.
    * Privacy: In order to conduct this promotion, the Promoter needs to collect personal information about each entrant and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored at the office of the Promoter. A request to access, update or correct any information should be directed to that office. Upon the entrant’s request, all information provided will be removed from our active database.
