Information regarding how to enter, how to claim and details of prizes form part of these conditions of entry. Entry into the promotion is deemed to be acceptance of these conditions of entry.
Entry to the promotion is only open to residents of Australia aged 18 years or over with a valid email address who fulfil the entry requirements. Directors, management, and employees of the Promoter, its related companies and agencies, the immediate families of the above listed persons, and directors, management and employees of companies, businesses or individuals associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
How to Enter
To enter the promotion, participants must register for more information about Victaulic and BlueScope Pipeline Supplies with participating BlueScope Pipeline Supplies stores, during the promotional period and then either:
1. Fully complete the official entry form provided and fax back to (03) 8540 8176; or
2. Visit
www.aperfectfit.com.au to fully complete and submit the online entry form.
Promotional Period
The promotion commences 00:00:01am (AESDT) on 18/10/2010. Entries close:
1. for fax at 5pm (AESDT) on 17/12/2010; or
2. for online registrations at 11:59:59pm (AESDT) on 17/12/2010.
Details and values of all prizes
There is one (1) prize to be won. The first valid entry randomly drawn from all valid entries received will win a Callaway Diablo Golf Set, with a recommended retail price of $2400 (including GST).
The prize includes: Callaway Diablo Driver, Callaway Diablo F’way x 2, Callaway Rescue 4 x 1, Callaway Diablo Iron set, Callaway Forrester Bag, Odyssey Putter, 2 dozen Callaway Diablo Balls, 1 x Hat, 1 x Towel, and a Callaway overnight Bag. Insurance and all other ancillary costs not listed are the responsibility of the winner. The winner will be notified in writing via mail 2 days after the draw. The Promoter will arrange delivery of the prize to the winners address.
The total prize pool is valued at up to $2,400 (including GST).
If for any reason the prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value, subject to the written approval of the gaming authorities in each State/Territory, where relevant.
How the Winner Will Be Determined and Notified
The draw will take place at BlueScope Distribution Pty Ltd, 88 Ricketts Rd, Mt Waverley, Vic 3149 on 17/1/11 at 3pm AESDT. The winner will be notified in writing and given details on how to claim their prize.
The name and postcode of the winner will be published in The Australian newspaper on 31/1/11. The name, suburb and State/Territory of residence of the winner will also be published on
www.aperfectfit.com.au in the week following the draw.
Entry into this competition shall be deemed to be approval to use the winner’s name and photograph for publicity purposes in any media for an unlimited period without remuneration for the purpose of promotion this competition (including any outcome), and promotion any products, manufactured, distributed and/or supplied by the Promoter. The Promoter may at its discretion refuse to award any prize to any entrant who fails to comply with these conditions of entry. If entrants do not wish for their details to be published, they must contact the Promoter at the address set out below.
General Conditions
1. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
2. The Promoter’s decision is final and no correspondence will be entered into.
3. The Promoter reserves the right, at any time, to validate any one or all of the entries or entrants (including an entrant’s identity, age and place of residence) in the promotion and may disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. The Promoter reserves the right to request winners to provide proof of identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. The prize is not transferable or exchangeable and cannot be taken as cash. The value of the prize is accurate as at September 2010. The Promoter accepts no responsibility for any variation in prize value after that date.
5. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or claims of correspondence, whether due to error, omission, alteration, deletion, theft, destruction, transmission interruption, communication failure or otherwise. The Promoter is not responsible for any problems or technical malfunction of any telephone, network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to entrant’s or referral’s or any other person’s computer related to or resulting from participation in or down-loading any material in this promotion.
6. Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem the prize by the time stipulated by the Promoter, then the prize will be forfeited.
7. A draw for any unclaimed prizes may take place on April 17 2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner’s name will be published in The Australian on 30/04/11.
8. If for any reason, any aspect of this promotion is not capable of running as planned, including by reason of tampering, unauthorized intervention, fraud or technical failures that are beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity of proper conduct of the promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, or invalidate any affected entries, subject to any directions from a relevant authority.
9. Any cost associated with accessing the promotional website or faxing an entry form is the entrant’s responsibility and is dependent on the Internet or telecommunication service provider used.
10. The Promoter reserves the right in its discretion to disqualify all entries from any person and prohibit any person from participating in this promotion who tampers with or benefits from any tampering with the entry process or the operation of the promotion, acts in violation of these conditions of entry or acts with the intent to annoy, abuse, threaten or harass any other person.
11. Tax implications may arise from the receipt or use of a prize. Liability for any tax arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the entrant. Entrants should seek independent financial advice in this regard.
12. The Promoter or associated agencies or companies (including their respective officers, employees and agents) shall not be liable for any losses, claims, damages, injuries, costs and expenses suffered sustained or incurred (including without limitation, direct or consequential loss), as a result of, arising out of or in any way connected with the promotion and/or its prizes howsoever arising, except any liability that cannot be excluded by law (in which case, that liability is limited to the minimum allowable by law).
13. Without limiting the previous paragraph, except for any liability that cannot be excluded by law, the Promoter and its associated agencies and companies will not be liable for (a) any loss or damage in transit of the prize; (b) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (c) any theft, unauthorised access or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in prize value to that stated in these conditions of entry; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize.
14. All entries will be the property of the Promoter.
