These Terms and Conditions of Entry relate to Spinners by Shane Warne's Win a Bowling Session with Warnie for You and a Mate Competition Game of Skill Promotion (the âPromotionâ). The Promoter is lime door brands Pty Ltd of 431 Swan Street, Richmond, Victoria Australia 3205; ACN: 145 285 356 (the âPromoterâ).
By entering the Promotion, entrants shall be deemed to agree to these Terms and Conditions of Entry.
Who Can Enter
Entry is open to all permanent Australian residents of 18 years of age or older. The following people and their immediate families are not eligible to enter the Promotion: (i) employees of the Promoter; (ii) employees of the Promoter's franchisees; and (iii) employees of any other agencies or companies associated with this Promotion.
How To Enter
Promotion entries will be accepted from 1 October 2010 at 9.00am (AEST) until 31 December 2010 at 11.59pm (AEST) (the âPromotion Periodâ).
Entries shall be deemed to have been received at the time the Promoter's systems indicate that they have been received, irrespective of the actual time at which they are sent.
Entry is free. Any costs associated with accessing the Promotional website is the entrant's responsibility and is dependent on the internet service provider used.
One entry per person is permitted.
This is a game of skill, chance plays no part in determining the Winner. To enter and be eligible to win, entrants must:

3.enter the Spinners by Shane Warne product code in the Freebies > Competitions tab at SpinnersbyShaneWarne.com from their purchased item in the âProduct Codeâ field
4.provide, in the space indicated on the online Entry Form, an answer to the following question (in 25 words or less); âIf you could name a signature bowling style, what would you name it and why?â (the âPromotional Questionâ). The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who has submitted an entry that is not in accordance with these Terms and Conditions of Entry. Entries including incorrect contact details may be deemed invalid. The Promoter also reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions of entry or any instructions or directions on the Promotional website, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
The Promoter reserves the right to disqualify any entry which in the Promoter's reasonable opinion contains material that is defamatory, offensive, in poor taste, or unlawful in any way or towards any person.
The Winner of the Promotion will be the entrant judged by the Promoter's judges as having submitted the most original and creative response to the Promotional Question.
All judging will take place at the Promoter's premises at 431 Swan Street, Richmond, Victoria Australia 3121 commencing 4 January 2011. The judges' decision is final and no correspondence will be entered into.
The Prize
1.The Winner of the Promotion will win:
a.Lunch with Shane Warne for themselves and their companion
b.A private bowling session in the nets at the MCG with Shane Warne for themselves and their companion
c.Return air flights from their closest capital city for themselves and their companion
d.One nightâs accommodation at Crown Towers, Melbourne, including breakfast, for themselves and their companion
e.Spinners by Shane Warne pack including an autographed cricket bat and ball, and selected garments from the Spinners by Shane Warne range. (the âPrizeâ). All prices include GST. 2.The Prize includes insurance, airport and MCG transfers.
3.The Prize does not include frequent flyer points; spending money; items of a personal nature; any meals or beverages other than the provided breakfast and lunch; in-room charges or any other ancillary costs.
4.For garments supplied for the Spinners by Shane Warne pack, the Promoter will endeavour to supply the winnerâs correct size, subject to availability. 5.Total maximum Prize pool is $6,837.80 plus postage to the winning entrant's nominated address in Australia. The Promoter accepts no responsibility for a change in prize value between now and the time of the prize redemption.
6.Spinners by Shane Warne representatives may accompany the Winner for the duration of their time with Shane Warne.
7.By entering this competition, the Winner agrees to be photographed and filmed with and without Shane Warne. The content captured will be broadcast and promoted as per the Promoterâs requirements. The Winner and their companion relinquish the rights to their images being used for this content. The Winner and their companion understand that any photographs, video footage or other images taken may be shown in a public environment (in Victoria, interstate and/ or overseas). The Winner and their companion understand there is no payment or further consideration paid for their images to be used by Spinners by Shane Warne in all aspects, to the full extent of the law.
8.The lunch meeting will take place on Friday 14 January 2010 from approximately 12.30pm to 1.00pm with the bowling session taking place from approximately 1.00pm to 1.30pm. Photographs with the Winner and their companion with Shane will take place at approximately 1.30pm. An interview with Shane Warne will take place at approximately 1.45pm after which time Shane will reserve the right to depart the meeting. An interview for Spinners TV will take place with the Winner and their companion at approximately 2.00pm, after which time the Winner and their companion will be escorted back to their hotel.
9.Prize must be taken on 14 January 2011 and is subject to booking and flight availability.
10.While the Promoter will employ every effort to ensure Shane Warneâs appearance, there is no guarantee that he will be in attendance. In the unlikely event of an unresolvable scheduling conflict, the Promoter reserves the right to reschedule the Prize redemption date.
11.The Promoter reserves the right at all times to terminate the meeting if the Winner or their companion become intoxicated, slanderous or in any other way inappropriate towards Shane Warne or the Promoterâs representative(s).
12.Shane Warne reserves the right to refuse to sign autographs, pose for personal photographs or perform any other personal requests, if he so chooses.
13.The Prize Winner must be ready to depart to Melbourne on 14 January 2011 and return on 15 January 2011.
14.The Prize Winner must be carrying valid identification at the time of travel.
15.The Winnerâs itinerary shall be determined by the Promoter in its absolute discretion.
16.Winner may be required to present a credit card or cash deposit at time of check in at the accommodation.
17.Subject to the terms and conditions of the participating Prize provider(s), if for any reason a Winner does not, once the Prize has been booked, claim the prize or an element of the Prize at the time stipulated, then the Prize or that element of the prize will be forfeited and will not be redeemable for cash.
18.If any prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize to the equal value and/or specification subject to any written directions from a regulatory authority.
19.The Winner will be contacted between 4 and 7 January 2011 via the email address and phone number provided on the Entry Page when submitting his or her entry. The Promoter will also publish the Winner's name on the Promoter's website.
20.The winning entrant agrees to provide a physical address to the promoter within 5 working days of the email informing the Winner of their success. The Prize will be sent by registered post, at the Promoter's cost, to the physical address provided by the winning entrant within 10 working days after the Promoter receiving that address from the winning entrant.
21.If the Winner cannot be contacted by 5.00pm 7 January 2011 (AEST), the prize will be forfeited and the second best entry will be deemed the Winner.
22.Prizes cannot be transferred or exchanged and cannot be redeemed for cash. All costs associated with taking or using the Prize are the responsibility of the Winner. The stated prize value is the recommended retail price at the time of printing and no responsibility will be accepted for any variation in prize value following the date of printing.
Use Of Your Personal Information
The Promoter collects the personal information requested on the Entry Form to conduct the Promotion. Unless the requested information is provided, the entrant cannot participate in the Promotion. By entering the Promotion, entrants acknowledge and agree that the Promoter may enter the personal information supplied by the entrant on the Entry Form into a database and store it at such places as the Promoter considers appropriate, and that unless otherwise advised the Promoter may (and may permit its affiliated companies and contractors to) use this information in any media for future Promotional, marketing and publicity purposes of the Promoter and its affiliated companies, including to contact the entrant by phone, email, SMS or MMS for the purposes of promoting any products or services offered by the Promoter or any of its affiliated companies from time to time, for an indefinite period and without any further reference or payment or other compensation to the entrant. Information collected will also be subject to the Promoter's privacy policy, which can be obtained at

General
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site, or any combination of those factors, including (but not limited to) any injury or damage to entrants or any other person's computer related to or resulting from participation in or downloading any materials in this Promotion.
Neither the Promoter nor any of its affiliated companies or suppliers is liable for any loss or damage whatsoever which is suffered (whether direct, indirect, consequential or otherwise) as a result of or in connection with the Promotion or the use of the Prize, or for any personal injury and/or death suffered or sustained in connection with any Prize, except to the extent such liability cannot be excluded by law. All warranties regarding the merchantability or fitness for purpose of the Prize are excluded to the maximum extent permitted by law. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the Prize supplied again.
The Promoter and its associated agencies and companies associated with this Promotion take no responsibility for Prizes damaged or lost in transit.
All entries become the property of the Promoter. By entering into the Promotion, each entrant:
a) warrants to the Promoter that their answer to the Promotional Question will be an original literary work of the entrant, which does not infringe the rights of any third party, and agrees to indemnify and keep the Promoter and its affiliated companies indemnified from and against any and all actions, claims, proceedings, losses, damages, costs, expenses (including legal expenses on a solicitor-client basis) and other liabilities of any nature arising in connection with a breach of this warranty; and
b) agrees to assign all rights (including copyright) in those answers to the Promoter, and to execute any documents reasonably required by the Promoter to enforce or perfect its rights in the answer to the Promotional Question.
By accepting the Prize, the winning entrant agrees to take part in any reasonable Promotional activities requested by the Promoter, including by having the entrant's photograph taken for the purposes of the Promoter's future marketing activities at no cost and permitting the Promoter, its affiliated companies and contractors to reproduce the photograph in any media for future Promotional, marketing and publicity purposes of the Promoter and its affiliated companies.
If for any reason this Promotion is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion to cancel, postpone or amend the Promotion, subject to the written directions of any competent authority.
