CONDITIONS OF ENTRY

1.    Instructions on how to enter and prizes form part of these Conditions of Entry.  Participation in this promotion is deemed acceptance of these Conditions of Entry.

2.    Entry is only open to Australian residents aged 18 years or over.  Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

3.    Promotion commences 18th October 2010 and closes 11.59pm AEDST on 14th November 2010 (“Promotional Period”).

4.    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5.    Incomplete or indecipherable entries will be deemed invalid.

6.    To enter, individuals must send an email to sallyhansen@acpmagazines.com.au with the subject title “Sally Hansen Promotion” and in the body of the email include their full name, age, address and daytime contact number, so it is received during the Promotional Period.

7.    Limit one (1) entry per person.


8.    The draw will take place at ACP Magazines Ltd, 54 Park Street, Sydney NSW 2000 at 9am AEDST on 22nd November 2010. The winner will be notified by phone, mail and the winner’s name will be published in the January issue of Cleo Magazine, on sale from 20th December 2010. The Promoter’s decision is final and no correspondence will be entered into.

9.    The first valid entry drawn will win a trip for two adults to attend a show at Australian Fashion Week in Sydney, NSW, valued at up to $3,750, depending on the winner’s date and point of departure (‘Major Prize’). The Major Prize includes:

a.    2 x return economy airfares from the Australian capital city airport closest to the residential address of the winner to Sydney (inclusive of airfare related taxes and charges).  If the winner resides within New South Wales, the airfare component of the prize is forfeited and not redeemable for cash;
b.    1 x night accommodation for winner and his/her companion (aged 18 years or over) at a 3-star hotel in Sydney;
c.    $500 spending money for the winner and $500 for his/her companion; and
d.    2 x tickets to attend a fashion show at Australian fashion week which will be held in Sydney during April/May 2011 with Aileen Marr. Exact dates of Australian Fashion Week event will be provided to the winner when they become available. The exact Australian Fashion Week event show winner and his/her companion will attend will be determined by the Promoter in its absolute discretion.

10.    Spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the Australian Fashion Week in Sydney during April/May 2011 and is subject to booking and flight availability. Exact dates of travel will be determined by the Promoter in its absolute discretion.

11.    Total prize pool for this promotion is valued at up to $3,750.

12.    A draw for the prize, if unclaimed, may take place on 22nd February 2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner (if any) will be notified in writing and their name will be published in the April issue of Cleo, on sale from 21st March 2011.

13.    The prize, including any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash unless otherwise stipulated. Any change in the value of the prize occurring between the publishing date of these Conditions of Entry and the date the prize is claimed is not the responsibility of the Promoter.

14.    The winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize.

15.    Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.

16.    Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.

17.    The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

18.    If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the competition.

19.    In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.

20.    In the event that the prize or part of the prize is not available, the Promoter reserves the right to substitute prize or that part of the prize with a prize to the same and equal recommended retail value and/or specification, subject to any written directions from the various Lottery Departments.

21.    Except for any liability that cannot be excluded by law, the Promoter excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; and/or (f) taking/use of the prize.

22.    Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

23.    The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Please see the Contents page of the latest Cleo magazine for reference of the Privacy Notice for further details on how ACP uses the personal information that is provided by entrants.

24.    If entrants do not wish to receive further communication from the Promoter or any third parties to whom their information is disclosed to by the Promoter, they must say this in their email entry.
