RIO CHRISTMAS CRACKERS PROMOTION
HOW TO ENTER
To be eligible to enter, individuals must purchase any Rio underwear product from a retailer that stocks Rio underwear between 22/11/2010 and 25/12/2010.
To enter, individuals must then either:
a) Visit www.riounderwear.com.au follow the prompts to the competition entry page, input the requested details including the last 4 digits of the specified product barcode and submit the fully completed entry form; or
b) send an SMS to 1991 6277 containing their first name, email address and the last 4 digits of the product barcode (in that order). Premium SMS cost is 55c. Entrants must have premium service access. SMS entrants under 18 years old must obtain account holder’s consent. SMS helpline: 1800 205 596.
Entries close 6:00pm AEDST on 25/12/2010. Each entrant will be notified instantly either online or by return SMS whether or not they are an instant winner.
After entrants receive their instant win notification entrants will receive a Christmas E-Card (if entering online) or a link to view a Christmas E-Card (if entering via SMS). In order to receive an additional chance to win an instant win prize, entrants must view the Christmas E-Card and then forward it to at least one (1) friend. To do so, entrants must, click on the ‘send to a friend’ link and provide the requested details including their friend’s unique valid email address. Each referred friend will then receive the Christmas E-Card via email from the entrant. Entrants will receive one (1) additional online instant win notification for referring the Christmas E-Card regardless of the number of friends they send the Christmas E-Card to. Entrants warrant that the friends that they intend to send the Christmas E-Card to are Australian residents who would normally consent to receiving such emails from the entrant. Entrants may only send the Christmas E-Card to a friend’s unique email address once.
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Promotion commences on 22/11/2010 and ends at 6:00pm AEDST on 25/12/2010.
3. Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS call costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete, indecipherable or illegible entries will be deemed invalid.
6. Multiple entries permitted, subject to the following: (a) only one (1) initial entry permitted per specified purchase requirement; (b) only one (1) additional entry permitted for successfully sending a Christmas E-Card to at least one (1) friend; (c) each entry must be submitted separately and in accordance with entry requirements; (d) a maximum of one (1) initial entry per person per day is permitted; and (e) unrecognised barcode numbers will be deemed invalid;
7. Entrants must retain their original purchase receipt(s) and product barcode(s) for all initial entries as proof of purchase. Failure to produce the proof of purchase for all initial entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
8. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
9. All claims for instant win prizes must be received by 2:00pm AEDST on 25/03/2011. Instant winners will be notified immediately and in writing according to their entry method: (a) SMS – via return SMS; or (b) online – upon entry submission. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. Winners’ names will be published in The Australian on 10/01/2011. The Promoter’s decision is final and no correspondence will be entered into.
10. There will be one (1) instant win prize randomly awarded for each day of the Promotional Period. Instant win prizes are: 31 x $1,000 cash awarded to the winners via electronic funds transfer or cheque (if requested). Prizes will be awarded within 28 days of winning notification. If no entries are received on a particular day the instant win prize allocated for that day will be awarded the next day. If on the last day no entries are received any instant win prizes to be won on that day will be awarded in the unclaimed prize draw.
11. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on their behalf.
12. Total prize pool value is $34,000. Prizes, or any unused portion of a prize, are not transferable or exchangeable.
13. A draw for any unclaimed prizes may take place at 3:00pm AEDST on 25/03/2011 at Message Media Interactive, Level 22, 385 Bourke Street Melbourne VIC 3000, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing and winners’ names] will be published in The Australian on 30/03/2011. Any unclaimed, un-won or undistributed instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.
14. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
16. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
17. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 31 instant win notifications for this promotion.
18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
19. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
