Terms & Conditions
1.Information on how to enter and prizes form part of these Terms & Conditions. Participation in this promotion is deemed acceptance of these Terms & Conditions.
2.Entry is only open to residents of Australia who are 18 years and over. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.Entry into the promotion commences 16th November 2010 at 07.00AM (AEDST) and closes on 16th January 2011 at 23.59PM (AEDST) ("Promotional Period").
4.To enter, an individual must, (during the Promotional Period):
◦Visit

◦Complete the online entry form by completing all fields as requested, including but not limited to the following information; entrant's full name, mailing address, postcode, contact number and valid email address;
◦Finalise the online entry form by; i) answering in 25 words or less why you need "Dr* Fairweather" and his Memordol Memory Kit to help their memory;
◦Confirm all of their entry details and submit the fully completed entry form.
5.Any entry that does not comply with the above will be deemed invalid.
6.There will be five (5) major prize winners. The winners will be the persons whose response is deemed to be the most creative response to this question "Just tell us in 25 words or less why you need Dr*. Fairweather and a Memordol Memory Kit to help your memory".
7.A limit of one entry per person applies. Multiple entries will be deemed invalid. Incomplete or indecipherable entries will also be deemed invalid.
8.There are 5 Major Prizes each consisting of one (1) 16GB Wi-Fi Apple iPads, including any postage and handling costs involved in shipping the iPad to the winners' residence. The prize is valued at $649 RRP.
9.Prizes are not transferable or exchangeable and cannot be taken as cash
10.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's/winner's identity, age, place of residence and/or if necessary relevant identification proof) and to disqualify any entrant who submits an entry that is not in accordance with these Terms & Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
11.Winners will be notified on 30th January 2011 by phone and email (supplied at the time of entry).
12.If a winner cannot be contacted within four weeks of the close of competition for any reason or fails to collect their prize by the time stipulated by the Promoter, then the prize will be forfeited and another winner shall be determined.
13.Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
14.The Promoter's decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into. This is a competition based on creativity and chance plays no part in determining the winners.
15.The Promoter is not responsible for any variation in prize value. In the event that the prize is unavailable for any reason, the Promoter reserves the right and discretion to substitute for that prize an alternative item of equal or greater value and/or specification.
16.Except for any liability that cannot be excluded by law (and in which case, such liability is limited to the maximum extent permitted by law), the Promoter and associated agencies exclude all liability (whether or not arising from any person's negligence) for any personal injury, illness, death, expense, damage or any loss (including, without limitation, loss of opportunity or loss of profits); whether direct, indirect, special or consequential loss, arising in any way out of the promotion or arising from any person accepting or using any prize, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) redemption of a prize; and/or (g) participation in this promotion.
17.As a condition of accepting a prize, that the winner/s may be required to sign legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
18.If for any reason this promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, war, terrorism, state of emergency or disaster, or any other causes beyond the control of the Promoter which corrupts or affects the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserve the right, in its sole discretion, to the fullest extent permitted by law, to (a) disqualify any entrant; and/or (b) to modify, suspend, cancel or terminate the promotion, as appropriate.
19.Any cost associated with entering the promotion is the entrant's responsibility and is dependent on the Internet service provider used.
20.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media, including radio, for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Entrants consent to the Promoter using the Entrant's image on the Honda promotional website when referring to the winner of a prize.
21.The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering, entrants' personal information may be disclosed to third parties, including but not limited to the Promoter's, agents, contractors, service providers and prize suppliers. A request to access, update or correct any information should be directed to the Promoter at its address set out below.
