Competition overview
This overview forms part of the general Terms and Conditions for the “WSFM’s Jonesy and Amanda’s Hallmark Personalised Cards Christmas” (competition). The promoter is the Australian Radio Network. “WSFM’s Jonesy and Amanda’s Hallmark Personalised Cards Christmas will be aired on 101.7WSFM Sydney.
Listeners will be invited to participate in WSFM’s Jonesy and Amanda’s Hallmark Personalised Cards ChristmasNovember 26 – Friday December 10. Listeners will be enticed to register their on the WSFM website
www.WSFM.com.au, and explain in 25 words or less why they would like to deliver their Hallmark Xmas Card to their loved one. From Monday 6 December to Friday 10 December (Monday – Friday) between 6am and 9am. Jonesy and Amanda will call one listener each day, based on their entry and will award them 1 return domestic flight to deliver their Hallmark Christmas Card to their loved one before Christmas, Saturday 26 December 2010.
3 Entry Details
3.1 WSFM will invite listeners to participate in the Competition fromFriday November 26 – Friday December 10 2010 (Monday – Friday), to register on the WSFM website and explain in 25 words or less who they would like to deliver their Hallmark personalised Christmas card to. Each day between Monday 6 – Friday 10 December, 6am – 9am, Jonesy and Amanda will call a daily winnerand award them 1 return domestic flight to their loved one prior to Christmas 2010, unless extended or withdrawn earlier by WSFM in its absolute discretion subject to NSW Legislation.
3.2 If in the course of the Competition:
(a) a telephone line breaks up or drops out or otherwise fails; or
(b) there is a dispute arising out of the use of telephone lines (including situations where multiple telephone lines are used); or
c) THE AUSTRALIAN RADIO NETWORK is effected by technical difficulties i.e. transmission failure.
3.3 If an event described in paragraphs (a), (b) and (c) in clause 3.2 above occurs:
(a) the Company will not be responsible for awarding a prize to the relevant contestant or contestants;
(b) The decision of the Company will be final and conclusive and no discussion or correspondence will be entered into.
3.4 Once a Contestant has won as a result of playing “THE AUSTRALIAN RADIO NETWORK – WSFM’s Jonesy and Amanda’s Hallmark Personalised Cards Christmas” game, they may not enter the Competition again.
3.5 THE AUSTRALIAN RADIO NETWORK, its agencies, affiliates, sponsors, representatives and their families are not eligible to enter ““THE AUSTRALIAN RADIO NETWORK – WSFM’s Jonesy and Amanda’s Hallmark Personalised Cards Christmas” competition.
3.6 By participating in this Competition, the Contestant agrees to be bound by the terms of these Specific Competition Rules and THE AUSTRALIAN RADIO NETWORK’s General Competition Rules. Participation is only open to residents of NSW aged 18 years and over.
4 Details of Competition
4.1 In each instance where a caller has been deemed a winner on air with WSFM’s Jonesy and Amanda’s Hallmark Personalised Cards Christmas, they will be awarded with 1 x domestic return flight from Sydney to another capital city before Christmas – Saturday 26 December 2010.
4.2 There is 1 prize per day to be awarded (From Monday December 6 – Friday December 10). 5 flights in total.
4.3 All prizes are accepted entirely at the risk of the winner, and THE AUSTRALIAN RADIO NETWORK - WSFM excludes all warranties in connection with any prize (including representations as to merchantability and fitness for purposes) to the extent permitted by law.
4.4 To the extent permitted by law, THE AUSTRALIAN RADIO NETWORK – WSFM, its agencies, affiliates, sponsors and representatives are not responsible for defective prizes or misuse of any prize, or for any claims, liability, loss or damage (whether foreseeable or not) arising out of or in connection with this Competition, whether caused by the negligence of any of the aforementioned or not.
4.5 Contestants are responsible for any and all taxes payable as a result of a prize being awarded or received.
5 PRIZE DETAILS:

5 THE AUSTRALIAN RADIO NETWORK’s Decision is Final
5.1 THE AUSTRALIAN RADIO NETWORK’s decision in respect of the selection of the Contestants is binding and conclusive and will not be challenged on the grounds that THE AUSTRALIAN RADIO NETWORK – WSFM failed to act reasonably, fairly, in good faith or otherwise in accordance with the principles of procedural fairness.
THE AUSTRALIAN RADIO NETWORK- WSFM’s decision will remain binding and conclusive notwithstanding that it can be demonstrated that THE AUSTRALIAN RADIO NETWORK – WSFM made a decision that was wrong, based on a factual error or an irrelevant or irrational consideration. It is not THE AUSTRALIAN RADIO NETWORK – WSFM’s policy to enter into negotiations with contestants who challenge a decision made by THE AUSTRALIAN RADIO NETWORK – WSFM
6 Promotional Activities
6.1 Each Contestant acknowledges and agrees that:
(a) he or she may be required by THE AUSTRALIAN RADIO NETWORK – WSFM, in its absolute discretion, to:
(i) participate in promotional activities for the benefit of THE AUSTRALIAN RADIO NETWORK – WSFM(including participating in a sound recording, photograph, video or film session); and
(ii) that he or she will not, without the prior written consent of THE AUSTRALIAN RADIO NETWORK – WSFM(which may be given or withheld in its absolute discretion) participate in any other media activities, promotions or events for the purpose of or which involve discussion, commenting on, expressing a view or giving an account of the Competition, THE AUSTRALIAN RADIO NETWORK – WSFM, its related bodies corporate or the operations of THE AUSTRALIAN RADIO NETWORK – WSFM and its related bodies corporate; and
(b) in promotional activities referred to in condition 6.1 (a)(i) and (ii), above, express a positive view of THE AUSTRALIAN RADIO NETWORK – WSFM and its operations and refrain from expressing a negative or disparaging view of THE AUSTRALIAN RADIO NETWORK – WSFM, its related bodies corporate or the operations of THE AUSTRALIAN RADIO NETWORK – WSFM or its related bodies corporate.
6.2 Each Contestant acknowledges and agrees that THE AUSTRALIAN RADIO NETWORK – WSFM has the right to use any materials generated in connection with a Contestant’s participation in the Competition in any medium and in any manner it sees fit.
7 Notifications
7.1 Winners will be notified of their win immediately on-air and in writing, and by phone.
8 Withdrawal
8.1 Notwithstanding any other condition of these Specific Competition Rules, THE AUSTRALIAN RADIO NETWORK reserves the right to withdraw the Competition at any time and for any reason whatsoever with the prior approval of the NSW Commission for Gambling Regulation. THE AUSTRALIAN RADIO NETWORK shall not be liable in any way or for any consequence of withdrawing the Competition.
