OurDeal – 12 Deals of Christmas Promotion Terms and Conditions

Information on ‘how to enter’ forms part of the Terms and Conditions of entry to this game-of-skill promotion. Entry into the promotion is deemed acceptance of these Terms and conditions.
1. The Promoter for this competition is OurDeal Pty Ltd ABN 27 122 967 239 Suite 805, 3 Waverley St, Bondi Junction, NSW, 2022.
2. Entry is open to permanent residents of New South Wales, Queensland, Victoria and South Australia who are over the age of 18 years as at 7th December 2010
3. Entries will open 10am AEST on 7th December 2010. Entries will close at 10am AEST on 29th December 2010.
4. To enter the promotion, entrants must write in 25 words or less ‘What would you like under the tree this Christmas?’. Entrants must register through a registration form on www.OurDeal.com.au between 10am on 7th December 2010 and until 10am 29th December 2010.
5. Additional entries are available for customers who make a purchase on www.OurDeal.com.au website during the promotional period. One (1) additional entry is received per one (1) voucher purchased.
6. Each entrant is entered into the draw for the state which it was purchased in.
7. Incomplete, indecipherable or invalid entries or purchases due to any circumstance be it technical or otherwise, will be deemed invalid.
8. Employees of OurDeal, its agents and their immediate family members are not eligible to enter.
9. Prizes: There are five (5) major prizes sixty and (60) minor prizes;
a. Sydney
1 x Major prize which consists of the following;
o 1 x $100 OurDeal Gift Voucher (valid for 12 months from date of issue)
o 12 x OurDeal deal vouchers for the daily television broadcasted Deals in Sydney during the promotion period valued at $1000.

1 x Major prize which consists of the following;

10. The total prize pool for the 12 Deals of Christmas Promotion is $10,500 and any unused portion of the prize, will not be transferable or exchangeable and cannot be taken as cash.
11. In the event that OurDeal do not have a featured television-broadcasted or featured website Deals for a particular day, OurDeal reserves the right to substitute that Deal for 1 x $50 OurDeal voucher (valid for 12 months from date of issue).
12. Any ancillary costs associated with redeeming the Prize are not included. Any unused balance of OurDeal vouchers will not be awarded as cash.
13. All entries will be judged via a judging panel who will select the winners for both major and minor prizes. The Promoter's decision is final on all matters and no correspondence will be entered into.
14. The judging will take place at OurDeal Offices, Suite 805, 3 Waverley St, Bondi Junction, NSW, 2022 at 3pm AEST on the 30th of December 2010.
15. The winners will be contacted via email and will be announced on the OurDeal promotion website. If there is an unclaimed prize, Winners will be notified via email and published in the Australian Newspaper on the 29th of March 2011.
16. If any prizes remain unclaimed, additional winners will be selected at OurDeal Offices, Suite 805, 3 Waverley St, Bondi Junction, NSW, 2022 at 3pm AEST on the 30th of March 2011.
17. The prizes are not exchangeable for other goods and services or redeemed as cash.
18. The Promoter accepts no responsibility for any variation to this prize, due to circumstances outside its control. In any such event, an alternative prize will be arranged.
19. The Promoter does not warrant the merchantability, suitability and/or fitness for purpose of any goods and/or services awarded as a prize.
20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: any theft, unauthorised access or third party interference; or any tax liability incurred by the winners.
21. The winner agrees to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agrees that the Promoter will own copyright of any such images and photograph/s and in all material incorporating the photograph/s.
22. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
23. The Promoter accepts no responsibilities for late entries or entries not received for any reason.
24. OurDeal Ltd accepts no responsibility for any tax implications that may arise from winning the prize.

25. OurDeal Pty Ltd is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this competition.
26. Entry into this competition will be deemed to be an acceptance of the above terms and conditions.
27. All entries will be handled in accordance with the OurDeal privacy policy.
