FULL TERMS AND CONDITIONS
Ra Nui and Trout Valley brands are proudly distributed in Australia by Tyrrell’s
Wines. Information on how to enter and prizes form part of these Terms and Conditions.
Entry into the promotion is deemed acceptance of these Terms and Conditions. Entry is
open to all Australian residents aged 18 years or over. Employees (and their immediate
families) of Tyrrell’s Vineyards Pty Ltd, providers, agencies and venues associated with
this promotion are ineligible to enter.
The promotion commences on 01/11/10 at 00:01 (EST) and concludes on 31/01/11 at
23:59pm (EST) “Promotional Period”.
Entry to the Consumer Promotion: For one (1) entry into the prize draw, participants
must purchase one (1) glass of either Trout Valley or Ra Nui wine, complete the details
on the entry form and submit the form at the venue where the wine was consumed “Entry
Requirements”. For three (3) entries into the prize draw, participants must purchase one
(1) bottle of either Trout Valley or Ra Nui wine, complete the details on the entry form
and submit the form at the venue where the wine was consumed “Entry Requirements”.
Multiple entries are permitted in accordance with entry requirements.
General: The Promoter’s decision is final and no correspondence will be entered into.
Prizes are non-transferable and cannot be exchanged for cash. The promoter reserves the
right to request winners to provide proof of purchase, age or identity. Proof of purchase
and identification considered suitable for verification is at the discretion of the promoter.
The Promoter, in its absolute discretion, reserves the right, at any time, to verify the
validity of all entries and entrants and to disqualify any entrant who tampers with the
entry process, or an entrant who submits an entry that is not in accordance with these
Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage
does not constitute a waiver of those rights. Entries will be deemed to be accepted at the
time of receipt and not at the time of transmission. Incomplete, incorrect, or
incomprehensible entries will be deemed invalid. The prize draws will take place at 10:00
(AEST) on 28/02/11 at Tyrrell’s Wines, Unit 6, 277 Lane Cove Road, North Ryde, NSW,
2113. All winners will be notified by phone and mail and their name published in the
public section of the Australian newspaper on 2/3/11. The first valid entry drawn from
all entries received in each state (NSW/ACTx1, QLDx1, VICx1) will win a return trip for
two (2) adults to New Zealand valued at up to $4,000 depending on date and point of
departure. Prize includes two (2) airfares from winners nearest capital city to Nelson via
Wellington; five (5) day car hire; two (2) nights hotel accommodation at Kahurangi
Estate Luxury Cottage Nelson; a viticulture tour of the Trout Valley vineyards including
wine tasting and lunch for two; two (2) nights hotel accommodation at Marlborough
Vintners Hotel including breakfast; a viticulture tour of the Ra Nui vineyards including
wine tasting and lunch for two; a $500 flight centre travel voucher to be used in
conjunction with this trip and two (2) airfares from Auckland to the winners nearest
capital city. Spending money, additional meals, taxes, insurances, passports, transport to
and from departure point, transfers, items of a personal nature, in-room charges and all
other ancillary costs are not included. Car hire prize is subject to standard rental
conditions. Petrol and insurance is not included. The driver must have a current valid
Australian driver’s license. Prize must be taken between 1/03/11 and 15/12/11 and is
subject to booking and flight availability. If the prize winners requested dates are not
available, alternative dates will be offered. The winner (and any companion aged 18
years or over) must depart from and return to the same departure point and travel
together. If for any reason a winner does not take an element of the major prize by the
time stipulated by the Promoter, then the major prize or that element of the major prize
will be forfeited. The second valid entry drawn from all entries received in each state
(NSW/ACTx1, QLDx1, VICx1) will win a $500 Red Balloon voucher. The total
maximum prize pool is valued at up to AUD $13,500. If any prize (or part of any prize)
is unavailable, for whatever reason, the Promoter, in its discretion, reserves the right to
substitute any prize (or that part of the prize) for a prize of equal or greater value and/or
specification, subject to any written directions from a regulatory authority. The Promoter
reserves the right to validate and check the authenticity of any prize claim or entry before
awarding a prize. Should any prize remain unclaimed, an unclaimed prize draw will take
place at 10:00 (EST) on 30/05/11, Tyrrell’s Wines, Unit 6, 277 Lane Cove Road, North
Ryde, NSW, 2113. Winner will be notified by phone and mail and their name published
in the public notices section of The Australian newspaper on 1/06/11. The prize must be
taken as offered and cannot be varied. Prize values are GST inclusive, recommended
retail value is correct at time of printing. If this promotion is interfered with in any way
or is not capable of being conducted as reasonably anticipated due to any reason beyond
the reasonable control of the Promoter, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b)
subject to any written directions from a regulatory authority, to modify, suspend,
terminate or cancel the promotion, as appropriate. As a condition of accepting the prize,
the winner (and any companion/s) must sign any legal documentation as and in the form
required by the Promoter / Prize Supplier / organisers in their absolute discretion
including but not limited to a legal release and indemnity form. Except for any liability
that cannot be excluded by law, the Promoter (including its officers, employees and
agents) excludes all liability (including negligence), for any personal injury; or any loss
or damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of the Promotion, including, but not limited to,
where arising out of the following: (a) any technical difficulties or equipment
malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised
access or third party interference; (c) any entry or prize claim that is late, lost, altered,
damaged or misdirected (whether or not after their receipt by the Promoter) due to any
reason beyond the reasonable control of the Promoter; (d) any variation in prize value to
that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or
entrant; or (f) use of a prize. The Promoter reserves the right in its sole discretion to
disqualify any individual who the Promoter has reason to believe has breached any of
these conditions, or engaged in any unlawful or other improper misconduct calculated to
jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to
recover damages or other compensation from such an offender are reserved. All entries
become the property of the Promoter. The Promoter collects personal information about
you to enable you to participate in this promotion but no further use of this information
will be made. If you do not provide your personal information, the Promoter will not be
