    To be in with a chance, just upload a photo of your favourite music experience and a caption telling us why it was so memorable.

    Only persons residing in Australia who are at least 18 years of age can enter.

ā€œV ENERGY POWERING MUSICā€ PROMOTION

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years or over.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. Promotion commences on 13th December 2010 and ends at 11.59pm AEDST on 6th March 2011 (ā€˜Promotion Period’).

5. To enter, eligible individuals must visit www.facebook.com/venergyaustralia the Official Australian V Page on Facebook (ā€˜Fan Page’), click the ā€˜like’ button on the Fan Page, follow the prompts to the competition entry page, input the requested details including their full name, phone number and valid email address and upload a picture of their favourite music experience (e.g. a picture of themselves/friends taken at a club, music festival or concert) and a corresponding caption/comment and submit the fully completed entry form during the Promotion Period. Entrants must have permission to use the images uploaded. In addition, images uploaded must adhere to the requirements under clause 23 of these Terms and Conditions. Only images that are compatible with the Facebook upload system may be used for entry. A caption/comment submitted must fall within the allowable character limit for picture comments on Facebook.

6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7. Incomplete or indecipherable entries will be deemed invalid.

8. Only one entry permitted per person per week of the promotion. Individuals must submit a different image and caption/comment with each new entry.

9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

10. Winners will be notified by telephone and e-mail.

11. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged by a panel of judges, based on the originality and creative merit of the caption/comment relating the image uploaded. The judging panel will be appointed by the Promoter in its sole discretion.

12. The judging panel reserve the right to select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.

13. The Promoter’s decision is final and no correspondence will be entered into.

14. Entries will be divided into weekly groups. Entries submitted for one week will not be included for judging for any subsequent week. Entries for each week open at 12.00am AEDST on the dates in the table below. Entries for each week close at 11.59pm AEDST on the dates indicated below. Final entries close at 11.59pm AEDST on 06/03/11.

15. Prizes awarded for each week are as follows:
• Week 1: The best valid entry in week 1, as determined by the judging panel, will win a double pass to Summadayze in South Australia on 01/01/11, valued at $350;

• Week 2: The best valid entry in week 2, as determined by the judging panel, will win a double pass to Summadayze in Victoria on 01/01/11, valued at $350. The next best two entries in week 2 will each win a double pass to Armin NYE (2 x general admission tickets) in Victoria on 01/01/11 valued at $270.

• Week 3: The best valid entry in week 3, as determined by the judging panel, will win a double pass to Summadayze in Western Australia on 08/01/11, valued at $350

• Week 4: The best two valid entries in week 4, as determined by the judging panel, will each win a double pass to Hot BBQ Point Nepean, Victoria on 22/01/11, valued at $190;

• Week 5: The best valid entry in week 5, as determined by the judging panel, will win a double pass to the Future Music Festival in Queensland on 05/03/11, valued at $350;

• Week 6: The best valid entry in week 6, as determined by the judging panel, will win a double pass to the Future Music Festival in Western Australia on 06/03/11, valued at $350;

• Week 7: The best valid entry in week 7, as determined by the judging panel, will win a double pass to the Future Music Festival in New South Wales on 12/03/11, valued at $350;

• Week 8: The best valid entry in week 8, as determined by the judging panel, will win a double pass to the Future Music Festival in Victoria on 09/03/11, valued at $350;

• Week 9: The best valid entry in week 9, as determined by the judging panel, will win a double pass to the Future Music Festival in South Australia on 14/03/11, valued at $350;

• Week 10: The best two entries in week 10, as determined by the judging panel will each win a double pass (2 x general admission tickets) to the Chemical Brothers concert in Victoria on 13/03/11, valued at $190;

• Week 11: The best two valid entries in week 11, as determined by the judging panel, will each win a double (2 x general admission tickets) to the Chemical Brothers concert in Queensland on 04/03/11, valued at $190;

• Week 12: The best two valid entries in week 12, as determined by the judging panel, will each win a double pass (2 x general admission tickets) to the Chemical Brothers concert in New South Wales on 10/03/11, valued at $190.

16. Summadayze double passes include side of stage viewing for Boys Noize and access to the VIP bar area and toilets. Double passes to Hot BBQ Point Nepean includes access to the VIP bar area and toilets. Double passes to the Future Music Festival include access to VIP bar area and toilets and side of stage viewing for one (1) artist (the exact artist will be determined by the event organisers closer to the event). Winner’s companion must aged 18 years or over.

17. The Promoter accepts no responsibility for any associated costs with travel to and from an event venue. All costs associated with attending an event venue (including but not limited to airfares, transfers and accommodation) is the responsibility of the winner.

18. If for any reason a winner does not take a prize or an element of a prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

19. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

20. The prize event tickets are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organizers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

21. Total prize pool value is $4,860.

22. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

23. When an entrant submits any materials via the Promotion including images (ā€œContentā€), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; Ā© they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

Without limiting any other terms herein, the entrant indemnifies the Promoter for any breach of the above terms.

24. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

26. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

27. Entry and continued participation in the Promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php.

28. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in clauses 23 and 31 of these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook.

29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory implied guarantees/warranties as provided under the Trade Practices Act, ASIC Act, or the Competition and Consumer Act including the statutory consumer guarantees under the Australian Consumer Law or similar laws in the State and Territories of Australia (ā€œNon-Excludable Guaranteesā€). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

30. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; Ā© any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if a prize event is cancelled/postponed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) attendance at a prize event.

31. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
