ARIA End of Year Chart Competition 2010

PROMOTER
 
The Promoter is the Australian Recording Industry Association Ltd (“ARIA”), located at Level 4, 19 Harris Street, Pyrmont NSW 2009. The Promoter’s ABN is 72 002 692 944.

PROMOTIONAL PERIOD
 
The Promotion commences on 16 December 2010 at 00:01 (AEDT) and closes on 28 December 2010 at 23:59 (AEDT) (the “Promotional Period”).

 ENTRY ELIGIBILITY
 
Entry is open to Australian permanent residents. Employees and the immediate families of the Promoter, the Promoter’s member organisations and / or licensors, Phonographic Performance Company of Australia Ltd and/or its licensors, Music Industry Piracy Investigations Pty Limited, We Are Social Pty Ltd and Revolutions Per Minute are ineligible to enter this Promotion.

 METHOD OF ENTRY
 
For the purpose of these Terms and Conditions, the “ARIA End of Year Singles Chart 2010” is a music chart compiled and administered by the Promoter that ranks the top selling singles in Australia for 2010.
To enter the Promotion, during the Promotional Period entrants will be required to:
 
‘Like’ the website;
 
register their details at the website including their first name, surname, gender, email, state, post code and phone number; and
 
rank the top five (5) singles in the ARIA End of Year Singles Chart 2010 in the correct order. During the Promotional Period, fifty five (55) singles will be listed on the website. Entrants will be required to select and rank five (5) singles from this list which they believe will be the top five (5) singles in the ARIA End of Year Singles Chart 2010 and in the correct order. 
Entrants may not enter this Promotion more than once and may not enter or participate in the Promotion on behalf of any third party. Multiple entries from the same email address or from automated competition entry services are invalid.
 
DRAW DETAILS
 
The winner of the Prize will be the entrant that correctly identifies the top five (5) singles in the ARIA End of Year Singles Chart 2010 in the correct order. The winner will be determined at 2pm (AEDT) at Level 4, 19 Harris Street, Pyrmont NSW 2009 on 5 January 2011.
If more than one entrant correctly identifies the top five (5) singles in the ARIA End of Year Singles Chart 2010 in the correct order, then a manual random draw that includes only those entrants will take place at Level 4, 19 Harris Street, Pyrmont NSW 2009 on 5 January 2011 after 2pm. The Prize will be awarded to the first entrant drawn.
If no entrant correctly identifies the top five (5) singles in the ARIA End of Year Singles Chart 2010 in the correct order, then the winner of the Prize will be the entrant that identifies the top four (4) singles in the ARIA End of Year Singles Chart 2010 in the correct order.
If more than one entrants correctly identifies the top five (4) singles in the ARIA End of Year Singles Chart 2010 in the correct order, then a manual random draw with only those entrants will take place at Level 4, 19 Harris Street, Pyrmont NSW 2009 on 5 January 2011 after 2pm. The Prize will be awarded to the first entrant drawn.
If no entrant correctly identifies the top four (4) singles in the ARIA End of Year Singles Chart 2010 in the correct order, then a manual random draw including entries from all Promotion entrants will take place at Level 4, 19 Harris Street, Pyrmont NSW 2009 on 5 January 2011 after 2pm.
 
PRIZE
 
There is only one prize. It consists of fifty (50) CD albums of various titles.

The approximate Prize pool value is AU$1,500.

The Prize cannot be transferred, exchanged or redeemed for cash.

 PRIZE WINNER PUBLICATION DETAILS
 
The Prize winner will be contacted by phone and email on 5 January 2011.

The Prize winner will also be published on the website and at www.ariacharts.com.au on 7 January 2010.

 UNCLAIMED PRIZES
 
Subject to any direction given under relevant State legislation, if the Prize is unclaimed three (3) months after the original manual random draw, an unclaimed manual random draw will take place at Level 4, 19 Harris Street, Pyrmont NSW 2009 on 6 April 2011 at 2pm (AEDT). The Prize winner will be notified by phone and email and published on the website and at www.ariacharts.com.au within 2 days of the draw.

 TAMPERING AND OTHER MATTERS
 
The Promoter reserves the right to verify the validity of all entries and to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions.
 
The Promoter may in its absolute discretion require that an entrant provide photographic identification or some other acceptable form identification before the Promoter awards the Prize.
The Promoter is not responsible for any incorrect or inaccurate information or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter does not accept any responsibility for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promotion database and not time of transmission by the entrant.
 
The Promoter’s decision in relation to any aspects of the Promotion is final and binding on each entrant and no correspondence will be entered into.
 
The Prize winner will be responsible for any taxes that may be payable as a result of accepting the Prize. The Prize winner is responsible for obtaining their own financial advice in respect of this before accepting the Prize.
 
PRIZE AVAILABILITY
 
The Promoter does not warrant the merchantability, suitability and/or fitness for purpose of any goods and/or services awarded as a Prize.
 
The Prize is subject to availability and the Promoter may, subject to State regulations, substitute a different Prize of equivalent value in place of any Prize referred to in these Terms and Conditions.
In the event that for any reason whatsoever that the Prize winner does not take the Prize then that element of the prize will be forfeited by the Prize winner and cash will not be awarded in lieu of that element of the Prize.
 
RELEASE AND INDEMNITY
 
By entering the Promotion, each entrant agrees that the Promoter, their respective parent companies, affiliates, subsidiaries, and their respective officers, directors, contractors and employees shall not be liable for injury, loss (including but not limited to indirect or consequential loss), or damage of any kind resulting from participating in this Promotion or from the acceptance or use/misuse of the Prize awarded. This includes, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.


TERMINATION
 
The Promoter may (subject to State Regulations) vary the terms of, or terminate, this Promotion at any time at its absolute discretion without liability to any entrant or other person. The Promoter will not award the Prize if the Promotion is terminated.

 PUBLICITY
 
The Promoter may publicise, broadcast and communicate to the public the names and likeness of any entrants for any promotion or matter incidental to the Promotion.

 MINORS
 
If the Prize winner is under the age of 18 years these Terms and Conditions must be signed by the Prize winner’s parent or legal guardian (if requested by the Promoter) before the Prize is awarded and the Prize may at the absolute discretion of the Promoter be awarded to the prize winner’s parent or legal guardian.

 
FAILURE TO ENFORCE TERMS AND CONDITIONS
 
A failure by the Promoter to enforce any one of these Terms and Conditions in any instance(s) will not give rise to any claim or right of action by any other person or entrant.
 
COPYRIGHT
 
By entering this Promotion all entrants:

 
assign to the Promoter all rights including present and future copyright in their entry in all media (including, without limitation, the internet) and whether in existence now or created in the future;
agree not to assert any moral rights in respect of their entry (wherever and whenever such rights are recognised) against the Promoter, its assigns, licensees and successors in title; and
undertake to the Promoter that their entry is not in breach of any third party intellectual property rights.
 
PRIVACY AND CONTACT DETAILS
 
It is each entrant’s responsibility to notify the Promoter if the entrant’s contact details change during the Promotional Period.

The personal information supplied by entrants when entering this Promotion will be used by the Promoter in accordance with its Privacy Policy. Please refer to the Privacy Policy by visiting the website for more information as entry in this Promotion is an agreement to be bound by that policy. All entrants may have their details removed from the Promoter’s database by simply contacting the Promoter or by sending an email to mail@aria.com.au. If an entrant requests the removal of their details prior to the conclusion of the Promotional Period and/or the awarding of the Prize, such entrant will forfeit their right to claim any Prize.
