OPTUS - "SHAPE OUR WORLD - WIN A TRIP FOR 4 TO AWC'S SCOTIA WILDLIFE SANCTUARY" PROMOTION
1. Information on how to enter and the prize forms part of these Terms and Conditions. Entry into the “Shape Our World – Win a Trip for 4 to AWC’s Scotia Wildlife Sanctuary Promotion” (“Promotion”) is deemed to be an acceptance of these Terms and Conditions.
2. Promotion commences Monday, 25th October 2010 at 09:00 (AEDST) and entries close on Thursday, 13th January 2011 at 23:59 (AEDST) (“Promotion Period”).
3. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.
4. To enter, eligible entrants must visit www.shapeourworld.com.au and follow the prompts to register with a valid email address to the Australian Wildlife Conservancy (“AWC”) Shape Our World online newsletter during the Promotion Period. Eligible entrants must input the requested details and submit the fully completed registration form during the Promotion Period. Entrants must remain registered to the AWC Shape Our World online newsletter with a valid email address throughout the Promotion Period and must still be registered as at 15:00 (AEDST) on Friday, 14th January 2011 in order to claim the prize. 5. Only one (1) entry permitted per person. 6. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
7. Incomplete or indecipherable entries will be deemed invalid.
8. All valid entries received during the Promotion Period will be entered into the draw to be held on Friday, 14th January 2011 at 15:00 (AEDST) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park, NSW 2113. The winner will be notified by email and phone within 2 days of the draw. The winner’s name will be published in The Australian on Tuesday, 18th January 2011. The Promoter reserves the right to draw additional reserve entries and record them in case an invalid entry or ineligible entrant is drawn.
9. The first valid entry drawn at random in the draw will win a trip for 4 people to Scotia Wildlife Park in central NSW at a date to be determined by the AWC in March/April 2011, subject to booking and flight availability. The winner will be notified via email and/or phone as soon as practicable as to the exact dates of the trip. The total value of the prize is up to AU$11,000, depending on date and point of departure. The prize includes 4 return economy flights from the winner’s nearest regional city/town to Mildura, VIC (if required), return transfers from Mildura to the Scotia Wildlife Sanctuary, 2 nights’ twin share accommodation in cabins at the Scotia Wildlife Sanctuary at Scotia, NSW and all meals and beverages.
10. If the winner resides within a 100km radius of Mildura, VIC, the airfare and return transfer components of the prize will be forfeited and not redeemable for cash.
11. Spending money, additional meals and beverages, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
12. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner (and his/her companions) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the prize. Winner may be required to present credit card at time of accommodation check in. Prize is subject to the standard terms and conditions of individual prize and service providers.
13. All bookings for flights to and from Mildura, accommodation at Scotia and the transfers from Mildura to Scotia will be organised through Optus.
14. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will not be redeemable for cash.
15. The prize cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the prize with a prize of equal or greater value where the prize is unavailable, subject to approval of the gaming authorities in each State and Territory where relevant.
16. The Promoter may conduct such further draws at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park NSW 2113 on Monday, 31st January 2011 at 15:00 AEDST, as are necessary to award the prize, if unclaimed, subject however to any directions from a regulatory authority. The first valid entry drawn and successfully contacted by email and phone will win the prize. If the unclaimed prize draw winner cannot be contacted within 24 hours, a reserve winner will be contacted until a prize winner is determined. The unclaimed prize draw winner, if any, will be notified by email and phone within 2 days of the draw. In this event, the winner’s name will be published in The Australian on Friday, 4th February 2011.
17. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute. The prize must be taken as offered and cannot be varied.
18. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
19. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
20. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
21. The winner agrees to participate in any reasonable news and media/PR activities surrounding the Promotion. The Promoter reserves the right to use the winner’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.
22. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
23. All entries become the property of the Promoter. The Promoter requires entrants’ personal information in order to conduct the Promotion. If an entrant does not provide the mandatory personal information requested then they will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion, announce the winner and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy.
