“BIC BACK TO SCHOOL YOGI BEAR” PROMOTION
HOW TO ENTER
i. To be eligible to enter, individuals must purchase any BIC® stationery product from a participating store nationally between 26/12/10 and close of business on 13/02/11.
ii. To enter entrants must then visit
www.bicexpressyourself.com.au (for Australian residents) or bicbacktoschool.co.nz (for New Zealand residents), follow the prompts to the competition entry page, input the
requested details (including the last five (5) digits of the BIC® stationery product barcode, store of product purchase, full name, age, address, email address and contact phone number and agree to having received permission from their parent/guardian to enter (if under the age of 18) by clicking the tick box and submit the fully completed entry form by 11:59pm AEDST on 13/02/11 (for Australian residents) or 11:59pm NZDST on 13/02/11 (for New Zealand residents).
iii. There is a limit of five (5) entries per person, per day.
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian and New Zealand residents.
3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
4. Employees (and their immediate families) of the Promoter, participating stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. Incomplete, indecipherable or illegible entries will be deemed invalid.
7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
8. Promotion commences on 26/12/10 and ends for purchases at close of business on 13/02/11. Entries close at 11:59pm AEDST on 13/02/11 (for Australian residents) and 11:59pm NZDST on 13/02/11 (for New Zealand
residents).
9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a
maximum of five (5) entries per person per day permitted.
10. Entrants must retain their original purchase receipt(s) and original BIC® stationery product barcode(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. The Promoter reserves the right to request entrants to provide all purchase receipt(s) and barcode(s) for winning and non-winning entries. Purchase receipt(s) must clearly specify that the purchase was made during the promotional period but prior to entry.
Minor Prize Draws
11. Entries will be divided into two “Groups” depending on where the entrant resides (Australia or New Zealand). Entries close for each Minor Draw on the dates and times specified in the table below. There will be 5 Minor Draws for each Group. The draws will be conducted at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004 on the dates and times outlined in the table below. Un-drawn entries in each Minor Draw will be entered into any subsequent Minor Draws for that Group and all entries from both Groups (including winners in a Minor Draw) will be entered into the Major Prize Draw.

12. The first 225 valid entries drawn in Australian Minor Draws 1 - 4 and the first 100 valid entries draw in Australian Minor Draw 5 will each win a single adult movie ticket to a general admission screening of ‘Yogi Bear’ at any cinema at which the film is showing within Australia, valued at up to AU$19.
13. The first 100 valid entries drawn in each New Zealand Minor Draw will each win a single adult movie ticket to a general admission screening of ‘Yogi Bear’ at any cinema at which the film is showing within New Zealand, valued at up to NZ$19.
14. In the case that the number of entries received for a given Minor Draw is less than the number of prizes available for that draw, any remaining prizes will be included in the next Minor Draw. This excludes: (a) the last Australian Minor Draw (Australian Minor Draw 5), where any remaining prizes will be included in the unclaimed prize draw; and (b) the last New Zealand Minor Draw (New Zealand Minor Draw 5) where any remaining prizes will not be awarded.
15. The ‘Yogi Bear’ movie ticket is valid until 30 June 2011 or whenever the film stops screening in cinemas (whichever date is sooner).
16. Any ancillary costs associated with redeeming the movie ticket are not included. Any unused balance of the movie ticket will not be awarded as cash. Redemption of the movie ticket is subject to any terms and conditions of the issuer including those specified on the movie ticket. Movie ticket may not be used on movie screenings after 5pm on Saturdays and Tuesdays.
Major Prize Draw
17. The major prize draw will be held at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne VIC 3004 at 12 noon AEDST on 21/02/11. The winner will be notified via phone and email, and their details will be published in the
Australian on 24/02/11.
18. The first valid entry drawn from all Australian and New Zealand entries received will win a trip for two (2) adults and two (2) children (aged 12 years or under) to Los Angeles, USA. The prize is valued at up AU$13,635 if the winner is from Australia and up to NZ$17,165.10 if the winner is from New Zealand, depending on the date and exact point of departure. Prize includes return economy airfares with Air Pacific from the winner's nearest capital city (if winner resides in Australia) or from the nearest of Christchurch or Wellington (if winner resides in New Zealand) to Los Angeles, return transfers from LAX airport to Hotel Renaissance, four (4) nights quad room
accommodation at Hotel Renaissance Hollywood, four (4) VIP entry passes to Warner Bros Studios, entry for two (2) adults and two (2) children to Jellystone Park and five (5) nights accommodation in a deluxe cabin at

19. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
20. The winner and his/her companions are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
21. The winner and his/her companions must depart from and return to the same departure point and travel together.
22. Itinerary to be determined by the Promoter in its absolute discretion.
23. Frequent flyer points will not form part of the prize.
24. Prize is subject to the standard terms and conditions of individual prize and service providers.
25. Winner may be required to present credit card at time of accommodation check in.
General
26. The Promoter’s decision is final and no correspondence will be entered into.
27. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
28. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
29. Total potential prize pool value in Australia is up to AU$32,635.00. Total potential prize pool value in New Zealand is up to NZ$26,665.10.
30. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
31. A draw for any unclaimed prizes from Australia may take place at 12pm noon AEDST on 23/05/11 at the same place as the original draws from all Australian entries received (excluding any entry/entries previously drawn), subject to any directions from a regulatory authority. The winners (if any) will be notified in writing. The winner of the Major Prize (if any) will be published in The Australian on 27/05/11.
32. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
33. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
34. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
35. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
36. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in
prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (g) use of a prize/ participation in a prize.
37. As a condition of accepting the Major Prize, the winner (and his/her companions and/or legal guardian, if applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize
suppliers in their absolute discretion, including but not limited to a legal release. All forms will be sent to the contact address provided by the winner and must be returned executed by the date indicated on the form.
38. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
39. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
