1. Instructions on how to enter form part of these Conditions of Entry. Participation in this competition is deemed acceptance of these Conditions of Entry.
2. The competition is open to all residents of Australia that are over the age of 18 years, except employees of the Promoter and agencies associated with this competition and members of their immediate families.
3. The competition commences at 10:00am on 24th January 2011 and closes at 11:59pm on 7th February 2011 (“Promotional Period”)
4. To enter, entrants must:
a) Complete the competition entry form found on the Kidspot website:
http://www.kidspot.com.au/Competition/competition.asp. After you have entered your details, then by clicking "Enter" on the Kidspot Entry form you are indicating that you have read and agree to the Terms & Conditions for this competition. (Terms & Conditions*)
b) Either already be a Kidspot member or sign up to become a member; and
c) In 25 words or less answer the question: “Why do you think you should win the Ultimate Valentines Day Experience?”
5. There is a limit of one entry per person. Submitted entries will not be published or visible on the Kidspot site or any other media.
6. Incomplete or illegible entries or entries considered by the Promoter in its absolute discretion to be inappropriate or offensive, will be deemed invalid and will not be included in the judging.
7. If the entry is deemed inappropriate or offensive, it will be removed from the eligible entries by the Promoter administrators at their discretion.
8. At 5:00pm on the 8th February, the entry judged by the Promoter to be the most creative and literary answer to the question will win. The winner will be notified by email communication on the 9th of February and the prize vouchers will be delivered to the winner by the 14th February, 2011. Redemption of vouchers is subject to booking and availability and terms and conditions of the prize provider.
9. The winner of the Kidspot Ultimate Valentines Day Experience competition will win the following prize being the “Kidspot Ultimate Valentine’s Day Experience “valued at $600 (Australian Dollars):
a).
$200 gift certificate for Hotel Medina chain Reservations at all Australian Toga Hospitality hotels including; Medina Apartment Hotels, Vibe Hotels, and Travelodge Hotels are subject to allocation and availability at the time of reservation. The promoter shall have no liability for any incidental, indirect or consequential damages. All gift certificates will have the appropriate expiry date marked on them. Gift certificates will be valid for twenty-four months until 7 February 2013. Blackout dates may apply to seasonal periods, including; school holidays and public holidays, or any special events periods. Room allocations fill quickly during special events, school holidays, public holidays and weekends and no guarantee can be given that an allocated room will be available at any hotel or for the days that a customer may prefer. Toga Hospitality does suggest that all gift certificate recipients book well in advance to avoid disappointment. If a customer cancels their reservation, they must do so by either contacting the Central Reservations team or the hotel direct and advising of the relevant cancellation. If the customer fails to cancel the reservation 24 hours prior to check-in time (2pm on the day prior to arrival), the relevant hotel will be entitled to deduct one night of accommodation dollars in relation to the reservation as a cancellation fee. Gift certificates are only valid in Australia at Toga Hospitality hotels. A gift certificate entitles the bearer to overnight accommodation at the hotel's 'Best Available Rate' at the time of booking, at either Medina Apartment Hotels or Vibe Hotels or Travelodge Hotels in Australia only as listed in the Toga Hospitality Directory at the specified redemption rate advised by Reservations at each of the hotels at the time of booking. The gift certificate can be used to redeem the accommodation dollars principally towards pre-booked accommodation including; special discount offers such as Entertainment Card Reservations. Any remaining balance on the gift certificate can then be used towards payment or part-payment of the customer's room account from any additional charges or services used in the hotel including; food and beverage charges, mini bar, in-house movies, car parking or other incidental charges. Additional value cannot be added to a gift certificate. All transactions are declined once the gift certificate balance reaches zero. Any additional value sought by a customer will require the purchase of a new gift certificate, in accordance with these terms and conditions. The customer may, however, redeem on two or more separate gift certificates.
b). 1 x double Gold Class Cinema tickets (admission for 2 adults) (valued at $100) valid at any Gold Class Event cinema Australia wide. The value of one Gold Class ticket is $39.00. For two people its $78.00. $22.00 remaining to purchase food or drink. Guests must be at least 18 years of age when visiting Gold Class at Greater Union MEGAPLEXES Innaloo and Marion only. Proof of identification may be required. All food and beverages (including alcohol) purchased in Gold Class must be consumed on the premises. They can be used at any Event Cinemas, Greater Union and Birch Carroll & Coyle Cinemas with Gold Class seating - for movies, drinks, snacks and meals. Valid for 12 months until 7 February 2012.
c) $300 Voucher for dinner at a restaurant in the capital city nearest to the winner. Conditions and restaurant details will be confirmed by the Promoter once the winner is chosen. Valid for 12 months until 7 February 2012. The restaurant will be chosen by the Promoter and the venue will be at the absolute discretion of the Promoter.
This major prize is not transferable for cash. Any additional costs incurred by the winner or their guest using the prize are incurred at the winner’s own cost.
10. The judges’ decision in relation to all aspects of this competition is final and binding on all entrants and no correspondence will be entered into.
11. Total prize pool is $600. The prize is valued in Australian dollars
14. This is a game of skill and chance plays no part in determining the winner.
15. The entrant’s entry must be original and must not infringe on any third party’s intellectual property rights. The Promoter reserves the right to seek a declaration from any entrant that their entry complies with these Terms and Conditions.
16. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. In the event that the winner is disqualified, the Promoter will award the prize to the entry judged to be the next best.
17. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
18. In the event that for any reason whatsoever the prize winner does not take an element of the prize as stipulated by the Promoter, then that element of the prize will be forfeited by the prize winner. If the prize is forfeited within twenty four business hours of the notification taking place, a re-judging will occur immediately.
19. Any costs associated with accessing the Kidspot website and entering the competition are the responsibility of the person seeking access and are dependent on the internet service provider used.
20. All entries are deemed to be received at the time of receipt by the Promoter, not time of transmission by the entrant. The Promoter accepts no responsibility for late, lost or misdirected entries.
21. All entries submitted become the property of the Promoter.
22. Except for any liability that cannot be excluded by law, the Promoter and Johnson & Johnson Pacific Pty Limited exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity and loss of profits); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (f) any tax liability incurred by a winner or entrant; (g) the prize and/ or (h) participation in the competition.
