1.STANDARD TERMS
1.1 – By entering the ‘VENI? Financial Pty Ltd – Bali Luxury Holiday Competition’ (the “Promotion”) you are agreeing to the following terms and conditions (the “Terms and Conditions”).
2. WHO CAN ENTER?
2.1 – Subject to clause 2.2, entry is open to all residents of Western Australia, over the age of 18 years whose new insurance application is lodged and approved (clause 3.2) within the Competition Period (clause 3.1).
2.2 – Directors, management, employees and their immediate families of VENIO Financial Pty Ltd, and their associated agencies and companies are not eligible to enter (Immediate family means any of the following: parent, step-parent, grandparent, step-grandparent, brother, sister, step-brother, step-sister, spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), uncle, aunt, niece, nephew, or first cousin).
3. HOW TO ENTER
3.1 – The Competition commences on 02.01.2011 at 9.00 am (AWST) and concludes on 30.06.2011 at 5.00 pm (AWST) (the “Competition Period”).
3.2 – The insurance policy application must be lodged and approved by the respective insurance company within the Competition Period.
3.3 – The insurance policy must be in force for a minimum of 15 months from date of commencement. If the policy is cancelled within 15 months from commencement, the winner agrees to repay VENI? Financial Pty Ltd the cost of the competition being $2000.00 plus the implementation fee of $750.00 and all other costs associated with cancellation of the policy including commission clawback.
3.4 – Upon successful approval of the insurance application, VENI? Financial Pty Ltd will automatically enter the names of new policyholders into the competition. Clients need to provide their email and telephone details to formally lodge their entry into the competition. Clients who do not wish to enter the competition need to lodge a withdrawal request via email to
farisen@venio.com.au or post a letter to PO Box 7602, Cloisters Square, Perth, 6850 stating they do not wish to participate in the competition.
3.5 – Only one entry per couple will be accepted into the draw.
3.6 – Entry details remain the property of the Promoter and will not be returned to the entrant. The Winner agrees to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and the Winner will not be entitled to any fee for such use.
3.7 - The Promoter reserves the right in its sole discretion to reject bulk entries which it considers to have been generated using software to generate multiple entries.
4. PRIZE
4.1 – There will be 1 prize Winner (the “Winner”).
4.2 – The Prize (the “Prize”) includes:
•4 days and 3 nights Deluxe Garden Room accommodation at The Westin Resort Nusa Dua for 2 adults only, return flights from Perth –Denpasar with Garuda Indonesia, with buffet breakfast daily and return airport transfers.
•TOTAL RRP VALUE: $2000.00
Total Prize value is a Maximum of AUD$2000.00 (including GST). Prize values are based upon the recommended retail prices (“RRP”) and are correct as of 26.12.2010. The Promoter accepts no responsibility for any change in prize value between now and the ultimate holiday date.
4.3 – Unless expressly stated in these Terms and Conditions all other expenses including but not limited to travel insurance become the responsibility of the Winner. The Winner is responsible for all expenses other than that specified, including but not limited to changes to airfare/flights, transfers, spending money, transfers, meals drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, insurance, taxes (including airport taxes), energy surcharges, gratuities, services charges, passports, visa charges and all other ancillary costs. The Promoter and the Prize Provider are not liable for any costs incurred if the Winner travels without insurance. A cash deposit may be required from the Winner upon arrival at The Westin Resort, Nusa Dua, for all incidental charges.
4.4 – Obtaining Visas, bookings and alteration to flights do not form part of the prize and are the responsibility of the Winner.
4.6 – The Prize Redemption and travel booking must be completed between 04.07.2011 to 30.09.2011 unless dates are changed by the Prize Provider. The Winner must travel between 15.07.2011 to 31.12.2011 unless dates are changed by the Prize Provider. The travel period and accommodation is subject to availability at the time of booking, is non-transferable and cannot be exchanged for other destinations. Embargo restrictions apply during certain periods.
4.7 – The Prize will only be available in the period as specified in clause 4.6.
4.8 – The accommodation type offered is specified in clause 4.2 and must be taken in consecutive nights’ stay.
4.9 – In participating in the Competition, the Winner agrees to participate and co-operate as required in all promotional activities relating to the Competition, including but not limited to being interviewed and photographed. The Winner agrees to grant the Prize Provider a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the Winner will not be entitled to any fee for such use.
4.10 – The Winner agrees they will not, sell or otherwise provide their story and/or photographs to any media or other organisation.
4.11 – Prizes are not transferable and cannot be redeemed for cash. The Winner should seek independent financial advice about any tax or financial implications that may arise from the prize winnings.
5. HOW TO WIN
5.1 – All entries completed and submitted in accordance with these Terms and Conditions will be judged at the Prize Provider’s office at Suite 22/259 Canning Highway, South Perth, 6151, on 04.07.2011. One Winner will be selected by a panel of judges appointed by the Prize Provider. The Winner will be the first entrant whose entry fulfils the entry criteria as set out in these Terms and Conditions.
5.2 – The Winner will be notified by email.
5.3 – The judges’ decision (including any decisions as to prize distribution) is final and the Prize Provider will not enter into correspondence regarding the result.
5.4 – It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form determined by the Prize Provider in its absolute discretion.
5.5 – It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize and the terms and conditions of the competition.
6. NO LIABILITY
6.1 – Subject to any restrictions in law, the liability of the Prize Provider however arising, whether by breach of any condition or warranty implied by statute or of this agreement or of any duty of tort (including negligence) is limited to the total value of the Prize.
6.2 – The Prize Provider (including their employees, officers, agents associated agencies and companies) takes no responsibility for prizes not claimed, or late, lost or misdirected mail.
6.3 – The Prize Provider (including their employees, officers, agents and their associated agencies and companies) will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: a) during the judging; b) whilst undertaking any travel / holiday won on or connected with their entry into the Competition c) in the participation in any Prize; d) as a consequence of late, lost or misdirected mail; or e) due to the publication of any material, including any statements made by any staff member, journalist, other entrants or any other person.
6.4 – The Prize Provider (including their employees, officers, agents and their associated agencies and companies) assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.5 – If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Prize Provider which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Prize Provider reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to relevant laws.
6.6 – In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions.
7. PROMOTER’S DETAILS
7.1 – The Prize Provider of this competition is VENI? Financial Pty Ltd, Suite 22/259 Canning Highway, South Perth, 6151 (the “Provider”).
7.2 – By entering this Competition you agree to VENI? Financial Pty Ltd’s use of your personal information in accordance with the Privacy Statement[K1] . All entries become the property of VENI? inancial Pty Ltd and your name may be included on a database. By entering this Competition you consent to VENI? Financial Pty Ltd including your name in future mail, email, SMS or other campaigns, and VENI? Financial Pty Ltd is solely responsible for its use of that information.
8. GENERAL
8.1 – Travel and accommodation are subject to availability at the time of booking.
8.2 – All components of the Prize must be taken together in a single trip and cannot be redeemed separately.
8.3 – Winners must provide upon request proof of residency e.g. Drivers Licence.
8.4 – Unless otherwise provided by the Convention or any applicable law, Government regulations, orders or requirements:
(a) these Terms and Conditions shall be governed by the laws of Western Australia; and,
(b) any dispute concerning or arising out of these Terms and Conditions and the Competition in any way whatsoever shall be subject to the non-exclusive jurisdiction of the Courts of Western Australia.
