MIX 102.3 $20 MILLION X LOTTO MEGADRAW COMPETITIONTERMS AND CONDITIONS1. THE PROMOTER
The Promoter is Australian Radio Network Pty Limited (ABN 95 065 986 987) trading as Mix 102.3, 201 Tynte St North Adelaide SA 5006 (the “Promoter”).
2. ELIGIBILITY
2.1 Entry is available to residents of South Australia aged 18 years or over.2.2 A person is ineligible to enter if he/she is:
a) an employee of, or contractor to, the Promoter or any of its agencies involved with this Competition; or
b) the spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), of such employees and contractors (whether or not they live in the same household); or
c) discovered to have used or attempted to use any more than one name in order to qualify to win any competition run by the Promoter except in the case of a legal change of name; or
d) a contestant or person from the same family/household who has won a prize/prizes from the Promoter or any radio station that is a member of the Australian Radio Network valued either individually or collectively at:
(i) more than $100.00 in the 30 days prior to the submission of his/her entry in this Competition; or
(ii) more than $200.00 in the 60 days prior to the submission of his/her entry in this Competition; or
(iii) more than $1,000.00 in the 90 days prior to the submission of his/her entry in this Competition; or
(iv) more than $2,500.00 in the 6 month period prior to the submission of his/her entry in this Competition; or
(v) more than $5,000.00 in the 12 month period prior to the submission of his/her entry in this Competition.
3. THE COMPETITION
3.1 The Promoter will conduct the Mix 102.3 $20 million X Lotto Megadraw Chinese New Year Cash Giveaway Competition (the “Competition”).
3.2 Participants must enter the Competition via
www.mix1023.com.au (the “website”).
3.3 The Competition registration period commences at 9.00am (CDST) Monday 31 January 2011 and concludes at 12.00 noon (CDST) Friday 11 February 2011 (inclusive).
3.4 To be eligible to win a prize in the Competition, a participant must register his/her requested details on the website, correctly identify How much could you win with Saturday X Lotto on 12th February? and explain in 25 words or less why you want to win $5000 and what you would do with your new found fortune?, during the registration period.
3.5 The Promoter will select one (1) major prize winner for the $5,000 cash prize and an additional five (5) runner up prize winners for the Instant Scratchies ticket packs from 12.30pm (CDST) Friday 11 February 2011 from the total pool of correct entries received via the website. There will be six (6) prize winners in total. All participants will be judged based on the creativity of his/her answer to the question in clause 3.4.
4. PRIZE
4.1 By participating in the Competition, a participant has the chance to win $5,000 cash payable by cheque or 1 of 5 $50 Instant Scratchies ticket packs.
4.2 The total value of prizes in this Competition is $5,250 (inc. GST).
4.3 The Promoter accepts no responsibility for any variation in prize item values. Any taxes which may be payable as a consequence of a prize winner receiving the prize are the sole responsibility of that prize winner.
4.4Instant Scratchies tickets are non-transferable and may not be redeemed for cash (save for prizes on winning Instant Scratchies tickets).
4.5If the specified prize becomes unavailable due to unforeseen circumstances, the Promoter may substitute a prize of like or equal value.
5. PRIZE NOTIFICATION
5.1.Prize winners will be notified by telephone, using the telephone number registered via the website, between 9.00am (CDST) and 6.00pm (CDST) from Monday 14 February 2011 to Wednesday 16 February 2011 (inclusive). Notification may take place on live radio.
5.2 The Promoter reserves the right to conduct such further draws as are necessary should a prize winner be unable to be contacted during the period specified in clause 5.1.
5.3 All non selected participants will remain eligible until the Competition has ended and the last of the prize winners is contacted.
6. PRIZE COLLECTION
6.1 All prizes must be collected from the Promoter’s premises, prior to 5.00pm (CST) on Friday 9 April 2011.
6.2 If any prize is not collected from the Promoter by the time and date set out in clause 6.1, prizes will be available for collection from SA Lotteries Head Office located at 24 – 25 Greenhill Rd Wayville SA 5034 until 5.00pm (CST) on Friday 29 April 2011.
6.3 Any prizes that are not collected prior to 5.00pm (CST) on Friday 29 April 2011 will be forfeited to SA Lotteries.
6.4 All prizes must be claimed in person unless the prize winner is otherwise advised. Proof of age identification, that includes a photograph, will be required at the time of collecting a prize. If any prize winner cannot provide proof of age, the prize will be forfeited, at the Promoter’s discretion. The collection of prizes is the sole responsibility of the prize winner.
6.5 Prizes will only be awarded following prize winner validation and verification.
7. PUBLICITY
Entry in the Competition constitutes provision of permission by the participant for the Promoter to use the participant’s name, suburb of residence, recording of participant’s voice and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law.
8. EXCLUSION OF LIABILITY
8.1 The Promoter accepts no responsibility for the loss of opportunity or prizes due to incorrect or imprecise details provided by a participant. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property including, but not limited to consequential (including economic) loss by reason of any act or omission, either deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for the supply of any goods or services by any person to the prize winner(s).
9. OWNERSHIP OF ENTRIES
All entries (whether in written, audio or visual form, or a combination of those) become and remain the property of the Promoter (subject to the limitations contained in the Privacy Statement).
10. DISQUALIFICATION
10.1 The Promoter’s decision is final and no correspondence will be entered in to.
10.2 The Promoter assumes no responsibility for any error, defect, delay, theft or unauthorised access to or alteration of entries. Subject to any written directions given under the applicable law, if for any reason, this Competition is not capable of being conducted as planned then the Promoter reserves the discretionary right to cancel, terminate, modify or suspend this Competition.
10.3 The Promoter reserves the discretionary right to disqualify any participant for:
a) tampering with the entry process, including exceeding any limitation on the numbers of entries, or any other process as determined by the Promoter that in any way affects the fairness of the Competition;
b) tampering with the operation of the Competition or website;
c) acting in violation of these terms and conditions; or
d) acting in an unsportsmanlike or disruptive manner.
10.4 If a participant who has been selected as a prize winner is found to be in breach of these terms and conditions, a new prize winner may be selected and, in the event that the prize winner in breach has been awarded a prize, the prize winner may be required to return the prize or reimburse the value of the prize to the Promoter.
11. PARTICIPATION
Participation in this Competition constitutes the participant’s unconditional agreement to and acceptance of these terms and conditions. The participant is responsible for ensuring his/her familiarity with the terms and conditions at the time of participation. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of the terms and conditions generally.
