TERMS AND CONDITIONS
1. Instructions on how to participate and information on the gift form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoters are Unilever Foodsolutions Australasia of 20 Cambridge St, Epping NSW 2121 ABN 66 004 050 828 and Inghams Enterprises Pty. Limited of 203 Northumberland Street, Liverpool NSW 2170 ABN 20 008 447 345
3. Promotion is only open to selected Bidvest foodservice customers as determined by the Promoters (“Eligible Businesses”).
4. Promotion commences on 01/03/2011 and closes at 5pm Sydney local time on 31/03/2011 (“Promotional Period”).
5. There are two (2) type of gifts available unde this offer as follows: Gift A & Gift B. Gift A is twin pack of Windy Peak valued at $33.98. Gift B is a six (6) pack of Windy Peak valued at $101.94.
6. To be eligible to receive Gift A, an Eligible Business must, during the Promotional Period, place an order to purchase, in one transaction, a minimum of two (2) cartons of the following ‘Participating Inghams Products’ and a minimum of one (1) unit of the following ‘Participating Unilever Products’ through Bidvest. To be eligible to receive Gift B, an Eligible Business must, during the Promotional Period, place an order to purchase, in one transaction, a minimum of four (4) cartons of the following ‘Participating Inghams Products’ and a minimum of two (2) units of the following ‘Participating Unilever Products’ through Bidvest.

7. After the conclusion of the Promotional Period, Bidvest will advise the Promoters of which Eligible Businesses have qualified and the Promoters will send out a claim form to the Eligible Business who qualifies for a gift. An authorised representative of the Eligible Business who is aged 18 years or over, must during the Promotional Period, complete and return the official claim form, by fax to 1800 008 405 by 5pm Sydney local time on 15 April 2011. By submitting the claim form, the authorised representative of the Eligible Business warrants he/she is aged over 18 years of age and is authorised to do so by the Eligible Business and claim the gift on behalf of the Eligible Business.
8. The Promoters reserve the right, at any time, to verify the validity of claims and Eligible Businesses and authorised representatives (including their identity, age and location) and to disqualify any Eligible Business or authorised representative who does not submit a claim in accordance with these Terms and Conditions or who tampers with the claim process or benefits from such tampering. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights.
9. Photo ID will be used solely for the purpose of age identification
10. Incomplete, indecipherable or illegible claims will be deemed invalid.
11. Notwithstanding any other provision, a maximum of two (2) gifts can be claimed by an Eligible Business through an authorised representative on its behalf. Limit of one (1) gift claim per eligible order.
12. The Promoters’ decision is final and no correspondence will be entered into.
13. For each valid claim received the Eligible Business will receive either Gift A or Gift B depending upon the relevant order placed by the Eligible Business. The gift will be addressed to the authorised representative of the Eligible Business (being the person who completed the claim form) and delivered to the Eligible Business. Gifts will be supplied and the delivery of the gifts will be arranged through Vaniworth Pty Ltd (ABN 59 055 152 040) NSW Liquor Licence No. (LIQP770010113). It is against the law to sell or supply alcohol, or to obtain alcohol on behalf of, a person under the age of 18 years. The gifts will only be delivered during normal business hours to the authorised representative of the Eligible Business who is aged 18 years or over who completed the original claim form. The Promoters and Vaniworth Pty Ltd are not responsible should the authorised representative who completed the original claim form not be at the place of delivery. Any costs to re-deliver the gift will be the responsibility of the authorised representative. Suitable photo ID of the authorised representative must be shown upon request before the gift is handed over to them. Unless due to reasons beyond the control of the Promoters, the gifts will be awarded within 28 days of the end of 15 April 2011.
14. If any gift (or part of any gift) is unavailable, the Promoters, in their discretion, reserve the right to substitute the gift (or that part of the gift) with a gift to the equal value and/or specification.
15. Gifts are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Business; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify any statutory consumer guarantees implied or any condition or warranty the exclusion of which from these Terms and Conditions would contravene any statute or cause any part of the Terms and Conditions to be void (“Non-Excludable Guarantees”).
17. Subject to the limitations in the preceding sentence, the Promoters exclude from these Terms and Conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoters (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any claim form or gift that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Eligible Business or recipient of the gift; or (f) use of a gift.
18. The Promoters collect personal information, including that of the authorised representative in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities. Participation is conditional on providing this information. The Promoters may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, and research purposes, including sending electronic messages or telephoning the Eligible Business or the authorised representatives. Authorised representatives should direct any request to access, update or correct information to the Promoters. All correspondence sent to the Promoters, unless otherwise advised, becomes the property of the Promoters.
